On the Duty of Civil Disobedience
In a concise essay, Thoreau proffers a challenge to all men, "not to cultivate a respect for the law, so much as for the right." Over and over, almost redundantly, Thoreau stresses simplicity and individualism, as most transcendentalists (the new philosophical and literary movement of Thoreau's time) did. Thoreau clearly states, in his On the Duty of Civil Disobedience, that the government is unjust and doesn't represent the will of the people, that one man can't change the government, and that people succumb unconsciously to the will of the government. The first of these is a ridiculous notion; the second contradicted and supported alternately throughout the essay so that one cannot be sure of what they agree or disagree with while reading it because it always contradicts itself in the following paragraph; and the last, a well-thought-out and legitimate concept.
Thoreau believed that "That government is best that governs least," (222) but his harsh feelings stemmed from his dislike of the government and its motivations at that time. He thought that everything the administration did was wrong: their head-turn at the treatment of slaves, their land-grabbing war with Mexico, and the taxes that Thoreau himself was imprisoned for refusing to pay. Even the basic system of government was unfair and biased to him. He thought that the majority system was unjust, "… when the power is in the hands of the people, a majority are permitted … to rule, not because they are most likely to be in the right, nor because this seems fairest to the minority, but because they are physically the strongest," (231) but what else can there be in a non-monarchical government? On the Duty of Civil Disobedience is an opinionated yet sincere treatise on the efficaciousness and assumed power of the United States' democratic government. The three main points proposed in this discourse vary in sensiblity from tangible to impalpable. Unfortunately, it is a very difficult and, for some, uninteresting and exasperating reading because in many parts of his essay, Thoreau, through ramblings and descriptions, unwittingly contradicts himself many times. Because of this, he is, by many, disregarded as a great philosopher and considered a hypocrite, and one has to look deep to discover the real meaning behind his grand words and complex sentences.

History has encountered many different individuals whom have each impacted the 21 in one way or another; two important men whom have revolted against the government in order to achieve justice are Henry David Thoreau and Martin Luther King Jr. Both men impacted numerous individuals with their powerful words, their words carried the ability to inspire both men and women to do right by their morality and not follow unjust laws. “On the Duty of Civil Disobedience” by David Henry Thoreau along with King’s “Letter from Birmingham Jail”, allow the audience to understand what it means to protest for what is moral.
Martin Luther King and Henry David Thoreau each write exemplary persuasive essays that depict social injustice and discuss civil disobedience, which is the refusal to comply with the law in order to prove a point. In his “Letter from a Birmingham Jail,” King speaks to a specific audience: the African Americans, and discusses why he feels they should bring an end to segregation. Thoreau on the other hand, in “Civil Disobedience,” speaks to a broader, non-addressed audience as he largely expresses his feelings towards what he feels is an unjust government. Both essays however, focus on the mutual topics of morality and justice and use these topics to inform and motivate their audience to, at times, defy the government in order to establish the necessary justice.
In 1848, David Thoreau addressed and lectured civil disobedience to the Concord Lyceum in response to his jail time related to his protest of slavery and the Mexican War. In his lecture, Thoreau expresses in the beginning “That government is best which governs least,” which sets the topic for the rest of the lecture, and is arguably the overall theme of his speech. He chastises American institutions and policies, attempting to expand his views to others. In addition, he advances his views to his audience by way of urgency, analyzing the misdeeds of the government while stressing the time-critical importance of civil disobedience. Thoreau addresses civil disobedience to apprise the people of the need for a civil protest to the unjust laws created against the slaves and the Mexican-American war.
Justice is often misconceived as injustice, and thus some essential matters that require more legal attention than the others are neglected; ergo, some individuals aim to change that. The principles of civil disobedience, which are advocated in both “Civil Disobedience” by Henry David Thoreau and “Letter from Birmingham Jail” by Martin Luther King Jr. to the society, are present up to this time in the U.S. for that purpose. To begin with, Thoreau expresses that civil disobedience should be more implemented when the just resistance of the minority is seen legally unjust to the structure conformed by the majority. Supporting his position, Thoreau utilizes the role of the national tax in his time; its use which demoralizes the foreign relationship of the U.S.; its use which “enables the State to commit violence and shed innocent blood”; its use which supports “the present Mexican War” (Thoreau 948, 940).

“On the Duty of Civil Disobedience” is evocative of some of the most famous writings of the Revolutionary Era. In comparison to “The Declaration of Independence”, both works include the three elements of Aristotle’s rhetorical triangle: logos, ethos, and pathos. When employed tactfully, the combination of these three components can create a very compelling argument. This letter covers the ways in which peaceful protest and standing up against injustice can lead to positive results. Both pieces conveyed a similar message of standing up for what is right. The strongest rhetorical methods which Thoreau uses are allusions, logos, ethos and rhetorical questions. However, King’s use of Thoreau’s piece was written prior to the civil war, and was in response to the Mexican-American war and slavery in some territories. It was intended for US citizens; more specifically, those who are unhappy with the way the United States government is ran.
Many throughout history shared Thoreau’s opinion, especially those who were on the receiving end of the government’s unjust practices. Thoreau felt that a better government was needed and I would argue, that his words are still relevant today. There is always room for the government to improve. Thoreau wanted a government that didn’t just look to the interests of the powerful majority, one in which individuals with consciences lead, instead of a collective power making decisions for the individuals. The people have the right to resist a government that isn’t serving them properly or is treating them unjustly, or is using their funding for immoral causes; in fact, it is the people’s duty to do so, for only through civil disobedience can the people simulate change. From these three men, we can learn the significance of detaching ourselves from the social norm and instead, fight for our values in a non-violent way, in order to make a change in our government’s corrupt and unjust laws. In “Resistance to Civil Government,” Thoreau articulates the importance he places on resistance against a powerful, controlling government. He opens his essay with a reference to the quote, “‘That government is best which governs not at all,’” and shares the motto, “‘That government is best which governs least’” (Civil).... ...
According to the American heritage dictionary “Civil Disobedience” is refusal to obey civil laws in an effort to induce change in governmental policy or legislation, characterized by the use of passive resistance or other nonviolent means. In “Civil Disobedience” Thoreau stated “That government is best which governs least, and I would like to see it acted up more rapidly and systematically” (pg227). Thoreau did not believe that the government should have the final say on everything. The citizens of this country should have rights in the decision making process and the opportunity to think for themselves also. Thoreau says that government does not, in fact, achieve that with which we credit it: it does not keep the country free, settle the West, or educate. Rather, these achievements come from the character of the American people, and they would have been even more successful in these endeavors had government been even less involved.
In this short story Thoreau plays the protagonist as well as a pacifist. He continually reiterates his beliefs of law and conscience. Thoreau believes we have a conscience to determine right and wrong and views the government, at a state level at least, as useless. He gives the reader several examples of things the government does that would be against most conscious decisions. Such as: The listing of accomplishments the “government” made possible, included in this list is the repetition of the word “It” referring to the government. “It does not keep the country free. It does not settle the West. It does not educate. The character inherent in the American people has done all that has been accomplished”(221).

Henry David Thoreau (1817-1862) was a philosopher and writer who is well known for his criticism of the American government during the time. During Thoreau’s life, there were two major issues being debated in the United States: slavery and the Mexican-American War. Both issues greatly influenced his essay, as he actually practiced civil disobedience in his own life by refusing to pay taxes in protest of the Mexican War. He states that the government should be based on conscience and that citizens should refuse to follow the law and have the duty not to participate and stay as a member of an unjust institution like the government. I argue that the notion of individualism and skepticism toward government is essential to the basis of many important reform movements in the modern society.
