The article “Should This Student be Expelled”, by Nat Hentoff exhibits many persuasive techniques and the writing style does an excellent job in giving the readers a direct and unfiltered look into the offenses of Doug Hann. The shocking statements that have been presented in the work quickly grab the attention of the audience, allowing them to understand the facts and produce an opinion. One of many notable persuasive techniques in this work would be the accurate portrayal of Hann. There is no room for bias from the author, only room for what has happened and what was said. The issue with this controversial case was that the student wrote the poem from a first-person basis and the words did not present any physical harm or threat to other students. The Ninth Circuit Court ruled in favor of the school district because the writing presented the likelihood or potential that a suicide could occur, which could have had a devastating and psychological impact on the school community.
This case involved a public high school student, Matthew Fraser who gave a speech nominating another student for a student elective office. The speech was given at an assembly during school as a part of a school-sponsored educational program in self-government. While giving the speech, Fraser referred to his candidate in what the school board called "elaborate, graphic, and explicit metaphor." After his speech, the assistant principal told Fraser that the school considered the speech a violation of the school's "disruptive-conduct rule." This prohibited conduct that interfered with the educational process, including obscene, profane language or gestures. After Fraser admitted he intentionally had used sexual innuendo in the speech, he was told that he would be suspended from school for three days, and his name would be removed from the list of the speakers at the graduation exercises.
He makes some very valid points pertaining to the zero tolerance policy practiced by schools and how it has a negative effect on children in our school systems and essentially pushes them into our juvenile and prison systems. I am a firm believer that the zero tolerance does nothing good for students in school. In my mind it completely goes against everything our schools supposedly stand for. We tell kids to go to school to learn, but the first time they break a rule we suspend them and send them home or even worse we expel them for the entire year. I just don’t see how that isn’t setting kids up for failure down the road and neglecting them of a quality education. One statistic the author presented that really caught me off guard was when they said that when someone is suspended or expelled even once in their entire time in school their chances of ending up behind bars is increased at a rate of five times than that of someone who doesn’t get suspended or expelled. For example, Lukianoff and Haidt explain that public figures like “Jerry Seinfeld and Bill Maher have publicly condemned the oversensitivity of college students, saying too many of them can’t take a joke”. Lukianoff and Haidt also provide examples of events being canceled, because of protests. Based on a TV commercial an event was canceled because the “’program [was] dividing people and would make for an uncomfortable and possibly unsafe environment’”. This example shows how many events, words, subjects, will cause discomfort to people causing them to be canceled. However, the examples provided shows how many people are missing out on positive learning experiences. Another major reason why juveniles are ending up in the juvenile justice system is because many schools have incorporate the zero tolerance policy and other extreme school disciplinary rules. In response to violent incidents in schools, such as the Columbine High School massacre, school disciplinary policies have become increasingly grave. These policies have been enacted at the school, district and state levels with the hopes of ensuring the safety of students and educators. These policies all rely on the zero tolerance policy. While it is understandable that protecting children and teachers is a priority, it is not clear that these strict policies are succeeding in improving the safety in schools.

Following the Columbine tragedy in 1999, “school systems across the nation introduced the zero-tolerance policies aimed at the curtailment of harmful student behaviors” (Noll, 2014, p. 295). The original focus of the policies was to eliminate the use/carrying of weapons but soon after spread to restricting drugs and medication (2014). By 2006 95% of the U.S. public schools had adopted the zero-tolerance policies and more than half of them reported taking significant action against students, many of which resulted in expulsion (2014). While the zero-tolerance polices were originally welcomed by all members of a community as a means of promoting and keeping a safer environment-- as of late many individuals are questioning the relevance of some actions and some school officials (2014).

John Doe took his picture with a smile and a hand gesture in which his thumb, index, and middle finger was raised. This was enough to earn him an indefinite suspension with a recommendation for expulsion because his school administrators believed he flashed a gang sign although he was simply putting up three fingers to represent his football jersey number. This kind of criminalization of young people contributes to suspension, dropout, and incarceration, and too often pushes students into what is referred to by many education scholars and activists as the “school-to-prison pipeline,” a term that refers to “the policies and practices that push our nation’s schoolchildren, especially our most at-risk children, out of classrooms and into the juvenile and criminal justice systems” (ACLU 2013). The School-to-Prison Pipeline is one of the most urgent challenges in education today. This paper will focus on the following circumstances and policies contributing to the school-to-prison pipeline: 1) resource deprived schools, 2) high-stake testing and 3) zero-tolerance discipline policies.
