“Great Cheese comes from Happy Cows. Happy Cows come from California.” A statement heard and seen on multiple advertisements, from commercials, to print.
It is this statement that sets in motion a lawsuit between People for the Ethical Treatment of Animals (PETA) and the California Milk Producers Advisory Board (CMAB). PETA is a group who fights for animal rights through public education. CMAB is a food department whose goal is to promote California milk and the use of dairy products. These two groups, state their facts backing up their sides in order to defend their actions. PETA filed their complaint in 2002, stating their reasons for taking action against CMAB. The first reason is for their false and deceiving advertising plan know as the “Happy Cows” campaign, which goes against the California …show more content…

A principal, which in this case is the California Department of Food and Agriculture (CDFA). The agent, CMAB, who works under their principal and consents to do the work of the CDFA. The Milk Board follows through on any of the CFDA 's wishes and jobs to help promote the use of California produce. All of these things add together to create a fiduciary relationship with high standards and helps each group benefit. There are many aspects to having this kind of relationship which includes many confidential aspects of the business done, conflict between the principal and agent, and also the duty to follow the principal 's wishes, even if it conflicts with the agents. I feel like the fact that the Milk Board was intermixed in with the California Government helped CMAB win their case against PETA. The California Unfair Business Act excluded government business such as the CMAB which could have easily been possible with lobbying. I think PETA should have won this case, however CMAB was able to evade the lawsuit with their interactions within the California
