Purchasing my first home was a monumental moment for me, yet there were so many steps involved. The acquisition was a process, far more extensive than I had ever realized. I had select criteria, and felt I satisfied this well. As a mother I needed a clean and safe environment in which to raise my daughter; as a first time home-buyer, I had to do this within a modest budget. I found a quiet little neighborhood on the edge of town; it was a dream come true. It was the perfect family neighborhood. I bought a cute little house in a cul-de-sac, no more apartments, and no more stringent guidelines. I had a protected investment and felt in control. I am not an experienced home-buyer, so it is quite possible I missed a few warning signs. My neighborhood is replete with rental properties. Neighbors came and went, few with lasting ties. There was a noticeable decline in property maintenance, as well as morale. If you’ve ever mistaken the neighbor’s home for a yard sale, then you know what must be done. In order to protect our investments, the residents of Windsor Village need to organize a homeowner’s association.
Poor property maintenance in Windsor Village is an area of great concern. Appearance is a key factor in either buying or selling a home. Towns establish by-laws in attempt to ensure this, the problem is these by-laws are fairly limited, and not always enforced. Property value can rapidly decline as a result of this. Neighborhood comradery helps, but the decisions of others affect all. In the absence of covenants, freedoms are unlimited. Homeowners associations have been criticized for having excessively restrictive rules and regulations on homeowners. Too stringent of regulations established by the homeowners association may suppress the rights of the residents. This can be easily avoided, in an existing neighborhood, as we are in control of our elections. We are all faced with the same problem, and provided with a feasible and effective solution.
Implementing a homeowners association will greatly benefit the residents of Windsor Village. We have the power to restore our property values, and the appearance of our neighborhood. Together this can be easily accomplished, and provide a lasting solution.
The Crossroads development has dominated the local conversation in Mahwah for the past 9 months. Over the past few years, the Crossroads Developers had put forth various proposals for development of the site, only to have them rejected by the Mahwah Township Council. This past March, the Developer once again came to the Council in order to ask that their property be rezoned from office use to mixed-use/retail to allow for the construction of a complex of retail stores, restaurants, a movie theater, hotel and office space. Over 400 residents attended the March 31 meeting to express their opposition to the development. This unprecedented turnout by Mahwah residents, unlike any the Council had seen before, should have been enough for the Council to realize that a decision to rezone the property may not be in the best interests of Mahwah residents. Instead, the Council voted 4-2 to allow for the property to be rezoned.

This organization requires that potential homeowners assist in the building of their home or others to reduce the financing cost of homeownership. The importance of social context in Land Law and the reforms which have occurred as a result cannot be ignored or their significance understated. In particular is the impact of the shift in the twentieth century to ‘emergence of a property owning, particularly a real-property-mortgaged-to-a-building-society-owning-democracy’. Such growth could hardly have been anticipated when the LPA 1925 was drafted and subsequently became statute. As a consequence of this growth the doctrine of the resulting trust and to a greater extent, the constructive trust became a robust mechanism by which non legal owners could establish beneficial interests in the home. Swadling comments on the ‘complete change in attitude’ between the emphasis on security of ownership of the home in Boland and the free marketability of land which we see in Flegg. He states ‘one wonders what has happened to the demands of social justice which justified their Lordships decision in 1980 (in Boland) over such a brief passage of time’. Did the House of Lords fail to resolve the very practical issue with which they were presented that had evolved over the passage of social change since the drafting of the 1925 legislation?
Lately I have noticed numerous abandoned buildings around the Battle Creek area; the sight makes our city look run down and cheap. I believe something must be done about this issue such as turning the buildings into new city attractions. Two vacant buildings that come to mind are the run down State Police Station and the dilapidated Family Fare store.

As the lease of my apartment is coming to an end it had me thinking of achieving my own American Dream of home ownership but as I do my research I find the dream is far from coming true. I am sure that the issue of housing prices and rent rates are what most of us Bay Area residents talk about and debate. It is an issue that needs to be addressed by the officials of the area, city mayors, affordable housing committees, social justice activists,lawmakers, and even employers. Skyrocketing prices, low inventory, and investors’ bidding wars are not only pushing the middle and lower classes out of San Francisco and the Bay Area out but will completely eliminate them.
Community Land Trust of Palm Beach County (CLT of PBC) : Formed in early 2006, and received its 501(c)(3) tax exempt designation in March of 2007. It is a countywide housing non-profit organization created for the purpose of providing permanently affordable housing opportunities for residents of Palm Beach County. 25% of one of its properties’ units, La Joya Villages will be set aside for families earning no more than 50% of the area median income. For its other property, Davis Landings, the Department of Economic Sustainability (DES) partnered with CLT of PBC to build the 25-unit affordable family rental community on 2.13 acres. It is of the recommendation of this lawyer that the action of the Department of City Planning in regulating the properties of the NYAEE owners has violated the vested rights of private property ownership. People commonly believe that property values decline when blacks or non-white move into a neighborhood. However, the real reason why property values decline is because of whites moving away and taking their resources with them. White homebuyers fear that property values will decline rapidly when nonwhite residents begin moving into a neighborhood. What they do not take into consideration is that the nonwhite residents may be their socioeconomic equals. Instead, they focus on race—they categorize individuals into socioeconomic classes on the basis of race. When whites or well-intentioned residents move away, businesses and jobs soon follow suit, thus, creating improvised neighborhoods.
The housing boom created an illusion of ever increasing home equity. It was difficult to walk away from potential homes that seemed good on the surface, but in reality were either money pits or less than desirable. For the uninitiated, making sense out of the chaos when things start to go wrong is an emotional process that lends itself to the gradual disposal of the rose-colored glasses. The upkeep and maintenance that homeownership requires of the inexperienced homeowner, particularly an older home, is comparable to taking on a new entry-level job with diminishing returns. There is a prevailing chaos amid the turmoil of a broken water pipe during a holiday weekend.
Buying and owning your home is part of the American dream. Although the dream itself has since changed, the home still remains the main focal point. Today owning a home doesn’t necessarily mean a house. People now buy duplexes, cooperative apartments, and condominiums. For some families it could take up to a couple of generations before it’s able to have the capabilities of buying a home. To many people it means a certain achievement that only comes after years of hard work. It is a life altering decision and one of the most important someone can make in their lifetime. The reasons behind the actual purchase could vary. Before anything is done, people must understand that it’s an extraneous process and it is a long term project.
This is not a popular solution with the community because of the expense issue. Yet, that is what the funds are for. Home owners pay home association fees for what the community needs.
