Becker (1963) Becker theorised that the term 'deviant' is applied when an actor (individual) violates the mores and values created by society. The label deviant is usually applied by a figure of authority or high social status, and provokes a negative social reaction. The same reaction that can be associated to an act of law breaking. Society struggles to differentiate between 'crime' and 'deviance',The two words are sometimes used interchangeably. Crime is an act that breaks 'criminal law'; resulting in formal punishment, whereas deviance is simply an act that is perceived as 'wrong'. The issue of social power cannot be divorced from a definition of deviance, some groups in society can criminalize the actions of another group by using their influence on legislators. The consensus of these boundaries promotes self restraint and discipline within society. Durkheim theorised that the basis of social order was the shared belief in norms and values. The absence of social order would result in anomie.
Social deviancy is the violation of social norms. A deviant is someone who rejects folkways and mores. Any action that violates the values or rules of a social group is deviant behavior. In order to actually be characterized as a deviant, the individual must be detected committing a deviant act and be stigmatized by society. A stigma is a mark of social disgrace, setting the deviant apart from the group. Criminality is healthy for society. Deviance affirms our cultural values and norms. Responding to deviance clarifies moral boundaries and brings people together. There will always be people who break society’s rules and that’s important.

Emile Durkheim (1901) argued that although definitions of what constitutes deviance vary by place, it is present in all societies. He defined deviance as acts that offend collective norms and expectations. Durkheim believed that what makes an act or appearance deviant is not so much its character or consequences, but that a group has defined it as dangerous or threatening to its well-being (Ferrante, 134).
Deviant behavior is sociologically defined as, when someone departs from the “norms”. Most of the time when someone says deviance they think against the law or acting out in a negative behavior. To sociologists it can be both positive and negative. While most crimes are deviant, they are not always. Norms can be classified into two categories, mores and folkways. Mores are informal rules that are not written; when mores are broken, they can have serious punishments and sanctions. Folkways are informal rules that are just expected to be followed, but have no real repercussions.
There exists conflicting theories among sociologists in the area of determining why a person is considered to be a deviant, and the reasons behind why he or she has committed a deviant act. From a positivistic perspective, deviance is based on biological or social determinism. Alternatively, from a constructionist perspective, deviance is created and assigned by society. Both perspectives seek to give a theory for why a person may become known as deviant. Although they both view similar acts as deviant, the basic differences between positivists and constructionists theories are clear.
In the world we live in today, deviance happens to play an integral role in within the societies that scatter our globe, whether we like it or not. Deviance describes actions or behaviors that violate the social norms of our society. These behaviors can violate formally enacted rules, such as laws that are put into place by government, as well as the informal type of “guidelines” that various cultures have informally established and shaped for themselves. As one may come to understand, norms are essentially expectations that are standard to a certain culture. These norms gently guide people in a society in “what to do,” and “what not to do,” in compliance with their societies' norms. With this said, it is important to keep in mind that social norms differ from culture to culture. One act that may be considered deviant in a particular society, may be generally accepted in another. Three main sociological theories of deviance include the cultural transmission theory (also known as the differential association theory), the labeling theory, and the control theory.
Sociologists understand the concept of deviance in a variety of ways. It is the result of unsuccessful socialization, the solutions are usually intended to change the mind of the individual, and that order needs to remain maintained. Norms determine whether something is deviant or normal. So deviance depends on the social status and power of the person, the social context in which the behavior occurs, and the historical place it takes place in. Deviance is all about violating the day to day norms and is usually considered to be wrong, bad, or immoral.

He believes that that the state maintains the capitalist order through the creation of laws. The state exists to serve the interests of the capitalist working class. The criminal law is merely an instrument of that class to perpetuate the current social and economic order and is used to repress those who are less powerful.

Within this group was a highly influential young man, Howard S.Becker who became the person most recognised for his work with the labelling of crime (Williams.F. McShaneM. 2010.p110). The bulk of deviant behavior will be looked as discontentment from those in society or even punishment from the system. Deviance can fall into many classifications such as addictions and delinquency. We will look at deviance and about how and why people are deviant. Some theories support the idea of deviance being biological while others refute this and believe the idea of it being caused by your social construction.

Some sociologists would explain deviance by accepting without question definitions of deviance and concerning themselves with primary aetiology. However, labelling theorists stress the point of seeing deviance from the viewpoint of the deviant individual. They claim that when a person becomes known as a deviant, and is ascribed deviant behaviour patterns, it is as much, if not more, to do with the way they have been stigmatized, then the deviant act they are said to have committed. In addition, Howard S. Becker (1963), one of the earlier interaction theorists, claimed that, "social groups create deviance by making the rules whose infraction constitute deviance, and by applying those rules to particular people and labelling them as outsiders". Furthermore, the labelling theoretical approach to deviance concentrates on the social reaction to deviance committed by individuals, as well as, the interaction processes leading up to the labelling.
Labelling theory was acknowledged and more commonly known during 1960’s yet towards the 1980’s it was seen as less supportive and was being critiqued by other scholars and theorists. One of the reasons to why labelling theory was becoming less supported and critiqued more frequently was due to lack of research being conducted in the field, however in recent years there has been an increased interest in labelling theory and its perspectives (Lopes and Krohn et al., 2012, pp. 457-458).
