The American workforce is getting older. Fact, in between 1970 to 1991, the workforce number over the age of 40 in the U.S. has increased from 39,689,000 to 53,940,000. Because of that, the legislative and judicial developments in the age discrimination in employment have occurred (1). The baby-boomer generation - Americans born between 1946 and 1964 represent more than seventy million workers in the U.S. workplace, and that around 50 percent of the whole workforce. The whole baby-boomer generation since 2006 has falls under the protection of the federal laws against acts of discrimination based on age (ADEA) (2). People who are in their middle age or older, and harmed by any decision in their workplace, based on their age, that is may considered as illegal age discrimination. It is illegal for employerss to hire, promote, or fire an employee on the basis of their age. Age discrimination has existed at the end of 19th and early 20th century. At 1890s and early 1900s fired worker over the age forty becoming as standard for employer. Then during that time, workers at forty of age started suffering from age discrimination. During the early of 1900s age discrimination in the workplace got the media attention and became a serious issue (6). In 1903 Colorado state has the first written low against age discrimination in employment. The law provides that the employer cannot be fired or discharged anyone at the age between 18 to 60 because of age. This law did not apply hiring and this law unfortunately never enforced (7). Later on, in August 1937 Massachusetts has released an act that forbids any discrimination based on age for hiring people on the age between 45 to 65. There are some signs that show you may be a victim of age discrimination. First, when your manager or HR based comments regarding to the employee age, and ask about the retirement plan. For example, if they say we need younger workers, or you are too old, or anything similar. Than that could be direct evidence that you are a victim of age discrimination. If happens, you have to document it by writing down the comment, time, date, and if there are any witnesses. Second, if younger employees getting more attention rather than older by including them at events, training, meetings, or you feel they have been treated differently. If the employer has laid off some workers, and all of them older workers, it is might be direct evidence of age discrimination. Also, favoritism when the employer favorite younger workers by giving them best leads, assignments, equipment, office space, and excluded older employees from meetings, and these things. These may be signs of age discrimination. Furthermore, hiring younger employees, if the company manner only hiring younger people with less qualification, over qualified older employees. Within business organizations, aging is something that is inevitable and unique to all people. Business practices need to be in the best interest of an organization, which is also inclusive to the employees, stakeholders, and customers in which they rely on and cater to. Best business practices, both directed and implied (regardless of the location) dictates that businesses follow and adhere to federal, state, city, and other local policies. However we needn’t look too far to see the multiple lawsuits that show continued and practiced bias and prejudice. One such incident involving discriminatory practices involving ageism that will be discussed within this discussion will revolve around a Texas Roadhouse restaurant based in Palm Bay, Florida.
Elderly folks are eminently mature and have the finest instinct about what is right and wrong though It’s challenging to change someone’s point of view in a matter like this. In an article called “Ageism and Bias in the American Workplace”, the author discusses the dominant demographic in certain lines of work. Whether by age, gender, or ethnicity some may find difficulty finding work. In this article it discusses the bias against older workers. It was found that employers were less likely to hire someone older in assumption that production would decrease resulting in a decrease in profit, but it was discovered the older workers were more long term employees. Some of the many common mistaken views of aging would involve our society seeing aging as something that will be a big problem for us and bring about burden. Other issues to consider are that aging is for everyone, not just the elderly. In many people’s minds, you say “aging” and the first thing that comes to mind is an elderly lady or man, retired, grey hair, and no longer full of life. However, children, young adults, and older adults are aging every day. Discrimination is a feasible method of making decisions in life based on the group, class, or category to which a person belongs to. “In an ideal world, people would be equal in rights, opportunities, and responsibilities, despite their race or gender. In the world we live in, however, we constantly face all kinds of neglect based on different attributes.” When one hears the word discrimination, the first thought that comes to mind is racial discrimination. In fact, it does not solely have to be racial discrimination. There are many forms of discrimination such as age, disability, transgender, and sex discrimination. The economy is faced with challenges for the youth and the elderly in order to become employed in various jobs. “Ageism is defined as stereotypes, prejudice, or discrimination against (but also in favour of) people because of their chronological age” (Ayalon &Tesch- Romer, 2017). Ageism affects a person behavioral, emotional and cognitive thinking skills. It is a form of prejudice that discriminates against people due to their age.
Age discrimination continues to be a problem for both men and women that are over the age of 40 in the workforce. In year 1967, the federal Age Discrimination in Employment Act ADEA was passed to prohibit discrimination against workers over age 40 and older. Another law in the year 1964, Title VII of the Civil Rights Act of 1964 that prohibits employment discrimination on the basis of sex, race, color, religion, or national origin. However there are still age discrimination and it seems to be more especially for older women more than older men. The Federal and the state should implement more regulations to protect workers' rights in all age groups, both in the younger and older generation including their race and gender.
