The Occupational Safety and Health Act
Just imagine working in an environment where there are very few safety regulations, and little safety equipment. Think of how it was for employees of a steel manufacturing plant to work where there are almost no safety regulations and safety hazards all around you. This is how the work environment was before 1970; there were only few laws or regulations that required employers to maintain certain safety standards or working conditions for employees. However in 1970 President Richard Nixon sought to change all of this by signing into law the Occupational Safety and Health Act (OSHA).
The Occupational Safety and Health Act’s mission is to assure the safety and health of America's workers by setting and enforcing standards; providing training, and education; and encouraging continual improvement in workplace safety and health (OSHA.org). OSHA covers an extremely wide array of workers, from construction workers to office workers. However when the act was first passed it was not heavily enforced and lacked inspectors. In 1970 because there were three times as many fish and game wardens than there were OSHA inspectors, people said that the trout and quail were more protected than Americas working men and women (Bennett, Alexander, & Hartman, 2003). The OSH Act gave OSHA the authority to come into work places and inspect facilities for health and safety risks. Due to shortages in personnel, OSHA inspects accidents and safety complaints that are filed, and those facilities that have a high volume of accident rates. If an individual state has an approved safety and health enforcement plan, than they may be exempt from yearly inspections by OSHA and have their own state personnel conduct the inspections. The Act sets a maximum penalty for safety and health violations, but OSHA has the authority to calculate fines. If an industry objects to the citation or fines, they can go before the Occupational Safety and Health Review Commission. OSHA has been criticized on both ends, by industries for being too strict, and by unions for not being strict enough. In the 1980s, OSHA had instituted a policy that would exempt some workplaces from a complete inspection if they had a lower than average injury rate. However, that policy was abandoned when an employee died from a workplace that OSHA had not fully inspected. OSHA has implemented new procedures that have set higher penalties and increased the maximum fine for all types of infractions.

The Fair Labor Standards Act The Fair Labor Standards Act (FLSA) was passed by Congress on June 25th, 1938. The main objective of the act was to eliminate “labor conditions detrimental to the maintenance of the minimum standards of living necessary for health, efficiency and well-being of workers,”[1] who engaged directly or indirectly in interstate commerce, including those involved in production of goods bound for such commerce. A major provision of the act established a maximum work week and minimum wage. Initially, the minimum wage was $0.25 per hour, along with a maximum workweek of 44 hours for the first year, 42 for the second year and 40 thereafter. Minimum wages of $0.25 per hour were established for the first year, $0.30 for the second year, and $0.40 over a period of the next six years.

In a reoccurring theme of Hollywood, the villains in these films are almost always foreigners or people of color. This is a stereotype. On the other side of the spectrum, we often see that the heroes of these films are most often than not white males. This is another stereotype. Within the last few years, we’ve seen actors such as Will Smith, Morgan Freeman, and Zoe Saldana take the lead roles, so it can’t be said that there are no non-white heroes, but there certainly isn’t many. Hollywood action movies, moreover than other genres, are typically loaded with an abundance of stereotypes. The way these movies are composed and structured can tell us a great deal about the views held within the American psyche and who holds the social power. The harsh reality is that the media ultimately sets the tone for societal standards, moralities, and images of our culture. Many consumers of media have never encountered some of the minorities or people of color shown on screen, so they subsequently depend on the media and wholeheartedly believe that the degrading stereotypes represented on the big screen are based on fact and not fiction. Mary Beltran said it best when she stated in her “Fast and Bilingual: Fast & Furious and the Latinization of Racelessness” article, “ultimately, Fast & Furious mobilizes notions of race in contradictory ways. It reinforces Hollywood traditions of white centrism, reinforcing notions of white male master while also dramatizing the figurative borders crossed daily by culturally competent global youth – both Latino and non-Latino” (77). Nowadays, it has been difficult to notice the harm media is doing to society. It has become too normal that we are already used to deny the reality. I have read several readings that have opened my eyes to the reality of media; A Crash Course on Hollywood’s Latino Imagery by Charles Ramirez Berg, (Re)presenting: Muslims on North American television by Amir Hussain, True Diary of a Part Time Indian by Sherman Alexie and The Paper Menagerie by Ken Liu. These readings include an important message about minority races, which I believe society should be aware of. All of the readings that I previously mentioned have something in common, they all examine the way race is portrayed in media. Moreover, they also include how media can potentially shape our perceptions of who we are and who others are. Our young community are the ones that are being most affected by media. Children receive messages in T.V shows, cartoons, movies and books of how different races supposedly are, and they immediately start assuming that those messages are true and continue growing up with that ideology.
The author and I are experiencing the same point of view on how the media influence people around us. This article is not only written for any particular group, race, ethnicity, gender, etc… I think as a human being, this article is related to all of us. The author has done an outstanding job for all of us by describing as people how the media represent a big problem for our society or our community. I learned a valuable lesson from this article, which I also discovered that central Africa women must have hips, but because of the western image that value is no longer applicable. I also encourage everyone to stay focused and love their culture while watching some TV shows because it is easy to forget about who you are and adopted another way of doing things you never used to do before.
Employers negligent in providing health and safety in the work environment could become criminally charged, fined or sent to jail. Providing an unsafe workplace is no longer considered just as morally unjust, but an act of crime. Health and safety in the workplace has become more encompassing and broader, accepting new causes and problems that influence occupational health and safety. Health is no longer just defined as wellness of the physical body, but also wellness of the mind. Mental health is considered an area of workplace safety.
