For years it has been a hot topic. What can students do and what can they not do? What is considered going to far? For many this is a question that has no true and legal answer. To many students, that is. In fact I happen to be one of the many. Now it would be wrong for me to write this paper and not put in my “two sense”. In my opinion this student protest bullshit has no limit.
Students should not be restricted to what they can and cannot do. They like everyone else are American citizens and should not have their rights as American citizens stripped from them when they enter a building teaching them all about the rights they possess. To me that is the very hypocritical. To teach one thing, and practice another! I mean come on doesn’t that come a cross as more than a tad bit wrong.
There are a number of court cases that cover the matter of student protest. Like always though I choose not to follow the norm, if you will. I would much rather take you on a trip through my mind and my opinions.
As for student protest I am all for it. I would take it to the highest degree if it has to go that far. I see school as a place to come and socialize. The stuff that is taught is all boring to me. It always seems as if I already know what is going to be said. So what is the point? To go and get a diploma that in all actuality is nothing but a piece of paper that could easily be made by me. Perhaps that is why I get myself in so much trouble here. I am not the only one students just get bored and try to heighten the learning experience. Try to make it more fun for everyone. Even though there may be those who don’t quite comprehend what is going on, they still enjoy the laughter. Who knows maybe they even learn a thing or two from the student that the obviously more intelligent teacher couldn’t get them to understand. I am not saying that the student is smarter than the teacher but in some cases the yelling and screaming of a teacher to get through can be substituted by the subtle sarcasm of the student.
The case also states “A prohibition against expression of opinion, without any evidence that the rule is necessary to avoid substantial interference with school discipline or the rights of others, is not permissible under the First and Fourteenth Amendments” (Tinker v. Des Moines Independent Community School District). Because the students didn 't necessarily disrupt the education process, their First Amendment freedom of speech should not have been violated by the school officials.
The district court found the disruptive-conduct rule unconstitutionally vague and broad, and that withdrawal of the student's name from the graduation speaker's list violated the Due Process Clause of the Fourteenth Amendment because the rule did not mention such removal as a likely sanction. The court made the case that nothing in the Constitution forbids the states from insisting that certain forms of expression are unfitting and subject to sanctions. (Tinker v. Des Moines Independent Community School District, 1969) The court affirmed that students do not "shed their constitutional rights to freedom of speech or expression at the schoolhouse gate."(Tinker) If the student had given the same speech off the school premises, he would not have been penalized because government officials found his language inappropriate.

Therefore, those students’ right to expression or speech was not violated because it interfered with the classroom’s learning. There is a time and place for everything, and freedom of speech should not be used everywhere.
One of the most violent protests of the Vietnam War took place in May of 1970 at Kent State University in Ohio. Protests were common across America during the war but this was by far the most violent. On May 4, l970 members of the Ohio National Guard fired into a crowd of Kent State University protesters, killing four and wounding nine of the Kent State students. The event triggered a nationwide student strike that caused many colleges and universities to shut down . This deeply divided the country politically and made ordinary citizens take notice of the protests that were taking place across the nation’s college campuses.
In December 1965, an issue was caused by teachers’ in violating students’ freedom of speech. In December some students from Des Moines Independent Community School District, in Iowa were suspended for wearing black armbands to protest against the American Government’s war policy in support Vietnam (Richard, Clayton, and Patrick).The school district pressed a complaint about it, although the students caused no harm to anyone. Students should be able to voice their opinions without the consequences of the school district.

When looking at restricting or granting student or group speech administrators must be consistent, because allowing one student or group to expression their First Amendment right opens a door for other student or groups that can be difficult to close. The institution should have clear policies that designate Public Forums, Designated Public Forums, Limited Public Forums, and Non-public Forms. Furthermore, a policy should be created explaining a student’s rights with procedures for a student to redress grievances. Beyond the established policies, administers must be aware of (and have training in) student rights, but should also understand the breadth of power public institutions have to restrict those freedoms when the expression of those freedoms would cause disruption to the school.
Students’ rights in schools are limited or just taken away. Kids are forced to do whatever the officials at their school, either the principal or the teachers, tell the students to do. One of the main right that gets taken away or limited is students’ first amendment rights, which is the freedom of expression. Students can gets suspended by just doing things the staff at the school does not like, including saying things that they don 't like or supporting a religion that the school does not support. Also, if something is said about the school or the people attending the school is said on social media that student can also get in a lot of trouble. In the two videos provided by FIRE, certain situations where students’ basic rights were violated were shown. In the first video presented by FIRE, I was very surprised to learn that some colleges opt to control what you wear, what you post on Facebook or what you say. Instead of educating young adults, it appears that colleges nowadays are trying to babysit them in every dimension of life, including their personal online social life. One example that prominently stood out to me was Hayden Barnes’ story, in video two. Hayden Barnes found himself in deep trouble with the school when he decided to speak out against an overpriced project that the school had decided to complete, by using student fees. This situation shows exactly why organizations like FIRE are needed. Students in certain schools have little to no verbal opinion on what happens at their school. There are certain things you’re allowed to say, and certain things that you are not allowed to say. Whatever happened to freedom of speech and does it exist on college campuses?
The First Amendment to the United States Constitution protects the exercise of an individual’s freedom of speech from infringement by government; the Fourteenth Amendment extends this protection to the States and local levels of government, including public schools and universities. The Supreme Court has held that students do not “shed their constitutional rights to freedom of speech or expression at the schoolhouse gate” (Tinker). School officials have the authority to censor school-sponsored speech based on legitimate pedagogical concerns. The dean of students has not censored any editorials yet, but required that they be cleared by her before publication. The main issue in this case is whether there exists a legitimate reason on her part to require the clearance of every editorial. Additionally, the dean of students has warned against a planned rally to protest lavish spending. This protest is not school-sponsored speech, but student speech that occurs in school premises. In Tinker v. Des Moines Ind. Sch. Dist., the Supreme Court ruled that speech must be tolerated unless it “substantially interfere[s] with the work of the school or impinge[s] upon the rights of other students.” Here the question is on the justification of the school to use disciplinary action against protesting students.

All people in the United States are guaranteed this right by the Constitution. Students, however, do not have this right to the same extent as adults. This is because public schools are required to protect all students at the school. The major aspects of this right are speech and dress. Both the right to speech and dress are not absolute in public high schools. According to the American Civil Liberties Union: "You (students) have a right to express your opinions as long as you do so in a way that doesn't 'materially and substantially' dirsupt classes or other school activities. If you hold a protest on the school steps and block the entrance to the building, school officials can stop you. They can probably also stop you from using language they think is 'vulgar or indecent'("Ask Sybil Libert" ACLU 1998). Public schools can also restrict student dress. In 1987 in Harper v. Edgewood Board of Education the court upheld "a dress regulation that required students to 'dress in conformity wit hthe accepted standards of the community'"(Whalen 72). This means that schools can restrict clothing with vulgarities and such, but they cannot restrict religious clothing: "School officials must accomodate student's religious beliefs by permitting the wearing of religious clothing when such clothing must be worn during the school day as a part of the student's religious practice"(Whalen 78).

School should be a time to make mistakes in a safe environment that they can learn from, not a place that they are petrified to make a mistake for fear of retribution on their grade cards. Its time to change the school system to save future students from becoming stress crazed and to let them know that there is more to this world than a grade card and in the long run it is a very small fraction of life.
Academic freedom should be a liberty granted to students and teachers of all ages. “Research in cognitive, developmental and educational psychology shows that learning and development are active self-regulated processes that require the freedom to seek information, to formulate and express your own ideas, and to engage in discussion. Many teachers that are tenured into a university of school district can say and do just about anything they want, whereas a teacher that has been apart of an institution for five years will be removed from the school for something the tenured colleague would not even be questioned about. In high schools the administration is so worried about parents complaints and how it will effect their reputation as a school that they let it affect the education that their students are receiving. Allowing grade school students the ability to be apart of the process building their schedule and education would be a step in the right direction. At this age students want to be more independent and are willing to experience all types of classes and learning types. When a student gets to college they are expected to have some kind of a major picked out. If the
