Ethical Dilemma in Counseling: A Case Study

This writer did an interview with a supervisor from Consejo Counseling and Referral Services. For confidentiality, the supervisor will be called Olive throughout the paper. Olive has been doing counseling for eleven years. During the interview, Olive shared with this writer an ethical dilemma that she experienced while working at Consejo. The client with which Olive faced the ethical dilemma will be called Popeye. Popeye is a Mexican adult male. Popeye is an illegal immigrant who came to the United States a couple of years ago. While living in the United States, Popeye was physically assaulted in one occasion. During the assault, Popeye had a head injury. This head injury affected Popeye’s ability to retain memories. Olive’s treatment was not providing beneficence to Popeye. Beneficence is to do good for others and promoting the well-being of clients (Corey et al., 2011, p. 18). In regards of allowing Popeye to authorize the release of information, this writer believes that Popeye could have been allowed to authorize the sharing of confidential information with his lawyer. Sharing confidential information with his lawyer would have helped Popeye to get his U-Visa. Popeye gaining his U-Visa was for the beneficence of Popeye. Beneficence is the moral principle that therapist have to act to help and advocate for their clients’ well-being (Corey et al., 2011, p. 18). Not helping Popeye to get his visa was not beneficial for the client. Based on the ACA ethical code B.2.e. Minimal Disclosure, the therapist could have shared only essential information with the lawyer without needing a release of information form to be signed.
In regards of referring Popeye out, this writer believes that Olive made a good decision. However, Olive should have not ended services with Popeye. Olive could have helped Popeye with her expertise to overcome his trauma. The therapist that works with brain injury might not focus on the trauma, but rather on the injury. Thus, Olive could have built an alliance to coordinate care for Popeye. Coordinating care with the brain injury specialist can be the most beneficial treatment for Popeye because he would
