What seems to most like the debate of the West versus the rest, the debate of whether to enforce universal human rights of individuals (set forth in documents such as the United Nation’s Universal Declaration of Human Rights (UDHR)) or to promote difference and recognize group rights, is as alive as ever in recent years thanks to intellectuals like Seyla Benhabib, Martha Nussbaum, Chandra Mohanty, Susan Okin Moller and Charles Taylor. The primary question behind this debate of universal legal principles versus group rights is whether or not a concept of universal justice exists. In the past, the French government granted certain French citizens capabilities that no other citizens had. One of those abilities was the right to contract polygamous marriages. She recognized that the granting of these rights create a snowball effect for more group-exclusive rights. Every day, people are denied basic necessary human rights. One well known event that striped millions of these rights was the Holocaust, recounted in Elie Wiesel’s memoir, Night. As a result of the atrocities that occur all around the world, organizations have published declarations such as the United Nation’s Declaration of Human Rights. It is vital that the entitlement to all rights and freedoms without distinction of any kind, freedom of thought and religion, and the right to a standard of living adequate for health and well-being of themselves be guaranteed to everyone, as these three rights are crucial to the survival of all people and their identity.
In its first article, it states “Men are born and remain free and equal in rights. Social distinctions may be founded only upon the general good (emphasis mine).” The first part of the paragraph does not exclude any person (while it can be disputed that it is ambiguous with the status of women) and serves the equalization of all people, regardless of the birth. It disposes any assumed privileges of the nobility, and if read in conjunction to the sixth article, is not shy from stating that the source of power or the imperatives of the government rests at the hand of the public. Society has long since considered women the lessor gender and one of the most highly debated topics in society through the years has been that of women’s equality. The debates began over the meaning between a man and woman’s morality and a woman’s rights and obligations in society. After the 19th Amendment was sanctioned around 1920, the ball started rolling on women’s suffrage. Modern times have brought about the union of these causes, but due to the differences between the genetic makeup and socio demographics, the battle over women’s equality issue still continues to exist. While men have always held the covenant role of the dominant sex, it was only since the end of the 19th century that the movement for women’s equality and the entitlement of women have become more prevalent. “The general consensus at the time was that men were more capable of dealing with the competitive work world they now found themselves thrust into. Women, it was assumed, were unable to handle the pressures outside of the home. They couldn’t vote, were discourages from working, and were excluded from politics. Students attending American schools are taught clearly about the United States’ image as a melting pot; however, there is evidence to support that, while there is not an official federal stance on the matter (Sengupta), the amount of assimilation required to be legitimately considered a “melting pot” is not being reached. Although similar, there is often confusion about the differences between “multicultural” and “assimilated” communities. By definition, assimilation is the complete “merging of cultural traits from previously distinct culture groups” (Dictionary), while multiculturalism is delineated as the “preservation of different cultures or cultural identities within a unified society, as a state or nation” (Dictionary). Early to mid-1900’s America entertained the idea of a melting pot, where people from all parts of the world would join together and assimilate. It seems, however, that the growing trend has been to treat America as more of a “salad bowl” (Porter), in that people are joining together but instead of merging as one unit, are maintaining a majority, if not all, of their primary culture with little attempt to adapt. This underachievement has left America to unintentionally become a multicultural society. The clear differentiation between expectation and reality brings vast amounts of controversy among the nation’s people.
We need to be aware of the diversity in the classroom. Cultural diversity includes: bi-racial, adoptive, immigrant, gay, and step-families. It is a large majority of the students today even in my generation. Focusing on making a balanced curriculum that exposes the students to all of these different backgrounds is very important. I know that it is likely that a teacher will not be able to cater to every student, but it is important to involve each of them. There is a large percentage of students that have dropped out due to the lack of having a connection with the curriculum. While at first blush the protection of cultural diversity seems like a worthy cause to support for many of us, there are much deeper implications than the prima facie façade multiculturalism suggests. Instead, there is a “deep and growing tension” (Okin,1999; p10) between the ideals of feminism and those concerned with the protection of cultural rights. This tension is exacerbated when the protection of those rights safeguards the continuation of practices such as female genital cutting (FGC) in the name of ‘culture’ and ‘tradition.’ Every culture is dynamic, complex, and rich in its own ways. However when cultures come together and interact there are inevitably tensions and one such tension is centred on gender and gender norms. In this paper I hope to explore the question “what should be done when the claims of minority cultures or religions clash with the norm of gender equality that is at least formally endorsed by liberal states (however much they continue to violate it in their practices)?” (Okin,1999; p9) Answering this question will allow us to look at the inconsistencies between women’s rights and cultural rights.
It is important to understand cultural relativism and universalism by definition for this assessment to understand why relative universalism is simply a reclassification, and how it fails to facilitate further innovation. Both quotes from the World Conference of Human Rights, which were previously used as one of Dahre’s supporting points, say that the UDHR is universal. Subsequently, the conference also stated that external factors such as culture, religion, and other particularities, “Must be borne in mind”. Comparing these two defining quotes to Dahre’s Relative universalism shows a striking similarity. Relative universalism is said to be the integration of universalism and relativism without trying to find “Some moral space in-between”. What Dahre believes to be the solution already exists in the fundamentals in the relationship between relativism and universalism. The difference is that Dahre essentially argues to stop the pursuit of a middle ground. When referring to the “middle ground” it is interpreted as being the solution of the dichotomy between culture and universal human rights. Both perspectives, Dahre’s and the current dichotomy, have the same goal of balancing the two. There is such a thing as universality of human rights that is different from cultural relativism, humanity comes before culture and traditions. People are humans first and belong to cultures second (Collaway, Harrelson-Stephens, 2007 p.109), this universality needs to take priority over any cultural views, and any state sovereignty over its residing citizens.
These days, it seems that multiculturalism is generally an assumed good. Increased acknowledgement of diversity and cultural sensitivity seem to be steps toward leveling the playing field for all human beings. And that is the goal of much scholarship and activism, right--to secure and ensure human rights across the board? That is one of global feminism’s aims, so it would seem that multiculturalism would help, not hinder, feminist work to better the situation of women. That is not necessarily the case.
On December 10th in 1948, the general assembly adopted a Universal Declaration of Human Rights. This declaration, although not legally binding, created “a common standard of achievement of all people and all nations…to promote respect for those rights and freedoms” (Goodhart, 379). However, many cultures assert that the human rights policies outlined in the declaration undermine cultural beliefs and practices. This assertion makes the search for universal human rights very difficult to achieve. I would like to focus on articles 3, 14 and 25 to address how these articles could be modified to incorporate cultural differences, without completely undermining the search for human rights practices.
The doctrine of human rights were created to protect every single human regardless of race, gender, sex, nationality, sexual orientation and other differences. It is based on human dignity and the belief that no one has the right to take this away from another human being.
