In Canada’s history we have been through some pretty horrific events like the Residential schools and the 60’s scoop, but now with our government and human rights the country of Canada has evolved a long way in multiculturalism. The human rights are the laws, customs, and practices that have evolved over the ages to keep the ordinary people from oppressive rules in the government. It includes the Prime Minister of Canada and cabinet, the Parliament of Canada, the federal courts and more than a hundred of departments and agencies which administer the day-to-day business of government. The Prime Minister in Canada is the head of government and is appointed by the Governor General. Canada is the northern neighbor to the United States, and the Queen of England is its head of state. These powerful countries being so closely tied to Canada makes it a major player on the world stage, and gives considerable power to its Prime Ministers.There have been twenty-two Prime Ministers, with John Diefenbaker being the thirteenth, serving from 1957-1963, and Pierre Trudeau the fifteenth, who served 1968-1979 and again 1980-1984. Diefenbaker was a progressive conservative, a right-center group associated with British imperialism. Trudeau was part of the Liberal party of Canada, one that focused on individual freedom, ironic considering Trudeau was the only Prime Minister to enact the War Measures Act during peacetime. Domestically, these two Prime Ministers have done much in terms of protecting and growing a modern Canada. There are many ways these leaders' domestic policies were similar, such as helping to create an equality among Canadians, and many ways in which they had opposing policies, such as their policies regarding French-Canada.
In Canada there are three branches of government: the executive branch which enforces Canadian laws and carries out government business; the legislative branch which debates and passes laws; and the judicial branch which interprets the laws and dictates how punishment should be carried out. In parliamentary government the executive branch is drawn from the legislative branch and is responsible to it. The responsibility lies in the fact that the government must have the confidence (or majority support) of the House of Commons in order to remain in power and this confidence is assured through party discipline; in other words, the party expects their Members of Parliament (MP’s) to vote the way the party votes.
Canada is a society built on the promise of democracy; democracy being defined as “government by the people; a form of government in which the supreme power is vested in the people and exercised directly by them or by their elected agents under a free electoral system.” In order to operate at full potential, the people of Canada must voice their opinions and participate fully in the political system. This is why it’s shocking to see that people are becoming less engaged in politics and the voter turnout has steadily been declining over the last 20 years. This lack of participation by Canadians is creating a government that is influenced by fewer people, which is detrimental to the democratic system Canada is built on.
The Constitution of Canada is very appropriate as it plays its role as a blueprint for the structure of Canada. According to section 91 of the Constitution Act, 1867, it says, “It shall be lawful for the queen, by and with the advice and consent of the Senate and House of Commons, to make laws for the peace, order, and good government of Canada…” [laws-lois.justice.gc.ca]. The structure of Canada and the powers of the Parliament can be easily identified through this law. As it is said, the Parliament can only make laws with the advice and consent of the Senate and House of Commons regarding peace, order and the government of Canada, which is fair and appropriate. Furthermore, as said in section 92 of the Constitution of Canada, it says, “In each province the legislature may exclusively make laws in relation to matters coming within the classes of subjects next hereinafter enumerated; that is to say, - direct taxation within the province in order to the raising of a revenue for provincial purposes, etc.” [laws-lois.justice.gc.ca]. It is a law regarding exclusive powers of Provincial Legislatures on the following topics. Having this law in place ensures that each part of the Legislature gets equal rights and powers making the Constitution very appropriate as a blueprint for the structure of Canada. In addition, in section 93, it states that, “In and for each province the legislature may exclusively make laws in relation to education, subject and according to the following provisions…” [laws-lois.justice.gc.ca]. It states that each Province’s Legislature can make laws in relation to education, subject according to the following necessities. This law balances the education in each province and further develops the overall structure of Canada.
Different states have various ways of ruling and governing their political community. The way states rule reflects upon the political community and the extent of positive and negative liberty available to their citizens. Canada has come a long way to establishing successful rights and freedoms and is able to do so due to the consideration of the people. These rights and freedoms are illustrated through negative and positive liberties; negative liberty is “freedom from” and positive liberty is “freedom to”. A democracy, which is the style of governing utilized by Canada is one that is governed more so by the citizens and a state is a political community that is self-governing which establishes rules that are binding.
The Indian Residential schools and the assimilating of First Nations people are more than a dark spot in Canada’s history. It was a time of racist leaders, bigoted white men who saw no point in working towards a lasting relationship with ingenious people. Recognition of these past mistakes, denunciation, and prevention steps must be taking intensively. They must be held to the same standard that we hold our current government to today. Without that standard, there is no moving forward. There is no bright future for Canada if we allow these injustices to be swept aside, leaving room for similar mistakes to be made again. We must apply our standards whatever century it was, is, or will be to rebuild trust between peoples, to never allow the abuse to be repeated, and to become the great nation we dream ourselves to be,
The Prime Minister of Canada is given much power and much responsibility. This could potentially create a dangerous situation if the government held a majority and was able to pass any legislation, luckily this is not the case. This paper will argue that there are many limitations, which the power of the prime minister is subject too. Three of the main limitations, which the Prime Minister is affected by, are; first, federalism, second the governor general and third, the charter of rights and freedoms. I will support this argument by analyzing two different types of federalism and how they impact the power of the Prime Minister. Next I will look at three of the Governor Generals Powers and further analyze one of them. Last I will look at the impact of the charter from the larger participation the public can have in government, and how it increased the power of the courts.
We often wonder about the importance of government. Is it necessary? Does it really benefit society? The answer is yes. Many countries have diverse forms of government such as totalitarian, monarchy, theocracy, and much more. The United States of America specifically runs a democratic type of government. A democratic government gives power to the people. Citizens over the age of eighteen are allowed to elect leaders based on their individual opinions through voting rights. The main purpose of the American government is, to protect people’s inalienable rights to life, liberty, property, and the pursuit of happiness as our Founding Fathers intended.
The federal level ensures public safety for all Canadian citizens during times of terrorism and natural disasters, reassuring individuals that their safety is a top priority. The provincial government provides an organized foundation for the education systems as they are able to assist and encourage individuals who are of age to attend school. At the same time, they ensure the health care system is being funded appropriately and is sustaining all necessary health related needs for citizens. Finally, the municipal government guarantees that waste management is taken into account and is being done so in a societal and environmentally cautions manor. The municipal level as well is sufficient when it comes to water regulation and treating and distributing water to households amongst a city. Government effects my life everyday in a vast variety of ways. From the quality of the milk that I drink in the morning, to the license and Insurance I need to drive my vehicle to school and work. Government also effects the taxes that are deducted from my salary. The government uses this money to protect consumers and provide services for the public amongst many other things.

A general definition of human rights are that they are rights and freedoms to which all humans are entitled to, simply because there human. It is the idea that ‘all human beings are born free and equal in dignity and rights. They are endowed with reason and conscience and should act towards one another in a spirit of brotherhood.’ The thought that human rights are universal emerges from the philosophical view that human rights are linked to the conservation of human dignity- that respect for individual dignity is needed regardless of the circumstance, leading to the notion that human rights are universal. The earliest form of human rights can be traced back to European history- the French Declaration on the Rights of Man and of Citizen which says that men are born free and equal in rights.
