On the above date and time Officer Runge and I were conducting a business check of the Walmart parking lot. While conducting the business check, I observed a White male subject in the passenger seat of a parked 2001 Chrysler van. The subject was slumped over to the right side in the seat. The window was completely open. Officer Runge stationed my patrol vehicle next to the van to conduct a welfare check on the male subject. At no time were my patrol vehicle's emergency lights or sirens activated. Furthermore, the vehicle was not blocked in as to where it could not leave freely. I exited my patrol vehicle and made contact with the subject, later identified as Mark Alan Wilt. I advised Wilt that I was checking on his welfare. Welt advised me that he was just sleeping. The paraphernalia and liquid were later photographed and placed into evidence at the Port Richey Police Department. The clear liquid will be sent to the FDLE lab for additional testing. The syringes were properly disposed of in a sharps container. I advised dispatch to contact Walmart management and to have them respond to the scene. Shortly after, Walmart Manager, Mark Kito, arrived on the scene. I advised Kito of the situation and he requested that all three subjects be trespassed from Walmart. All the subject later acknowledged, received, and signed their trespass warnings. All three subjects were advised that they would be arrested if they returned to Walmart, located at 8701 U.S. Highway 19 in Port Richey. Kito also received and signed copies of the warnings. I advised Kito to contact the Port Richey Police Department if any of them returned. I advised dispatch to have the next wrecker in rotation en-route to the scene for an impound.
