Trademark Infringement and Counterfeiting in the Fashion Industry
In 2012 US Customs and Border officials seized $1.26 Billion, in counterfeit goods (US seizes counterfeit goods worth $1.26 billion in 2012, 2013). Counterfeiting has become so widespread that it has often become difficult to determine which item is the authentic one.
Counterfeit goods fall under the intellectual property law of trademarks. When a trademark has been infringed upon in the fashion industry it is known as counterfeiting. Proving that a trademark has been infringed upon can be very difficult. Counterfeiting also is a huge burden to law enforcement. Law enforcement must spend large amounts of money in order to combat the counterfeit good trade. Not only is the money being spent, but their time is being taken as well. There are other crimes that law enforcement could be handling, but cannot send their full resources because they are also dealing with the counterfeiting. Finally the consumers are affected as well. Consumers are affected by counterfeit goods everyday by being forced to pay higher prices. Brands are losing money when consumers make the choice to buy the counterfeit good. If there was no counterfeit the consumer would have to buy from the brand itself. Brands that lose money due to counterfeiting are forced to raise their prices in order to combat costs. This then drives the prices up for the consumers who are now forced to pay these higher prices.
As technology continues to increase it is likely that counterfeiting in the fashion industry will as well. Before the internet it was much more difficult to sell counterfeit goods as there was

The fashion industry as a whole, has been notorious from green issues caused by their lack of sensitivity to the environment, conspicuous and unnecessary consumption of materials, encouraging an “throw-away” society and image issues that support women and young adults to look a certain way to feel “beautiful.” This is an issue that has increased over the past decades. Not just women, but men also feel the uncontrollable need to do whatever it takes to look like the celebrities they see on television and on the runways. The thought that the materials to make those desired items may have caused the life of animals or the destruction of mother nature does not come into mind. Countless people are concerned about conserving planet Earth and keeping it healthy. The fashion world has been targeted for many corruptions.

The Fashion Industry can be described as a glamorous world with cameras flashing, beautiful models strutting down the runway, in stunning and grand designs. What really goes on behind fashion’s dolled up doors is only an illusion compared to what reality is. Beautiful people, stylish clothing and timeless sophistication all make up the illusion of the glitz and glam of the fashion industry, but behind the curtains countless of models and designers constantly fall victim to this industry’s ever changing wrath. Fashion can be defined as a popular trend especially in styles of dress, ornaments or behavior. A model is a person who poses or displays for art purposes, fashion or other products and advertising. Fashion models are used mainly to promote products focusing mostly on clothing and accessory. The two main type of modeling in the fashion industry is commercial modeling and high fashion modeling. High Fashion models usually work for campaigns, designer’s collections and magazine editorials for high fashion designers. Runway modeling also known as “catwalk modeling” is displaying fashions and is generally performed by high fashion models. In my research paper, my main focus will be the multiple effects on high fashion models based upon the industry’s unregulated standards.

We buy anything that doesn’t break a bank, people buy a $10 shirt just because it’s cheap and they might not even wear it, but it’s all right, since it wasn’t expensive. Most of the time they do not just stop there, and it is not even just clothes. They usually buy jewelry, shoes, and even bags or purses to match. Sometimes it can get a little out of control. Most designers, if not all, release a new line of clothing every year or season. Bringing out a new line of clothing every year or season encourages fashion enthusiasts to buy new clothes that they don't really need. While some people see this as harmless or helpful to the economy, others believe that it encourages mindless consumerism.
