1. Introduction
The Construction industry is large, volatile, and requires tremendous capital outlays. Typically, the work offers low rates of return in relation to the amount of risk involved.
Delays on construction projects are a universal phenomenon. They are almost always accompanied by cost and time overruns. Construction project delays have a debilitating effect on parties (owner, contractor, and consultant) to a contract in terms of a growth in adversarial relationships, distrust, litigation, arbitration, cash-flow problems, and a general feeling of apprehension towards each other.
2. Problem Statement
Many construction projects have been facing various problems and delays of time are a major problem. The delay in the settlement of disputes has multiple effects such as this will give the detriment of the relationship between the owner and the contractor. In addition, it will also contribute to cost overruns and time. The most serious problem is that it sends the wrong signals to foreign investors that slow national progress. It is generally said that the contract language is considered difficult to understand and they are a major source of conflict.
The survey results indicate that the majorit...

This paper will boil down the mass of legal issues facing the construction industry through these facets into three distinct areas of law that, as they evolve, may govern the further transformation of the construction industry in the United States. First, we will dissect the regulatory legal environment in the construction industry at a greater depth and highlight three emerging issues pervading construction litigation today: health and safety hazards, the no damage for delay cause, and the public project restrictions on contrac...

With a variety of procurement routes to choose from, how can one facilitate the selection of the most appropriate construction contract and avoid situations where the owner insists on using a less appropriate one? How do we begin to focus the conversation on training, and updating efforts to create a reduced number of documents (Construction Canada, 2014)? In the next chapter this dissertation will further analyse the trends and investigate how different procurement routes naturally align themselves in certain asset classes in
The material changes could include fluctuation in material prices, contractor’s financial problems, and selection of unsuitable material or material storage problems (Kazaz,2012). Financial factors include relative importance values. Inflation is the most important factor, which cause material prices fluctuation (Kazaz,2012) .Although cash flow problem caused by the owner ,it directly lead to the main contractor could not gain the monthly progress payments. Equally, inflation and the constant increase of material prices are having a close relationship with another change design material factors. This relationship could be explained by the realities that unsteady inflation making a great influence on material prices. In fact, the one factors in this group indicate budget problems in the project-level, while the others mean financial problems in the country-level(Kazaz,2012) .However, it is evident that overrun-based financial factors in construction basically arise from private owners and public institutions, and lead to time extension, from general contractors . It would also be claimed that a country’s financial atmosphere has secondary effect on the time extension issue of a construction project investment. (Steffens,2007 )These evidences obviously highlight that a sound time preparation and projection is not caused by the parties in a construction project, and that
For each delay events, the Contractor should serve the notice with 28 days of the each event in accordance to sub clause 20.1 “Contractor Claims” the contractor should keep the contemporary record and Engineer will review and comments the records prior to the claim submission. In every Project, the Engineer is not acting as a referee and reviewing and investigating the subcontractor contemporary records appropriately. They simply reject subcontractor claims by considering subcontractor delays which may not be sole cause for the total delay of project. Even if the Extension of time is approved, however, the appropriate actual prolongation cost for the approved Extension of time is not being approved.
The history of construction management was not a shock, but it was a little bit of a reality check. It is common knowledge that the human race has been building things since the beginning of time, but what is extraordinary is to think about how far the world has come over the thousands of years. Men and women started living in small huts. Now there are skyscrapers that reach thousands of feet into the air. That is a drastic change in the way construction has developed. As I researched
However, there are some disadvantages in the processes. First, it is very consume time in the pre contract process due to the strategy is sequential and construction cannot be started before the completion of design. Also, the contractor is not appointed in the design stage, so the contractor and supply chain are no input into the design or planning of the project. Mo...
The builder supervises, coordinates, and works on the construction or maintenance of houses and other buildings. In addition to doing some work, some Builders also manage the entire project. This may include arrangements for subcontractors to perform specific tasks and to ensure that the project complies with industry and government regulations and customer requirements. Builder contains two kinds of domestic builder and commercial builder. This report will show the legal requirements and obligations of a builder and a builder should have the right.
Lack of coordination between the project management team causes the project to work at a much slower rate than estimated.

With sufficient capital, some may even start their own construction management companies or general or specialty contracting firms. Employment of construction managers is projected to grow 11 percent from 2016 to 2026, faster than the average for all occupations. Job opportunities for construction managers are expected to be good. Specifically, jobseekers with a bachelor’s degree in construction science, construction management, or civil engineering, coupled with construction experience, will have the best job prospects. In addition to employment growth creating many new jobs, construction managers are expected to retire or leave the occupation in substantial numbers over the next decade, resulting in further job openings.
Accurately forecasting the cost of projects is vital to the survival of any business or organization. Cost estimators develop the cost information that business owners or managers, professional design team members, and construction contractors need to make budgetary and feasibility determinations. From an Owner's perspective the cost estimate may be used to determine the project scope or whether the project should proceed. According to the U.S. Department of Labor there were about 198,000 cost estimators in 1994. That of which 58% work in the construction industry, 17% employed in manufacturing industries, and the remaining 25% elsewhere. From this we could conclude that a great deal of cost estimation lies in the construction industry, where multi-million dollar contracts are formed after a thorough cost estimation.
Brooke (1997), explains Estimation as the technical procedure of anticipating the value of the project. Building construction estimation is the process of acquiring the construction value for the whole project before the project starts. Thus, construction attaining process depends hugely on financial management to sustain workability and smooth operations. The delay in construction is a global issue which is due to improper preparation of estimates and lack of drawings (Ajanlekoko, 1987). In accordance to Gkritza (2008), the source of delay in a project are identified to be in the initial stages, like bad quantification, errors in design and ground conditions. Thus, the purpose of a proper estimate is to foretell the cost needed to finish the
This paper explores what it takes to be a construction manager and the responsibilities of being a construction manager and the skills that a construction manager should have. It also explores what good construction managers do to have success on their construction projects and the steps that a construction manager must follow to end a project and meet their deadlines at the same
Risks are inherent in almost every work done by human so as in construction projects. Lives, property and money are lost due to these risks. These losses can happen due to human carelessness or extreme environmental conditions and these losses can be mitigated by proper risk management plan. Construction projects are vast and complex. The risks vary by varying construction projects types. This paper addresses the most common construction risks in all types of construction projects and their mitigation strategies.
