What is the Function of a Social Contract? Philosophers have been concerned with the theories of a social contract for thousands of years. Plato mentions the concept in Crito and in Republic. These theories have stemmed from the concept of justice and for our society to be just. I will look at the works of Thomas Hobbes, John Locke, Jean Jacques Rousseau and finally with John Rawls after which a overall view into the function of a social contract can be derived as well as any problems with the theory(s). The basic concept of a social contract is for members of society to enter into a voluntary contract, which allows society to go from a state of nature to a state of civilisation. What is meant by a state of nature is quite similar to how the rest of the animal kingdom works. A person¡¦s security depends on his or her own personal power. The fittest survive and the weakest suffer. Every person is concerned with his or her own ends. Plato outlined two types of contract within society. These were the contract of citizenship and the contract of community. The contract of citizenship was tackled in Crito. He regarded it as a contract made by each individual citizen with the state or law. If a man is to remain in a political society he will have to accept its obligations for he has enjoyed it privileges and benefits. The contract of community was covered in Republic Book II. This theory is based on the assumption the man is an egoist. With this assumption of ¡¥every man for himself¡¦ it is likely that he would either cause harm to others or sustain harm from others and therefore there would be a need to combat this. Thomas Hobbes published his work, the leviathan, which included theories of a social contract. His view is very similar to Plato¡¦s in regards to contract of community. He felt that there was a need for members of a society to Curtail the war of all against all and without these theories this war would spiral out of control with everyone competing against scarce resources. He talks about how a person¡¦s strength is all that protects them from others. The only way he saw fit to counter this predicament would be for a person to voluntarily agree to a contract where their natural freedom is given up in return for personal security. This freedom would be give up to the supreme authority, the Leviathan, which would serve as a ¡¥common pow... ... middle of paper ... ...ction to relatives and close associates. The theory of general will also has problems. What can protect society from unjust rulers who say they are working in the way of general will? General will does not allow for difference in taste. It also identifies moral obligation with general interest. This is a problem because people may have similar morals but have different interest. The rulers can also work with regards to the interest of the state but not with regards to morals. The Social Contract and the Leviathan by Jean-Jacques Rousseau and Thomas Hobbes, respectively, contextualizes man’s struggle to escape a brutish, short life within the state of nature. Man is confined in a lawless world where the words mine and thine are interchangeable, and where there is no regard for private possession; this indifference even extends to the right over someone’s body. And while there are those who revel in freedom from the synthetic chains of law, the reality of life in the state of nature- a life of constant war and distrust for one’s neighbor- trumps any short lived joys or monetary gains. Second Treatise of Government by John Locke and Discourse on the Origin of Inequality by Jean-Jacques Rousseau are books written to try and explain the origin of society. Both try to explain the evils and inequalities of society, and to a certain degree to discuss whether man in his natural state is better than man in society. These political science based theories do not appear, at first, to have anything in common with J. Hector St. John De Crèvecoeur’s Letters from an American Farmer, which are letters written by Crèvecoeur during the settling of America and the beginning of the American Revolution, however with examination we can see reflection of both Locke’s and Rousseau’s ideas about things such as human nature, government, and inequality.
Society’s structure has been debated and contested as far back as ancient Greece. Since then, man has developed social systems that greatly differ from anything the ancients had in mind. One such system is the social contract theory, which first came to prominence around the time of the enlightenment. Simplified, social contractarians argued that in order to achieve a balanced and stable society, all of its members must sacrifice certain liberties to a government or similar authority. As Rousseau explains, the contract begins when “Each of us places his person and all his power in common under the supreme direction of the general will” (148). Essentially, it is an agreement between the rulers and the ruled that produces a stable political state. John Locke’s The Second Treatise of Government and Jean-Jacques Rousseau’s The Social Contract are both enlightenment works that detail contractarianism, yet each has a unique and different way of considering the social contract. Although John Stuart Mill is also known for his work with Utilitarianism, his essay On Liberty considers consent and other issues relating to contract theory. These authors provide different insights into the social contract, and frequently one will reject another’s idea and offer a new solution. Even after this meshing of ideas and solutions, contract theory falls short of practicality. The idea is appealing, appearing on the surface as a fair and just way of governance. However, true liberty cannot arise from a contract, as man cannot be “forced to be free” (150). The political philosophy of Jean-Jacques Rousseau and Karl Marx examined the role that the state played and its relationship to its citizen’s participation and access to the political economy during different struggles and tumultuous times. Rousseau was a believer of the concept of social contract with limits established by the good will and community participation of citizens while government receives its powers given to it. Karl Marx believed that power was to be taken by the people through the elimination of the upper class bourgeois’ personal property and capital. While both philosophers created a different approach to establishing the governing principles of their beliefs they do share a similar concept of eliminating ownership of capital and distributions from the government. Studying the different approaches will let us show the similarities of principles that eliminate abuse of power and concentration of wealth by few, and allow access for all. To further evaluate these similarities, we must first understand the primary principles of each of the philosophers’ concepts.
In his essay, Discourse on the Origin of Inequality, Rousseau attempts to explain the relationship between the formation of political and social institutions and the state of human nature. Before going into depth regarding the state of human nature, Rousseau starts by first demonstrating the first crucial steps in human evolution and the effects these steps had on the development of inequality. Rousseau believes that the combination of these concepts are important to understanding where we came from, who we are now as a society and what our society will resemble in the future.

Throughout history, the effects of the unequal distribution of power and justice within societies have become apparent through the failure of governments, resulting in the creation of theories regarding ways to balance the amount of power given and the way in which justice is enforced. Due to this need for change, Thomas Hobbes and John Locke created two separate theories in which the concept of a social contract is used to determine the ways in which a government can govern without forfeiting justice. In this essay, the relationship between force, morality, and rights within both theories will be investigated in order to determine the most beneficial format for society based on the ideas of the natural condition of mankind, the rights of the government, and the rights of the governed.

John Locke’s views on property and liberty, as outlined in his Second Treatise of Government (1690), have had varying interpretations and treatments by subsequent generations of authors. At one extreme, Locke has been claimed as one of the early originators of Western liberalism, who had sought to lay the foundations for civil government, based on universal consent and the natural rights of individuals. [1] Others have charged that what Locke had really done, whether intentionally or unintentionally, was to provide a justification for the entrenched inequality and privileges of the bourgeoisie, in the emerging capitalist society of seventeenth century England. The crux of these arguments either way have centered on Chapter 5 in the Second Treatise, entitled ‘Of Property’.

In The Social Contract philosophers John Locke and Jean-Jacques Rousseau discuss their differences on human beings’ place of freedom in political societies. Locke’s theory is when human beings enter society we tend to give up our natural freedom, whereas Rousseau believes we gain civil freedom when entering society. Even in modern times we must give up our natural freedom in order to enforce protection from those who are immoral and unjust.
Political theories abound, considering many parts of society and the body politic. John Locke was one of the first to expound on the origins of property, and sixty-six years later Jean-Jacques Rousseau would also address the issues of property and inequality. According to Locke and Rousseau, the social contract is sanctioned by formal equalities yet creates or gives way to inequalities after it is formed. Though Locke would argue that inequalities in the private sphere don’t fall under the jurisdiction of the government, Rousseau would say justice gets deformed through inequality. Understanding how both equality and inequality can be present under the terms of the social contract is important because we cannot understand how to minimize inequalities if we do not first understand how they originated (origin). Inequality and equality can coexist under the terms of the social contract because the contract was formed under the influence of specious reasons with only an illusion of political equality.
The Social Contract is an attempt to explain the reason why individuals agree to form organized governments. The idea that a person is willing to abandon the freedoms previously enjoyed under the State of Nature in which no government interfered with their pursuits, are believed to correspond to the individual’s attempt to protect what is on their best interest.
