Mergers usually take place when companies are struggling on their own, but find hope and comfort in uniting with another company. This unite is a great way to create new companies, combine revenues, establishing new policies, procedures, and objectives. It also opens up new doors, and allows new companies to expand in so many different aspects of their business. Part of the mergering phrase should include the planning process to assist with determining the objectives of the business’ long term investments goals. The merger was a brilliant idea, because companies themselves were struggling to stay afloat. Due to poor regulations of the Federal Communication Commission, the process for the merger took 17 months. There were basic demands from the commission that required a percentage of channels for minorities and other public interest. One of the agreements between the two companies was to keep the brands operating separately, so that they could make sure they fulfilled obligations that were already in place. The two brands are available in all vehicles, and depending on the vehicle will determine which one you will receive. The pricing of the two brands are also different, and currently they will not combine the two. Even though there was a merger of Sirius Satellite Radio and XM Satellite Radio, there are currently three radios (XM, Sirius, and SiriusXM). All of them offer a diversity of channels, but the platforms and prices are different. Howard Stern was also part of the merger promise, but there were a lot of issues and concerns from him about the censorships. Due to this setback the company’s stock took a turn for the worst. When the word monopoly is spoken most immediately think of the board game made by Parker Brothers in which each player attempts to purchase all of the property and utilities that are available on the board and drive other players into bankruptcy. Clearly the association between the board game and the definition of the term are literal. The term monopoly is defined as "exclusive control of a commodity or service in a particular market, or a control that makes possible the manipulation of prices" (Dictionary.com, 2008). Monopolies were quite common in the early days when businesses had no guidelines whatsoever. When the U.S. Supreme Court stepped into break up the Standard Oil business in the late 1800’s and enacted the Sherman Antitrust Act of 1890 (Wikipedia 2001), it set forth precedent for many cases to be brought up against it for years to come.

INTRODUCTION Would people be willing to pay $12.50/month for commercial free radio beamed right to their car or home. Well two companies and many big investors are betting about $3 billion dollars that people are willing to do just that. In 1997, the Federal Communication Commission (FCC) granted a portion of the S-band spectrum for satellite radio and two companies purchased use of these bands and started the only two companies competing in the satellite radio business today, namely Sirius and XM. Analysts like William Kidd of CE Unterberg Towpin, predict satellite radio will generate about $10 billion a year in revenues by 2007 (McClean, 2001).
As a result of the FCC auction, the only XM’s competitor in satellite radio arena is SIRIUS. But at the same time there other entertainment sources that could be perceived as prospective competitors for XM.
