arrival, we met with Victim Claribel Gomez at the above residence. Gomez told me the following information in summary: Gomez and her husband, Suspect Humberto Rivera have been married for sixteen years and have five children with one another. On 10-18-15 a domestic battery incident occurred at the residence between Gomez and Rivera. The Pasadena Police Department responded to the residence regarding the above incident (refer to case #1514550 for additional information). On 12-29-15, Gomez was granted a restraining order against Rivera for domestic battery through the Pasadena Court which expires on 12-29-18. Gomez told me that Rivera was served with the restraining order. Gomez told me that they are still married to one another. Gomez told me that she could not find the restraining order. On 02-16-16 at approximately 0840 hours, Gomez was sleeping in her master bedroom inside the residence. Gomez woke up to see Rivera walk into her bedroom. Gomez immediately told Rivera to leave the residence. Rivera reportedly stated, “I’m not going to leave.” Gomez told Rivera if he did not leave that she would contact the police department. Rivera yelled, “Then I’m going to call your boss!” Rivera then laid down in the bed next to Gomez. Gomez stood up out of her bed and began to gather her two young children in order to leave the residence. Rivera also stood up and used both of his hands to grab Gomez by her upper shoulders. Rivera shook Gomez approximately two times, in a back and forth motion and yelled, “You are not going anywhere!” Gomez was able to use her arms to break free from Rivera’s grip. Rivera reportedly left the bedroom and walked toward the front door of the residence.
Gomez immediately contacted the police department to report the incident. Gomez walked past Rivera, who was standing in the living room. Gomez walked toward the front door with both of her children. Rivera reported stated, “You are missing money from your purse” as Gomez walked past him. Gomez then saw Rivera walk out the front door of the residence. Approximately two minutes later, Gomez exited the residence and saw Rivera standing along the driver side rear tire of her GMC Yukon California license plate #5ENW878. The vehicle was parked in the driveway located along the north side of the residence. Gomez reportedly heard what appeared to be air rapidly being released from her rear tire. Rivera then ran out of the driveway, along the south side of the residence and out of sight. Rivera placed her children inside of the vehicle and saw that her driver side tire was flat. Gomez then checked her purse and saw that $800.00 in US Currency was missing. Gomez described Rivera as a male Hispanic, 35 years of age, 5’05” in height, 180lbs., dark complexion, with short hair, wearing a black shirt, black pants and no shoes,
NFD. Gomez stated she does not have video surveillance at her residence. I saw that Gomez’ driver side rear tire was flat. I took a photo of the rear tire (see attached photo). I spoke with Gomez’ brother in law Salvador Rivera who told me he witnessed the entire incident and confirmed her statement. Officer Cass and I attempted to locate Rivera inside of the residence and surrounding area with negative results. We also attempted to locate video surveillance or any witnesses but met with negative results. I conducted a crime broadcast and the bulletin was updated. I had PPD Records confirm that the restraining order was valid with proof of service given (see attached printout). I recommend that Suspect Humberto Rivera be additionally charged with PC 236 False imprisonment, PC 273.6-Retraining Order Violation and PC 594(a)-Vandalism. DISPOSITION: Case to Detectives.

On Tuesday, 08/02/2016, I, Deputy Stacy Stark #1815, received a telephone call from the victim, Cara M. Morrison (F/W, DOB: 09/27/1989). Morrison called to report she went to Midwest Cash located at 1200 W. Main St. Carbondale, Illinois to pawn another television she owned for cash. While at Midwest Cash, she recognized her stolen television advertised for sale. Morrison did not have the serial number of the television she reported stolen on 07/29/2016, so she was unable to verify to the clerk the television was hers. Morrison remembered she used the stolen television for collateral at a local cash loan business in the past. Morrison went to the cash loan business and was able to retrieve the identifiers on her television, including the serial number. The day Morrison was returning to Midwest Cash to verify the television was hers, she brought along her boyfriend, Rodney J. Tully (M/W, DOB: 05/26/1988). Prior to arriving at Midwest Cash, Tully told Morrison they were
