The Treatment of Women and Men Sports Players
Sport plays a major part in the culture of today’s society. Many
people spend considerable time in front of the television, in sports
grounds and traveling all over the country to support their respective
club whether it be football, rugby, cricket or netball etc. However
whilst playing, spectating or just generally being involved in a
sport, things can go wrong and this very often results in an action in
the civil or criminal courts.
Sporting incidents should be dealt with like any other civil or
criminal action, however there is evidence this is not happening in
many cases in both areas of law.
There can be several areas of civil law where claims can be made.
These are Negligence, occupier’s liability, defamation, nuisance,
trespass and animals. However not all these will need to be looked at,
the main ones being Negligence and occupiers liability. It is in the
area of negligence that I will look at the sporting cases and how they
differ from non - sporting cases of civil wrongs. I will be looking at
participators, clubs, referees and spectators. In the second section
I will be looking at negligence and injuries in football and how they
differ from non football negligence and injuries.
Part 1 The Law of Negligence
Negligence occurs in many areas of civil Law. Negligence consists of
three elements, namely a legal duty to take care, breach of that duty
and damage suffered as a consequence of that breach.

Unintentionally, a lot of us have been boxed into institutions that promote gender inequality. Even though this was more prominent decades ago, we still see how prevalent it is in today’s world. According to the authors of the book, Gender: Ideas, Interactions, Institutions, Lisa Wade and Myra Marx Ferree define gendered institutions as “the one in which gender is used as an organizing principle” (Wade and Ferree, 167). A great example of such a gendered institution is the sports industry. Specifically in this industry, we see how men and women are separated and often differently valued into social spaces or activities and in return often unequal consequences. This paper will discuss the stigma of sports, how gender is used to separate athletes, and also what we can learn from sports at Iowa State.
1. Through the readings, films, and discussions, we have looked at the image of women in sport. Discuss the images of women in sport and how they are affected by today's cultural ideal of women.
Women have forever had this label on their back of being too small, too weak, too feminine, and too boring. The traditional gender roles of the female interfere with the extortionate nature of competing in sports. Men are usually the ones to go 100% and give whatever they got, and to show masculinity while doing it. The standard masculinity of being strong, smart, and taking charge over dues the feminine traits of being soft, gentle, and polite. That’s what society has taught us to learn and accept. But the traditional female gender role is diminished when participating in athletics and people may think it’s weird to see females compete at the same level as males do. It has taken many years for women to gain a semblance of equality in sports. Throughout history, women have been both excluded from playing sports and discriminated against in sports. Men’s sports have always dominated the college athletic field, but women were finally given a fighting chance after Title IX was passed. Title IX, among other things, requires scholarships to be equally proportioned between men and women’s sports. Although this was a huge gain for women, gender inequality still exists in sports today. An example of this persisting inequality can be seen when looking at men’s baseball and women’s softball. In college, baseball and softball are both major NCAA sports. It is widely accepted throughout today’s society that baseball is a man’s sport, and softball is a woman’s sport. Very few people question why the two sexes are separated into two different sports, or wonder why women play softball instead of baseball. Fewer people know that women have been essentially excluded from playing baseball for a long time. This paper will focus on why softball has not changed the way women’s basketball has, why women continue to play softball, the possibilities and dynamics of women playing baseball with and without men, and the most discriminating aspect of women being banned from playing professional baseball.
Men and women have been separated since the beginning of life. God put Adam in charge of the Earth. When God created Eve, he took a piece of Adam’s rib from his stomach to create Eve. From this story that came from the bible, men believe that God made them better than women. And this has created a gender inequality between man and woman ever since then. Gender inequality, as stated on The Free Dictionary’s website is, “the difference between women and men in regard to social, political, economic, or other attainments or attitudes, or the problem perceives to exist because of such difference.” I believe that, when it comes to women’s sports, there is a pretty big difference in genders. Some of these differences are caused by men. A good example is that there are an enormous amount of men that take it as a joke. Most men feel that women just do not have the capability to ever have the strength and skills to compete with men. While others look at it as women are too girly to play and that they will cry and complain if they break a nail. Some think women are too fragile and if they try to compete against a man they will get badly injured. I believe these opinions that men have about women in sports, leads to the gender inequalities in it.
As it becomes increasingly acceptable for women to be athletic in American culture, a new question arises: in which sports should women be allowed to participate? From a physiological standpoint, it has been scientifically proven that female bodies do not differ significantly enough from male bodies to prevent them from participation in any "male" sports. This division between "male" and "female" sports clearly stems from age-old, socially constructed norms of femininity and masculinity. When women attempt to challenge these societal molds by participating in sports that are traditionally male, the intricate web of norms is disrupted. Like many other instances where traditional social constructions are tinkered with, individuals and communities are forced to reevaluate how they think about and categorize their surroundings. I would argue that women's participation in athletics, especially in non-traditional sports, is instrumental in breaking down stereotypes and social confines that have plagued women for centuries
What are the social and cultural costs and benefits of an individual (male or female) entering a non-traditional sport for their gender/sex (e.g. women enter body building, power lifting, boxing; men enter synchronized swimming or field hockey)?
Sports become stereotyped as gender-neutral, feminine, or masculine based on conceptions regarding gender, gender differences, and beliefs about the appropriateness of participation due to gender (Colley et al., 1987; Csizma, Wittig, & Schurr, 1988; Koivula, 1995; Matteo, 1986). Sports labeled as feminine seem to be those that allow women participants to act in accordance with the stereotyped expectations of femininity (such as being graceful and nonagressive) and that provide for beauty and aesthetic pleasure (based on largely male standards). A sport is labeled as masculine if it involves the following: 1) attempts to physically overpower the opponent(s) by bodily contact; 2) a direct use of bodily force to a heavy object; 3) a projection of the body into or through space over distance; and 4) face-to-face competition in situations in which bodily contact may occur. These characteristics are believed to be appropriate expressions of masculine attributes such as aggressiveness, effectiveness, and power (Metheny, 1965; Koivula, 2001).
“Did you notice that the boys game is played differently than the girls, I mean my children don’t complain about the rule difference but I wonder what is up with that.” Most likely this is what is going through parents minds while their kids are playing a game and then there are other teams that are a different gender playing the game differently. In youth sports, the rules are different for the different genders playing the game which makes it a really judged game based off of athletes different genders.
For many years gender inequality in sports was still present, even after the women's right movement, Title IX was passed in 1972 (Sandys, 2007). Title IX banned sex discrimination in any education program that is federally financed. This was supposed to correct the imbalance of treatment between the sexes of college students. Since the passing of the federal gender-equality law, universities started to offer a chance for many of women to participate, that was not previously offered before (Adams & Tuggle, 2004). Now that more women have jumped into the sports arena, many institutions are giving the appearance of offering more sports to females (Hardin & Shain, 2005). Equal opportunity for women in sports would provide better psychological and sociological development that would derive from the impact of sports participation.
Over the past decade or so, we’ve seen a dramatic increase in the number of women dominating in their respective sports. As well as, seeing women dominate in their professional sports, we’ve seen women become more prominent in broadcasting, and reporting on sports as well. An occupation that once was male dominated, is not so much anymore. These strong female figures, such as Ronda Rousey, Venus and Serena Williams, Maya Moore and Erin Andrews are making waves and names for themselves in sports history with their notable athleticism, feministic views, and sports knowledge. Women in sports is relatively a new thing in the U.S. Until 1972, discrimination in sports on the basis of sex was very prevalent. Title IX established fairness in regards to sex discrimination for women in federally funded schools and programs. I had the ability to interview a woman who lived and went to school during this era.
