Human rights are rights that belong to all human beings simply because of their humanity. These rights are inherent to all humans regardless of one’s race, religion, gender, colour, language, or any other status and everyone is equally entitled to their human rights without discrimination.
Religious discrimination is the unequal treatment of individuals or a particular group either before the law or in institutional settings such as employment or housing simply because of one’s beliefs.

It would also be racial discrimination if there was a policy that was the same for everyone but had a negative impact on people from a particular race. A certain type of workplace that does not allow people to wear any type of head wear even if it is a part of someone’s religion is a type of indirect racial discrimination. The Racial Discrimination Act 1975 is an Act that protects every individual in Australia from racial discrimination and ensures that every one has equal opportunities. The Act makes it illegal for any person to discriminate against another person or treat them unfairly whether it be because of a person’s religion, race, or color. The Act is fairly effective and helps individuals with different aspects of their lives such as employment, education, accommodation etc. People are able to feel at ease as they are aware that they cannot be treated unfairly as it it illegal to do so. However, many people still encounter racial discrimination on a daily basis. This may be due to the fact that although the law states that it is illegal to discriminate against someone, many people disagree with the law and believe that there is nothing wrong with racial discrimination. If they feel uncomfortable writing a complaint, they can get a solicitor, advocate or trade union to write a complaint on their behalf. It is free to write a complaint to the commission and it must be written out. The commission has forms that people can fill out and post or they can simply just lodge a complaint online. If someone is unable to write a complaint out the commission can offer help and can also provide a translator for those who do not speak English well. The complaint should clearly explain the incident, when the incident happened and where it happened and must also mention the people that were involved. After the complaint has been received by the commission and the incident that is explained in the complaint is covered by the Racial Discrimination Act, the President of the Commission can examine the complaint and try to resolve it by conciliation which is the action of peacemaking and preventing anger or hatred by talking about the issue and coming up with a resolution. The commission cannot decide whether the person has actually been discriminated as it is not a court.
