According to the text, a prenuptial agreement or premarital agreement is a contract signed before a couple is married that outlines how property will be distributed when a marriage ends, by divorce, annulment, or death. Premarital agreements lead to many issues because during the course of a marriage, a couple not only has the property they came into the marriage with but also property such as gifts, inheritances, or additional assets gained during the marriage. This is defined as separate property. However, there are cases where what would seem like separate property is actually community property. In fact, child support is necessary whereas spousal support isn’t relevant to all marriages and should be revamped. Furthermore raising and supporting children are very expensive. Regardless if the parents are together or not, both parents are required to support the children and every expense that childcare requires. Whether a child is born to parents with above average incomes, or parents with low incomes, the child still needs to be taken care of and both parents should be required to do so. On the other hand, not every divorced couple is awarded spousal support. In fact, spousal support seems to be a benefit of marrying a partner with higher than normal income. Because of this the rules around spousal support should be changed and judged on in a case by case basis. Spousal support in the case of a child with special needs, which requires a parent to stay at home is legit. However, spousal support that is awarded in order to make sure that a partner maintains their way of living after the divorce isn’t nearly as important, especially when people who marry just to financially benefit is
