I contacted Witness Sandra Leal and she told me the following information in summary: On 02-03-16 during the morning, Leal contacted Bautista in regards to an appointment on they had on 02-02-16. Leal was reportedly advised by Bautista that her son, Suspect Maradiaga grabbed her by the neck and

pushed her into some furniture. Maradiaga also threatened to kill Bautista, NFD. Oakland Avenue to investigate the incident. Upon our arrival, we learned that no one was inside of the residence. We contacted Bautista who advised us that she was picking up her son Maradiaga from the Sierra Madre Middle/High School. Bautista told us she would be home later during the afternoon.
At approximately 1650 hours, Officer Cass and I responded to the residence. Upon our arrival, we contacted Victim Kenia Mendez-Bautista, who told me the following information in summary: On 02-03-16 at approximately 0500 hours, Bautista attempted to wake Maradiaga for school. Maradiaga was sleeping on the couch in the living room. Maradiaga reportedly told Bautista that she was “bugging” him. Bautista again told Maradiaga to wake up for school as she walked back into her bedroom.
Maradiaga threw a shoe at Bautista which hit the bedroom door instead of her. Bautista picked up the shoe and hit Maradiaga twice against his left arm. Maradiaga stood up from the couch and raised his right arm as if he was going to strike Bautista. Bautista was facing Maradiaga as they stood in the living room. Maradiaga then grabbed Bautista around her chest with both arms, “bear hug” and forcefully pushed her onto the couch along the north side of the living room. Maradiaga fell on top of Bautista as they landed on the couch. Maradiaga reportedly began yelling, “I’m tired of you bossing me around! I don’t give a fuck, call the police! I want to go back to Honduras!”

Maradiaga then let go of Bautista and went back to sleep on the couch. Bautista advised me that they moved from Honduras to the United States approximately two years.
Bautista and Maradiaga’s father Oscar Maradiaga are currently separated. Oscar still resides in Honduras.
Bautista told me that she was not injured as a result of the assault. Bautista told me that she fears Maradiaga will continue to assault her if he remains inside of the residence. Bautista is desirous of prosecution against Maradiaga. Bautista told me that Maradiaga has a scheduled court date at East Lake Juvenile Hall on 02-04-16.
I spoke with Witness Diana Fuentes, who also resides at the above location. Fuentes corroborated Bautista’s statement and told me the following information in summary: Fuentes saw Maradiaga grab Bautista around her chest with both arms, “bear hug” and forcefully pushed her onto the couch along the north side of the living room. Fuentes saw Maradiaga fall on top of Bautista as they landed on the couch. Fuente then heard Maradiaga yell, “I’m tired of you bossing me around! I don’t give a fuck, call the police! I want to go back to Honduras!” Fuente saw that Maradiaga let go of Bautista and he went back to sleep on the couch. Fuente left the residence and is unaware if anything else
occurred. It should be noted that Maradiaga is currently on probation for PC 245(a)(1)-Assault against his mother Bautista. I contacted Maradiaga’s Probation Officer Rancher in order to advise him of the incident (626-201-0604). I left a message for Rancher to contact me in regards to Maradiaga. Maradiaga was arrested for PC 243(a)-Battery. Sergeant Tucker #8547 approved the arrest. Officer Cass and I transported Maradiaga to the police station. Officer Marin #5450 advised Maradiaga of his constitutional rights per Miranda. Maradiaga understood his rights and refused to give a statement (See attached Glady’s R. Interview). Maradiaga was later booked at the Pasadena Jail. Officer Cass and I transported Maradiaga to East Lake Juvenile Hall for housing. DISPOSITION: Case Youth and Family Services.

First, we must consider the facts of the case, specifically the ones that surround this event. Julia Navarro has had a history of erratic behavior, she was described to have walked around her previous apartment at night, as if in a trance, and it took several minutes for another person calling her name to get her to respond and come back to consciousness. She has also had a history of claiming to hear voices and see shadowy figures that call her. Julia appears to have schizophrenia but has never formally been diagnosed with any mental illness. It has been said that since moving to Myrontonia, her condition has worsened.

For the first mock trial held in class, the case of the stolen lunch, I did not have a large role. I chose to be a part of the jury, which I feel gave me an immense feeling of responsibility and really allowed me to deeply analyze the case as it was being presented. Within this case, Mary Ovechkin, the plaintiff, had claimed that her lunch had been stolen and ate by the defendant, Sammy Crosby. My first expectation of this case, before it had actually started, was that the defense and prosecution would each have time to present their cases. I expected both sides to question those who were involved, such as the witnesses, defendant, and plaintiff. Then I expected to have to come up with my own verdict to share with the rest of the jury based on the evidence presented. Based on my role, I expected to learn how the jury reaches their decisions.
