Curricular Implication of Section 504 The Section 504 Rehabilitation Act of 1973 was designed to meet the needs of students with disabilities and who do not fall under or qualify for special education services. For example, a student that is perfectly capable of meeting all curricular requirements on assessments and assignments but cannot hear very well will fall under the 504 act. They will not necessarily meet the special education qualifications of the IDEA. Therefore, they will not be classified as special education students and will not receive the same services as special education students, even though they need modifications and accommodations to ensure their overall success. A major curricular impact of Section 504 of the Rehabilitation Act of 1973 is that all educators are legally required to provide students that meet the requirements to be qualified or classified as a 504 student with the same course of study as general educations students without making changes to their course work. This is because 504 students are not considered special education students. Therefore, they are not supervised by para-educators and or special education teachers. The 504 students are supervised by the classroom instructors and building or organizational leaders such as the principal and vice principal. It is the classroom instructors’ responsibility to ensure that the 504 students are receiving their accommodations and or modifications. It is the school principal’s job to ensure that these 504 accommodations and modifications are being implemented by each of the classroom

A 504 Plan is a condensed version of the IEP, for it was created to assist students with non-complex accommodations. The 504 plan contains two parts: background information and the plan. Thus, the IEP is overdrawn and well thought out process, it consists of numerous parts: exit information, initial eligibility, student participation on assessments, present level of academic achievements, etc. Correspondingly, the 504 plan does not require the team to list the frequency of accommodations, whereas the IEP requires the frequency of each accommodation be listed. According to what I have learned in class, a 504 plan is for when a student does not qualify for an IEP but still needs some accommodations. A student may meet the first two prongs of eligibility for special education but does not meet the third prong of needing specifically designed instruction. If this is the case the student can still receive a 504 plan. According to understood.org, “A 504 plan outlines how a child’s specific needs are met with accommodations, modifications and other services. These measures “remove barriers” to learning”. This is important because the student will still get the accommodation he or she needs.

Prior to 1975, educational options for a child living with a mental or physical disability were limited. The family of the handicapped child was most likely forced down an path that lead to the institutionalization of the child and distancing the child from the benefits of receiving a free and public education. It was after federal legislation passed the Rehabilitation Act of 1973 (42 U.S.C. § 1983) that monumental changes began to develop that allowed a better understanding of the needs and capabilities of people with various handicapping conditions. Soon after this legislation, Public Law 94-142, also known as the Education for all Handicapped Children’s Act of 1975 (EHA) would further increase the public awareness by providing a free appropriate public education (FAPE) for children suffering from disabilities. Following the EHA legislation reformations concerning the education of disabled individuals would soon become numerous and legislative acts were passed enabling accommodations for disabled individuals in the fields of vocations and technology. In 1990, President Gerald Ford signed legislation replacing P.L. 94-142 with the Individual with Disabilities Education Act of 1990 (IDEA, 20 USC 1400). By definition, the Individuals with Disabilities Education Act (IDEA) is a law ensuring services to children with disabilities throughout the nation (US Department of Education, 2011).
Nevertheless, it is my opinion that Randall’s teacher should explain the benefits of a 504 Plan and how it can benefit Randall. She could send documentation home that discussed the 504 Plan. I feel it is especially important that they understand the accommodations that Randall could receive during class and testing. I feel that it would be beneficial for Randall to receive extended time for testing and test modifications, especially being Randall was almost retained due to test scores. A modification that I feel could impact Randall in the classroom is creating a daily class work to do list similar to a ‘honey do’ list, which he has access to. The list could be laminated or placed on a white board. The items could be marked off upon completion. This would allow Randall to stay on task and know what is expected of him daily. Also, an accommodation that could help Randall is providing him with a list of strategies or steps during test taking. Having reminders of these strategies close will allow Randall to recall the strategies as needed. Another accommodation, I believe that can be beneficial to Randall if the homework and test evaluations are reassessed. Randall’s teacher could find ways that Randall enjoys expressing himself and have him complete work in a similar format. For example, Randall could draw to show his understanding of a reading passage or write a summary or poem that reflects the story. An option mentioned in the article Accommodations for Students with LD is to allow the student to “provide responses on a computer.” Using a computer can provide students with the ability to present their knowledge through technology. Throughout the book Inclusion, it suggests that as a teacher your primary goal is to know your student and enable them to embrace their differences to show who they are individually. From a legal perspective, this represented a profound and historic shift in America’s disability policy. With the passage of Section 504 of HR 8070 (named The Rehabilitation Act of 1973), which banned discrimination on the basis of disability, this marked the first time people with disabilities were viewed as a group - a minority group. This Section also provided opportunities for children and adults with disabilities in education and employment and allowed for reasonable accommodations such as special study areas and assistance as needed for students with disabilities.
Public Law 94-142: The Education for All Handicapped Children Act of 1975, now called Individuals with Disabilities Education Act (IDEA), requires states to provide free, appropriate public education (FAPE) for every child regardless of disability. This federal law was the first to clearly define the rights of disabled children to receive special education services if their disability affects their educational performance. A parent of a special education student also has basic rights under IDEA including the right to have their child evaluated by the school district and to be included when the school district meets about the child or makes decisions about his or her education. If a child is identified as in need of special education services, the school district must devise a written individual education program (IEP) for the child, which includes related services. An IEP is a statement of a student’s special education and related services including speech services, psychological services, physical and occupational therapy, counseling and assistive technology and transportation. The administrator that I spoke to wrote in a fax "the Special Education classes are transitioning into study skills classes so the teacher can provide additional help and support for the student to succeed in the regular class environment. During the four or five periods, when the teachers and instructional aides do not have students assigned to them, they are providing support for their students in the regular education classroom. The level of support is directly related to two factors: 1) What the student needs to be successful. 2) What the teacher needs to help the student succeed. So the support provided by the teacher may be provided daily in the regular education classroom, in the form of helping the student take notes, monitoring behavior, doing a lab activity, etc. The support may also take the form of weekly program checks with the regular education teacher, modifying and/or adopting curriculum, or teachers meeting informally to talk."

Students with disabilities are far too frequently isolated and separated from the education system (Johnson). They are often provided a diluted, inferior education and denied meaningful opportunities to learn. Writing this final essay for this course one is able to reflection on the knowledge one has gained since the beginning of the course. This course has been affective and the benefits are using the information immediately to correct mistakes and grow in the profession. After interviewing attorneys and director’s special in the education program the reality of how important following the regulations are important and must be followed. As a special educator one is more prepared and ready to provide a first rate education. Accommodations will help students achieve these academic goals, which can be instructional or environmental changes that help students to successfully understand and respond to the regular curriculum. These kinds of accommodations may be a change of seating in the classroom, sitting up front during story time or allowing more time on an exam. For example, a child who may have dyslexia needs to have an additional 20 minutes on exams, or have test questions and answers read to them aloud. These are accommodations made in order for the student to have the best chance of success.
