Yes, I feel as though it would be, because it sets up specific disciplines for the individuals that work there giving them an insight as to what rules and regulations that the organization expects from all their workers. Behaving ethically is at the heart of what it means to be a professional; it distinguishes professionals from others in the marketplace. Although, at times these professional standards cannot always be enforced there for healthcare organizations have put in place what is known as Healthcare Organizational Ombuds. This way it supports a patient’s safety by creating a channel through which employees at all levels can discuss problems that involve issues such as medical errors and maintain self-determination in how to address
these issues (Patterson, L.M.,2012). Having this system put in place within one’s organization allows workers to surface and report medical errors to find ways to alleviate the systematic weaknesses that promote them, because the workers can maintain viability which is rare (Patterson, L.M.,2012). If there is a possibility that they are not adhering to the standards that they are given I feel as though every supervisor within those specific departments should make it a point to drop in without notice and ask patients how they are being treated by the workers and if they have any concerns.
Today, there are so many legal dilemmas dominating trial for the courts to make a sound legal decision on whose right in a complicated situation. Despite the outcome of the case, the disagreement usually has a profound effect on the healthcare organization, and the industry as a whole. Many cases are arguments centered around if the issue is a legal or moral principle. Regardless what the situation maybe, the final decision is left to the courts to differentiate between the legality issues at hand opposed to justifying a case based on moral rules. According to Pozgar (2012), an ethical dilemma arises in situations where a choice must be made between unpleasant alternative. It can occur whenever a choice involves giving up something good and suffering something bad, no matter what course of action is taken (p. 367). In this paper, I will discuss cases that arose in the healthcare industry that have been tried and brought to justice by the United States court system.
My job is to also ensure that the patient is aware of our HIPAA policies and that we are dedicated to protecting their records from any hackers or someone calling on the phone hoping to get any information. Not only do health care providers have an ethical implication to care for patients, they also have a legal obligation and responsibility to care for the patient. According to the Collins English dictionary, a duty of care is ‘the legal obligation to safeguard others from harm while they are in your care, using your services or exposed to your activities’. The legal definition takes it further by making it a requirement that a person act towards others and the public with watchfulness, attention, caution and prudence which a reasonable person in the circumstances would use. If a person’s actions fail to meet the required standard, then the acts are considered negligent (Hill and Hill, 2002). If a professional fails to abide to the standard of practice for their practice in regards to their peers, they leave themselves open to criticisms or claims of breach of duty of care, and possibly negligence. Negligence is comprised of five elements: (1) duty, (2) breach, (3) cause in fact, (4) proximate cause, and (5) harm. Duty is defined as the implied duty to care/provide service, breach is the lack thereof, cause in fact must be proven by plaintiff, proximate cause means that only the harm caused directly causative to the breach itself and not additional causation, and harm is the specific injury resultant from the breach.
Why is it so important that healthcare executives adhere to a professional code of ethics?
These types of external influences keep the healthcare organization afloat and maintained for patient care. The staff such as assistants, nurses, physicians, specialists, clinicians, and managers, states their opinions for improvement and make proper judgement for patient care. Lastly, patients are a prime influence and critic of healthcare of negative aspects or positive aspects of doctor care and treatment. Conflicts of staff shortages, incorrect coding/ billing, incompetent staff, and lack of knowledge of ethics are always an issue to improve. As long ethical procedures are in effect at all times with OSHA, ACA, HIPAA, JCAHO, etc., then the healthcare facility is in good order. The Affordable Care Act is a law for all staff and managers to stay informed and know how the changes apply to patients. At times these organizations may seem like a nuisance, but as a patient and an employee in the healthcare field I feel safer knowing that such organization exist, given that I have worked both in the private and public sector, there have been things that should not have happened. The key on ensuring policies are followed is awareness, communication, and continuous education. By having procedures in place for all departments this will help elevate and ensure no infractions are given by OSHA and JCAHO in the Healthcare facility.
