From the reading “Ethical and Legal Issues in U.S. Education”, there were three points that that surprised me. One point was that it is so surprising to me that there are so many steps that a teacher, on tenure, must go through before they get fired. It makes it so difficult to be fired and such a long process that they will never be fired unless they commit a major crime and I believe that this should change. As a teacher, we need to be at the top of our game at all times, and teachers with tenure seem like they do not always have to in order to keep their job. It is also surprising to me that student teachers do not receive the same rights as normal teachers in some states. I agree that teachers must think before they act and process the best consequence to the action that he or she will or will not do in class. The book makes a point on talking about how teachers must thoughtfully decide if what they are doing every single day. I believe that that is a crucial quality every teacher must have in order to avoid major issues in the classroom. It is amazing how much can change when a teacher, or anyone, thinks about what they are doing before they do it and what are the possible consequences are based on their action. Better than thinking about it, if they talk to one another, as teachers, on how they should act, this would help them even more to make the right decision. I also agree teachers deserve the right to due process, just like everyone else in their profession. Being a teacher is very difficult, and it is very important that teachers are not constantly scared to lose their job with one bad choice. There are so many parents out there who will immediately try to get the teacher fired in any way they can in order for their child to be happy which is very threatening to teachers everywhere. The fact that due process is given to teachers is extremely important for the sanity of teacher’s minds and their performance as teachers. Lastly, I agree with tort liability because teachers must be on high alert at all times with their classroom. Any possibilities of injury in the classroom must be thought about by the teacher and prevented in anyway. Teachers are one hundred percent liable to what goes on in their classroom and they need to pay attention to all kinds of behavior that could lead to danger. A teacher’s most important duty is to protect the students they are in charge of. This duty includes both reasonably protecting students from harm and, when a student is harmed, reporting it to the proper authorities (Gooden, Eckes, Mead, McNeal, & Torres, 2013, pp. 103-109). There have been many court cases that reiterate this duty of school staff. One such case is Frugis v. Bracigliano (2003) where many staff at a school failed in their duty to protect students and allowed abuse to continue for years.
He also argues that without tenure it would to be easier to fire the 10 percent of teachers that are poor performers. I personally agree with Matthew Miller’s proposal.
The Alabama Educator Code of Ethics is designed for every educator in the state of Alabama. The Code must be implemented for the safety of students and educators. The goal of the Alabama Code of Ethics can be accomplished as long as all educators value the worth and dignity of all students, parents, and staff. There are nine Alabama Educator Code of Ethics and Standard 1: Professional Conduct, Standard 4: Teacher/Student Relationship and Standard 5: Alcohol, Drug and Tobacco Use of Possession are the most important standards.
Tenure is a type of job security that professors earn once they reach an exact level of expertise. Once a college professor has earned tenure, they need to be able to follow the teaching contract as long as they abide by the rules set forth in their contracts. It's believed that students are able to gain help from the expertise and skill of an untenured teacher. A number of the protections are extended to an irremovable teacher so that they can't be discriminated against their personal views, temperament conflicts, or any space that's not instructional. The statutes for academic tenure in higher education and dismissal vary from state to state, however altogether all are smart in standing and should be offered employment. This therefore will make sure professors won’t be fired for unnecessary issues. Tenure won't shield professors, but will help with those whom are ineffective or incapable.
As mentioned the authors did argue some strong logical points. One of their strongest points just might be when they mentioned how tenure should be replaced with multiyear contracts. “Professors who possess it have no reason to improve their teaching, take on introductory courses, or, in fact, accept any tasks, not to their liking.” (Hacker and Dreifus 181). Some might argue better yet some will argue that “if he/she has been teaching a long time then they deserve to be granted tenure”, but wouldn’t it be better for our future and our children’s future if those who continues to teach well

Professors with tenure, contend Hacker and Dreifus, are not motivated to perform well and therefore will engage the students in the way Hacker and Dreifus believe they should. To correct this, Hacker and Dreifus advocate for tenures to be replaced with multiyear contracts to ensure professors work hard for their own benefit and for the benefit of the students’. Keep the teachers in the classrooms inspiring young minds rather than taking unnecessary paid vacations, assert Hacker and Dreifus, who believe sabbaticals should be limited. Hacker and Dreifus also agree that adjunct teachers, professors who teach at a college but do not receive the same benefits as their peers who are, in fact, faculty members, should receive similar benefits. The United States has proven to be a world leader with their powerful military, democratic government, and stringent foreign policies. There is one category however, the United States struggles to be number one in, education. As shocking as this may sound, the public school system in America is not superior to other developing countries. I have witnessed this scandalous phenomena firsthand, engrossed in the public school system from kindergarten to freshman year of high school. The student body and the school administration is morphing into a nonproductive system with a zombie-like attitude. American students lack academic drive and curiosity compared to European and Asian countries because the standard for academic success is constantly lowered. Americans must reform the school system and change their perspective on how important an education is to the rest of the world.
Tenure is a policy that has been designed to protect teachers from false accusations and various injustices that may take place throughout ones career. For example, one of the rights afforded a tenured teacher is they cannot be discriminated against based on their personal views or belief systems outside of the educational arena. Also, they cannot be terminated without full due process. Tenure will not, however, protect educators who are incapable, ineffective, or are in violation of school board rules (Essex, 2012).
Did you know that most schools have a lemon teacher? Those are the teachers that exploit the union by being a very poor performing teacher that has a secure job because the union states that cannot be fired and are guaranteed their jobs for up to 10 years. Another problem with lemon teachers are if they are “suspended”, they can still get paid. The documentary “Waiting for Superman” gave an example of the lemon teachers in New York still getting paid, even while they are suspended and are in a room to learn what they did wrong but instead they just play cards and sleep. Canada pins the blame on tenured teachers who cannot be taken out of the system. The Florida Department of Education has its own specific Code of Ethics just as any other state in the united state. 6B-1:001 is the Codes and 6b-1:006 are the Principles. As an educator in Florida one is expected and required to follow all the codes and principles. To be sure to not get into trouble an educator must follow the all the Principles of Professional conduct for the Education Profession. There are many obligations involved, ones to the students, ones to the public, and ones to the profession. By breaking those rules one can have their educator’s certification revoked and not be permitted to teach in Florida or they could also be punished by the law enforcement (1).

Right to education is a human right recognized by the United Nations. It includes the entire compulsion to eliminate inequity at all levels of the educational system.
