The term criminal desistance refers to when offenders desist, or stop, committing crime. Desistance from crime exists when an individual has an absence of criminal behavior in their lives for a sustained period of time. By studying desistance, a better understanding of what causes individuals to commit crime is created; as well as, a better understanding as to why certain individuals discontinue their lives of crime. The criminal justice field often encompasses, serving justice by locking people up and keeping the “bad guys” away from the general public. Little thought was given as to what can be done in order to help prevent people from committing crime, until more recent years. The reasons as to why individuals desist from crime can range from genetic, environmental, social, or psychophysiological. One belief focuses on the idea that criminals desist from crime through pro-social development and a worthwhile career path. In a study conducted by Aresti, Eatough and Gordon (2010), five ex-offenders participated in interviews about their lives as offenders, and their new found lives as productive members of society. Results show that four major themes emerged from the five men. First “being stuck” in their offending ways, second “defining moments” or moments of self-change, third “life in transition” or moments in the self-change process, and fourth “a new world” which encompasses the men’s new and reformed lives. The men in the study each had defining moments, typically the realization that they were going to be locked up for many years or losing out on time of their lives acted as this defining moment. While this may help adults desist from crime, it may not be as effective in helping juveniles. Most delinquency occurs during young adulthood and then the individual ages out of crime. When looking at juvenile desistance other explanations exist as to why some juveniles continue a life of crime and others desist. One idea places responsibility on the ability to make conscious decisions. A study, by Haigh, of desistance among juveniles and their transitional period to a law abiding life suggest that most juvenile offenders simply make the decision to stop committing crime. Haigh conducted the study using one on one interviews in order to capture the former offender’s interpretation as to why they stopped committing crime. Through the interviews she found that most juveniles held this preconceived idea that they had to commit crime based on where they lived. Crime was a part of a regular daily routine for many. Participants state things such as, “you have to do crime, if you don’t you get stomped on” or “we didn’t think it as dangerous, we got off on the buzz of doing it” (Haigh, 2009). Some did not have reasons as to why they made the decision to stop committing crime. Others stated that they wanted to stop committing crime because of new found relationships, making their parents happy, or from fear of being sent to jail. In Chapters six and seven of Shared Beginnings, Divergent Lives by John Laub and Robert Sampson, the lives of numerous men are shared and analyzed. The authors use life history interviews as well as crime history to help explain their theory. They interviewed these men various times throughout their lives, from a very young age up until age seventy. In Chapter six, Laub and Sampson mention the lives of a few men who have turned to desistance, or stopping, in committing crime. There were two subgroups, “nonviolent desisters” and “violent desisters”. These men had tough upbringings, living in deteriorated homes in Boston. Their parents were not supportive and showed little interest in parenting. Throughout the chapter, the men mentioned various turning points that occurred in their lives in which turned them to becoming desistant to crime. The Glueck’s analyzed and interviewed three men. Leon, Henry, and Bruno were the men. Leon’s turning point for his desistance was his marriage. Henry’s turning point stemmed from his decision to enlist in the Marine Corps when he was eighteen. And for Bruno, he said that his turning point was attending The Lyman School for Boys. In today’s society, many people commit crimes and illegal behavior is nothing new. Society knows that there are criminals and they have criminal intentions. The question today is not if people are going to commit crimes, it is finding the most effective method to help those criminals reenter society as productive citizens, and preventing new people from becoming criminals. Department of corrections around the nation have implemented a program that identifies the most effective method. The “what works” movement outlines four general principles that are implemented in the rehabilitation of criminals; and, these principles are risk principle, criminogenic need principle, treatment principle, and fidelity principle.
As some criminologists have debated, the methods and approaches to crime control have failed miserably. They are of the opinion that the criminal justice system fails in achieving its aims in rehabilitating criminal offenders. For example, a report made in the U.K claimed that 58 per cent of the prisoners released in 1997 were convicted of another crime (SEU, 2000). Some argue that it seems for the criminal justice system there is only one answer to crime control, a prison sentence. Nevertheless, some question how accurate this method is for some crimes in society. That is to say, that for certain crimes, taking the consumption of marijuana as an example, a prison sentence is not the solution, rehabilitating individuals should be the main priority and in certain cases if not the only
The goals of juvenile corrections are too deter, rehabilitate and reintegrate, prevent, punish and reattribute, as well as isolate and control youth offenders and offenses. Each different goal comes with its own challenges. The goal of deterrence has its limits; because rules and former sanctions, as well anti-criminal modeling and reinforcement are met with young rebellious minds. Traditional counseling and diversion which are integral aspects of community corrections can sometimes be ineffective, and studies have shown that sometimes a natural self intervention can take place as the youth grows older; resulting in the youth outgrowing delinquency.

The criminal justice system has come under fire over the last couple years over the handling of many incidents involving police officers use of force and the lack of punishments being handed down to them. Police officers play a vital role in ensuring law and order is maintained in the communities they are protecting and serving against any crimes and to help during natural disasters. This paper will explore how the criminal justice system is viewed in the eyes of a police officers and the thoughts on everything that has been ongoing.
Literature Review Introduction Recidivism refers to the tendency of reversion to criminal activities of the released inmates. It is measured by the frequency with which released offenders return to incarceration for new crimes. The rates reflect the effectiveness of instituted programs that focus on integrating the released offenders into the society (Schmallager, 2007). When the rates are healthy, it means that the programs in place are doing well in helping the offender restrain from criminal activities. The importance of correctional programs cannot be downplayed for any reason.
The old way is comprised of the expression, permission, and the triggers of violence. To get from the first phase to the second, there will be many catalysts for change. These catalysts are triggers or anything that can assist the process in moving forward to change and desistance. These can be consequences for one’s violence such as the involvement of the criminal justice system, emotional responses, or fearful reactions. Is there a way for offenders to be rehabilitated? A scientific study by psychologist, known as the principles of effective intervention program used an opportunity to evaluate why the program either worked, or did not work to rehabilitate inmates. The common goal was to find an effective intervention program that would share common features and would likewise rehabilitate criminals. These intermediations used four principles programs for offenders. The risk principle acquires that a quarry should be put on inmates that are a high risk.
The report shows that the recidivism rate of men was 37.6 % compared to 60% of earlier studies and slightly down from 2007 with a 38.3 % recidivism. Studies also show that 3 out of every 10 inmates will return to prison within four years of their release, and the first year of release is the inmate’s most crucial. Nearly two thirds of all recidivism occur within the first year of release. Though the recidivism rate is still high, with this percentage on a downward trend, it does appear that deterrence and rehabilitation have some impact on recidivism. Additional research conducted by sociologist Ben Crouch shows that deterrence is ineffective for offenders who view two or three-year prison sentences easier than probation and is preferred over probation.
The United States of America’s criminal justice system is defined as the system of law enforcement that is directly involved in apprehending, prosecuting, defending, sentencing, and punishing those who are suspected or convicted of a criminal offense. And while nothing is perfect, the goal of this system is to make sure every citizen is treated fairly and that justice is served. Over the years the United States has made a lot of changes to the way their law enforcement handles certain situations and offenses. These changes have come from learning experiences. For example the Miranda vs. Arizona case taught us that every person, guilty or not, needs to be read their rights before taken into custody because it is fair. A more modern topic that has constantly been changing the way our government and criminal justice system operates, is terrorism. Juvenile delinquency is one of the major social issues in the United States today. Juvenile delinquency, also known as juvenile offending, is when “a violation of the law committed by a juvenile and not punishable by death or life imprisonment” (Merriam-webster.com). Although we have one justice system in America, the juvenile system differs from the adult juvenile system. Most juvenile delinquents range from as low as the age of seven to the age of seventeen. Once the delinquent or anyone turns the age of eighteen, they are considered an adult. Therefore, they are tried as an adult, in the justice system. There are many different reasons why a child would commit crime, such as mental and physical factors, home conditions, neighborhood environment and school conditions. In addition, there are a variety of effects that juvenile justice systems can either bad effects or good effects. Finally there are many different solutions that can reduce juvenile delinquency. As a result, juvenile delinquency is a major issue and the likeliness of it can be reduced. In order to reduce juvenile delinquency there has to be an understanding of the causes and the effects.
