Having established that the U.K. offers celebrities extremely limited rights over the use and distribution of their image for commercial purposes, and that case law indicates that the tort of passing off is applied on a somewhat unclear and inconsistent basis, the 2013 case of Robyn Rihanna Fenty and others -v- Arcadia Group Brands Limited acted as a landmark case with regards to publicity rights and the tort of passing off. (i) The Facts, Judgement and Effect Robyn Rihanna Fenty, most commonly known as the pop star Rihanna, brought proceedings against Arcadia Group Brands LTD (Topshop) over their use of her image on a T-shirt (see appendix one) that they produced without seeking Rihanna’s permission prior to use. The image in question had been taken by an independent …show more content…
Birss J held that Rihanna is “style icon by many people, predominantly young females aged between about 13 and 30” and as a result, these people are extremely interested in what she views as stylish. By holding contracts with fashion outlets such as H&M and River Island, including her own fashion brand, it was clear to Justice Birss that Rihanna has ‘ample goodwill to succeed in a passing off action.’ The main issue however, was in relation to the misrepresentation aspect of the claim. Birss J stressed that a critical issue in cases of this type is to identify the differentiation between the two separate reasons why a customer might wish to purchase the garment in question; as he explained in paragraph [35]: "If when they buy the t-shirt, they simply wish to buy an image of the pop star, then no misrepresentation has taken place. Merely recognising that the image is an image of the celebrity can never be sufficient to make the claimant's case. For passing off to succeed there must be a misrepresentation about trade
A celebrity is not a person known for his/her talent or achievement, but an individual recognized for his/her reputation created by the media. The phase of stardom is slippery, and media may choose to represent celebrities varying from exaggerated admiration to mockery. The three texts chosen, movie "Sunset Boulevard", feature article "Over the Hilton" and television show "Celebrity Uncensored Six" are texts presenting different perception of celebrities than their usual images - either corrupted by the encircling media, overloads oneself with self-indulgence, or just mocks celebrity in a broad spectrum. Such media items empower and impresses the audience by perceiving celebrities as people who pay the price of privacy to gain well knowness, signifying the vanity of stardom from the commonly accepted images.

In today’s world, celebrities are often misunderstood, especially singer/songwriter Robin Rihanna Fenty, referred to as Rihanna. Rihanna’s sexual behaviors in her videos have been talked about in negative ways for some time now, but what [eople do not understand is that it is all for fame. Celebrities will do anything to keep their career going strong. If one really took the time out to take a deep look at Rihanna, they will notice how humble she really is. After going through the abusive relationship with Chris Brown, Rihanna has struggled with gaining that strong confidence with who she is. Her critics believe that she is still trying to discover herself and figure out who she really is as a person. Rihanna is often given two choices, to do what she is being asked to do, or throw her career out the window. She either gives the crowd the sexual acts they want or let her career die down. In the song “S&M,” Rihanna was really exposing herself to the crowd, as well as “Good Girl, Gone Bad.” She is basically telling the crowd that this is the person she is, but is it really? For my original piece I will be creating a journal, expressing the feelings Rihanna felt as she overcomes her struggles. Rihanna’s sexual behaviors in her videos are really all for fame and therefore, are easily misunderstood.

There are others ways to express ourselves that are no based on our appearance. Through drawing, painting or through our thoughts and ideas. According to Aristotle, a tragic hero is a literary character born of nobility and gifted with heroic qualities who, because of their tragic flaw, experiences a downfall which leads to their own destruction. Celebrity culture today is epidemic; some might agree that it is sweeping up America in a harmful way, while one might argue that it is beneficial to our society. Over the last few decades, celebrity and fame has changed dramatically, from Alexander the Great to Kim Kardashian. Talent and achievements no longer play a huge role when it comes to celebrities. “Much modern celebrity seems the result of careful promotion or great good looks or something besides talent and achievement” (Epstein2) with that being said celebrity-creation has blossomed into an industry of its own.... ...
