Domestic and International Law in the Transportation Sector

Domestic transportation law is a conglomeration of Federal statues, regulations, and codes; additionally, many states, counties, and local jurisdictions also have laws and regulations that are incorporated into domestic transportation law. In general most transportation law deals with safety and restricts the type and scope of conveyance in regard to the product being transported. The basis for all federal domestic transportation law is the United States Constitution which authorizes Congress regulate interstate commerce (Transportation Law1). Federal Transportation law is found in title 49 of the U. S. Code § 101 with the stated purpose of the section to provide fast, efficient, safe, secure, and convenient transportation at low cost. Department of Transportation resources are also to be conserved and used efficiently as proscribed under this section of the code (Transportation Law2 2).

Many laws create regulatory agencies that oversee areas of the transportation sector such as; the Federal Railroad Administration (FRA), National Transportation Safety Board (NTSB), Federal Aviation Administration (FAA), Pipeline and Hazardous Materials Safety Administration (PHMSA), Federal Motor Carrier Safety Administration (FMCSA), Transportation Security Oversight Board (TSOB), as well as the Department of Transportation (DOT) itself and many others. Domestic laws not only govern the infrastructure that the conveyances travel upon and in but the conveyances themselves, for example FAA regulations cover the air terminal, airport grounds and surrounding areas including the airspace above the grounds, the passengers, cargo, crews and the actual aircraft as well as support vehicles.
