This claim arises out of an incident that occurred on October 29, 2015, at 13630 Bent Tree Circle, Centreville, VA 20120. The insured, Carlos Morales Portillo, was hired by Bent Tree Circle Apartments, Inc. (hereinafter “Bent Tree”) to help remodel and bring their condo units up to code. Specifically, insured was tasked with increasing the strength of the ceiling joists. In order to so, insured was using pieces of plywood to make boxes around the joists for more support. Since the sprinkler system lines run close to the ceiling joist system, insured tried to flex the pvc water lines of the sprinkler system away from the joists in order to slide the plywood next to the joists. sprinkler head, causing water to escape in the two units below and also to the adjoining stack of apartments. There were six units damaged in total: 303, 203,103, 304, 204, and 104. Blair & Company hired Matthew Rushziky as an independent adjuster from Quick Cat Claims to prepare an estimate of the damage.
Mr. Rushziky’s estimate came to $115, 826.42 before depreciation and removing non-covered anti-microbial application. Since depreciation in this claim is $15,345.42, Blair & Company received approval from Underwriters to issue a Release of All Claims representing the settlement amount of $100,480.99, to the claimant. Instead of executing the release, Andrew Ross, a construction manager with Bent Tree, responded with a request for $124,191.29. In this request, Mr. Ross stated that their cost for the damages was greater than what was currently being offered. The claimant provided additional invoices that were later reviewed by the independent adjuster. Mr. Rushziky’s review of the estimates found that there is an $8,364.87 difference at Replacement Cost. Bent Tree’s new invoices have what appears to be emergency mitigation services for unit 103 in the amount of $1,800 that was not applied to the lump sum repair for that unit. Additionally, Bent Tree has an invoice for $1,800 for cabinet repair and cleaning for units 102 and 204. Both of these units also have lump sum repair estimates for $12,900.00. loss Blair & Company has attempted to settle this claim with Bent Tree on numerous occasions. On May 23, 2016, Mr. Rushziky contacted Andrew Ross to explain the issues in the estimate differences for the loss. Mr. Ross stated that he understood these issues and said he would have the estimates revised and sent back to him. On June 9, 2016, Mr. Rushziky spoke with Andrew Ross again and he was informed he would receive revised estimates in a few days. On June 24, 2016, Mr. Rushziky had still not received any return calls from Andrew Ross and began leaving voicemails for Amanda Urbani, the Business Manager for Bent Tree. Additionally, he attempted to email her on numerous occasions. At one point, he was told by the staff that Mr. Urbani was on vacation and would return his calls once she was back. During this period of time, Blair & company sent letters to the claimant as well. We have been informed that Andrew Ross no longer works at Bent Tree and that Amanda Urbani is the new point of contact. As of October 6, 2016, Mr. Rushziky has not received any additional information from the claimant.

Aldo shipped 10 refrigerators to Rafael pursuant to a sales contract under which title to the goods and risk of loss would pass to Rafael upon delivery to Fleet Railroad. The agreed price was $5,000. When the refrigerators were delivered to Rafael, he found they were damaged. An estimate for repairing them showed it would cost up to $1,000, and an expert opinion was to the effect that they were defective when shipped. Rafael put in a claim to Aldo, which Aldo rejected. Rafael then wrote to Aldo, “I don’t like to get into a despite of this nature. In my opinion, if the jury in this case subtracted the contractual claims against the profits, they would have arrived at different damage/entitlement amounts. My guess is Main Line would have been entitled to much less than what was awarded in this case.
Since the Court found that Jacob & Youngs had substantially preformed the contract, and that the cost to remedy to damages unreasonable, Kent is entitled to be compensated the difference in value between the reading manufacture pipe specified in the contract and the pipe that was actually installed.

In the late 1950’s there was a woman named Marcella Schmoeger who suffered from a medical condition that kept her hospitalized during her recovery. At this time, Marcella witnessed many psychiatric patients remaining hospitalized due to the limited supports available. Due to these observations, Marcella had a vision to help people with mental illness. Years later, Marcella began taking these ideas and concerns to others in the community to address the social problems that individuals with mental illness faced, thus, in 1952 HHINC as created (Horizon House, Inc., 2016).
