If Uber has a written agreement, then the company would have known which avenues to explore without the need for litigation or court cases. However, the company is settling the case even if they have a valid case against the dismissed driver. This highlights a challenge with Uber’s hiring process, working practice and relations with their contractors. Milner (2012, p. 207) notes that a written contract documents the intricacies of the working conditions from the job description, pay, working hours and conduct and this help guide both the contractor and the service owner.
