Gender is not anatomically decided. Transgenders, Cis-genders, Genderfluid, and Nonbinary persons are held at different standards, and given varying rights based on their gender expression. Cis-genders, or those who identify with their birth gender, are often held above all others, while their is a misogynistic separation between male and female persons within the Cisgender community. Transgenders, or those who identify with the gender opposite that of their birth gender, are often abused, harassed, and even killed over their gender expression. Genderfluid, those whose gender preference may change over time, including male, female, Nonbinary, or a combination of such, and Nonbinary, those who identify as neither male or female, receive little attention and recognition creating problematic scenarios such as public restroom and utility usage.

One key fact forgotten by conservatives and Transphobia in Texas, and nationwide, is “men” will not be entering women's bathrooms. Transgender women, and Genderfluid women will be, never men. As far as violence against women in public restrooms is considered, there are current laws in place preventing such events. Cities allowing non gender conforming peoples to enter the restroom of their gender identification also saw no spike in restroom violence or sexual attacks (Berman). In fact, there is no documented encounter of a Transgender person committing an act of violence or crime in a public restroom.
