Reasonable Accommodations Request 8) Job functions affected: Nearly every aspect of my job functions are affecting by my disability. Firstly, since I’m a wheelchair bound individual and cannot stand. The reason I’m requesting an accommodation is based on the nature of my job as a Tax Examiner which consists of sitting a considerable amount of time (100% of the day, approximately 8 hours). With my recent surgery (hemorrhoidectomy, 2 months ago) I can no longer sit long periods without experiencing a considerable amount of pain, even when I take frequent breaks to lean over and change positions to relieve pressure from sitting I still cannot avoid the pain from constant sitting while I work. to mention that I’ve spoken to the Agency in charge of assisting me with gaining employment (Department of Rehabilitation, Fresno CA.) and they are willing to assist in my accommodations whether it be purchasing specialized equipment for accessibility, etc. Furthermore, I’ve requested specialized equipment for standing from Department of Rehabilitation so I can take breaks to stand and even work while standing to prevent further pain. In addition, the standing also improves my frequent spasticity (involuntary leg movements) which causes pain and is a constant burden when I’m trying to focus on doing my work. Also, standing improves my blood pressure medical condition (orthopedic hypotension) which is also something that prevents me from doing my work well. Secondly, in training we were given desks that are height adjustable. I hope the same type of desks are available when we begin working after our training period ends. Thirdly, instead of a mouse for my computer, I utilize a touchpad much better. A touchpad is similar to the pad that laptops use to navigate from using touch instead of a mouse. 9) A touchpad instead of a mouse would help me perform my job effectively. In addition, while in training, a notetaker would help me attain more notes when we are learning new material. 10) Additional comments There may be other accommodation request(s) that arise after our training ends and we start working as Tax Examiners on the floor. A stool with positive ergonomic characteristics should support “thighs, arms, legs, and back, as well as proper posture, circulation, and respiration” . The stool should also be equipped with at least five free-rolling casters and be supportive of posture during various movements made by the hygienist. If the stool that is provided to a hygienist by their employer does not have these qualities, the hygienist could consider purchasing their own stool. While solitary confinement is one of the most effective ways of keeping todays prisoners from conflict and communication it is also the most detrimental to their health. According to an article by NPR.org the reason for most solitary confinement units in America “is to control the prison gangs (NPR, 2011).” Sometimes putting a gang member in solitary confinement reduces the effect that confinement is supposed to have when the confined inmate starts losing their mind. The prisoners kept in solitary confinement show more psychotic symptoms than that of a normal prisoner, including a higher suicide rate. Once a prisoner’s mental capacity to understand why he or she is in prison and why they are being punished is gone, there is no reason to keep said prisoner in solitary confinement. Once your ability to understand punishment is gone the consequences of your actions lose value and become irrelevant.
The case of sick leave involved Kelly, who was hired by Soto Board of Education in Japan. It is mandatory for organizations to make necessary accommodations for the employee’s disabilities unless it would create an undue hardship to the organization. However, new laws were passed stating that if accommodations would be too burdensome, and no other solutions can be found for the job, the disable person must be given another vacant job (Sotoa & Kleiner, 2013). The requirements for employers under ADA are very strict and organizations must work diligently to provide the needs of the employees with disabilities to comply with the law.
