Have you ever been to a band concert and bought something you wanted to wear? Well this student named ben had a rock band t-shirt and wore it to school, and it caused some arguments. Therefore his principal suspended him. Ben got suspended because he broke the rule,the rule stated that you can not wear band t-shirts on school grounds, or anything that disrupts class. I feel that ben did not break the rule,because rock band t-shirts do not cause trouble. Band t-shirts have not disrupted class because, although daran and sara were arguing,once they were told to be quiet they did so right away. The case also states “A prohibition against expression of opinion, without any evidence that the rule is necessary to avoid substantial interference with school discipline or the rights of others, is not permissible under the First and Fourteenth Amendments” (Tinker v. Des Moines Independent Community School District). Because the students didn 't necessarily disrupt the education process, their First Amendment freedom of speech should not have been violated by the school officials.
This case involved a public high school student, Matthew Fraser who gave a speech nominating another student for a student elective office. The speech was given at an assembly during school as a part of a school-sponsored educational program in self-government. While giving the speech, Fraser referred to his candidate in what the school board called "elaborate, graphic, and explicit metaphor." After his speech, the assistant principal told Fraser that the school considered the speech a violation of the school's "disruptive-conduct rule." This prohibited conduct that interfered with the educational process, including obscene, profane language or gestures. After Fraser admitted he intentionally had used sexual innuendo in the speech, he was told that he would be suspended from school for three days, and his name would be removed from the list of the speakers at the graduation exercises.
Many Supreme Court cases in the United States have reassured its citizens’ rights. One of those cases was that of the 1965 Tinker v. Des Moines Independent Community School District case. This case was about five students who were suspended from school for wearing black armbands. Should the students have been suspended? The Tinker v. Des Moines case was a very controversial Supreme Court case in which the right to freedom of speech and expression for students in public schools was violated.
In band people are divided up by the instrument they play, but for each section there is also a stereotypical personality. The stereotypes for me high school band are kind of weird, but have stayed a constant norm for as long as I’ve been in band.
The fact was that the Plaintiff Tom Defoe was a high school student who attended Anderson County High School (ACHS), and Anderson County Career and Technical Center (ACCTC) until December, 2007. Both of the ACHS and ACCTC have a dress code that prohibited racial and ethnic symbols, gang affiliations, vulgar, subversive, or sexually suggestive language, and any items that promote alcohol, tobacco, and drugs, because there were several racially charged incidents happens in that district in the past sixty years. In 2006, the plaintiff Tom Defoe has worn the clothes with the Confederate flag for two times, even though the school officials asked him to remove it and gave him warnings that he has already violated the dress code. Therefore, school decided to suspend the plaintiff Tom Defoe.
The majority vote was that it was not constitutional for the school to suspend the students because the students have rights. The majority vote believed the school was violating the students first and fourteenth amendment. The first amendment is freedom of speech, whether verbal or nonverbal, cannot be taken away from students unless it is harming or disrupting other students. What if you were suspended from school because of something you were wearing? Not only was the clothing or item appropriate, it was something you were fighting for or something you believe is right. Is this fair or okay for this to happen? There is a specific incident that this situation happened to a few teenagers in Des Moines, Iowa in December of 1965. A group of students wanting to wear black armbands throughout the holiday season was in for a wake up call. (FORTAS) These plans and or idea were quickly shot down by the high school principals. The principals caught wind of the teen’s plan, so there was a meeting a few days beforehand. The talk of the meeting was to ensure the teens that if they were to wear the black armbands a few days from then, they would be asked to remove the bands, if they refused, suspension would be given.(KELLY) Is this a violation of the First Amendment?
Schools provide an umbrella for freedom of expression other places may not have. In school we are allowed to share and express our opinions hopefully without judgement. Teachers, for the most part, show an unconditional positive regard; refraining from public judgement in the classroom setting, allowing each and every student to feel comfortable expressing their views and feelings of their own. Although, some occurrences may infringe upon school law. On the count of threatening and potentially adverse public speech, the Itawamba School Board claims the allegations Taylor Bell made in his song were a violations and disruption of school policy. However, I personally believe the school cannot ‘police’ students outside the school grounds. More importantly, the Itawamba school district should be more concerned with the meaning of Taylor Bell’s song than any charges against him.
We, all, have the opportunity to voice our opinion on subjects that matter to us. The First Amendment grants us freedom of speech and expression. However, this was not provided to all students in 1968. During this time, there were three students in Des Moines, Iowa, who wore black armbands to school. These armbands were a symbol of protest against the United States involvement in the Vietnam War. After the Des Moines School District heard about this plan, they instituted a policy banning the wearing of armbands, leading to the suspension of students. A lawsuit has been filed against the Des Moines School District, stating how this principal goes against the students’ First Amendment rights. Thus, in the Tinker v. Des Moines Independent Community School District case, Justice Abe Fortes determined the policy to ban armbands is against the students’ First Amendment rights. Yet, Justice Hugo Black dissented with this decision, determining the principal is permissible under the First Amendment.
In December 1965, an issue was caused by teachers’ in violating students’ freedom of speech. In December some students from Des Moines Independent Community School District, in Iowa were suspended for wearing black armbands to protest against the American Government’s war policy in support Vietnam (Richard, Clayton, and Patrick).The school district pressed a complaint about it, although the students caused no harm to anyone. Students should be able to voice their opinions without the consequences of the school district.
Justice Hugo Black dissented and feared that the Court’s ruling would cause more revolutionary actions from students. However, Justice Fortas addressed this potential outcome. He says, “Certainly where there is no finding and no showing that engaging in the forbidden conduct would "materially and substantially interfere with the requirements of appropriate discipline in the operation of the school," the prohibition cannot be sustained.Burnside v. Byars, supra at 749.” The school’s ban of the armbands could not be upheld because the expression had not caused any harm. If the students underwent another expression, the school would still have the power to make a decision. If their actions were disruptive, the school would still have the power to limit these actions. In a bigger picture, students don’t come to school for a fashion show they come to school for an education. Somewhere along the line some students and parents have forgotten that simple fact. In some districts, like Wilson County Schools, the dress code violations got so out of hand that administration had to threaten suspensions, “During the first six days of the policy change 184 high school students were suspended.” (Creech, 1). The Lima Senior High School campus made the same decision as the Wilson County Schools. On Tuesday January 27, 2009, the Lima City Schools suspended about 164 students for dress code violations. They both knew that their students were having problems following the rules, and since the punishments that were set didn’t affect the students they did the one thing that got the students attention.
Of course, students and school officials can often disagree about what may or may not be disruptive. For example, in 1998, the Rhode Island ACLU successfully challenged the suspension of a student for wearing a rock band t-shirt with the numerals “666” on it. On the other hand, although the ruling might come out differently today, a Virginia court ruled two decades ago that a school could decide to ban as “vulgar” a t-shirt with the phrase “Drugs Suck.” If you think you were unfairly disciplined for something you wore to school, you should contact the ACLU. Administrators have the responsibility to protect the health, welfare, and safety of students. If compared to previous generations, the students living in the 21st century should have a bright future ahead of them. To create that future one must first go to school. Is the main purpose of school having to deal with oppression and injustice or is it to give children a proper education and an opportunity to learn? Mandatory school uniforms are a very controversial issue. Clothing impacts a student’s daily life. The clothes they choose to wear, makes them who they are. A student may choose to express who they are or who they want to become through the clothing they wear. It gives them a taste of freedom and choice; a feeling that every individual living in a democratic society should have. Uniforms in school oppose that feeling. Many private schools and some public schools require students to wear a uniform but the majority of schools do not. The school boards need to understand all the bad things uniforms have to offer. School uniforms are useless because they do not help fix any major problems, are very expensive for the less fortunate families, and oppose the rights every Canadian is entitled to; therefore, must not be mandatory to wear in school.
Students claim that requiring them to wear mandated uniforms deprives them of their ability to freely express themselves through their choice of dress. However, freedom of expression does consist of the rights to freedom of speech, assembly, and to petition the government, but the first amendment does not grant people the right to act any way they want without actions taken.
