This is a controversial subject. I actually agree and disagree with the right to check an applicants’ background, it depends on the type of background check being done and for what position. Background checks can consist of medical, criminal and credit (EEOC, n.d.). I do believe there are certain positions when a criminal background check should be performed. For positions such as CEO, anything concerning finances, and police officer/ SPO (special police officer) just to name a few. However, I do not agree that a credit check should be used in all cases. Times are certainly hard today and people are losing their jobs and are unable to pay their bills. This can cause a persons’ credit report to plummet and have derogatory information on their At the first stage before an offer of employment, a company may not ask any disability-related questions or require any medical examinations, even if they are related to the job. The second stage is after a conditional job offer, but before he/she begins work. During this time an employer may ask disability-related questions and conduct medical examinations, regardless of whether they are related to the job, as long as it does so for all entering employees in the identical job type. Stage three is after employment commences, an employer may make disability-related inquiries and also require medical examinations however, it has to be job-related and consistent with business necessity(Questions and Answers, n.d.). When it comes to medical background checks, there are some instances where I feel this is necessary such as in the medical field. I am also opposed to medical background checks for personal reasons. I Have Lupus, if my future employer sees that I have Lupus it might keep me from getting the position. Employers will see my disease and automatically feel I will be taking a lot of time off work and I couldn’t perform my job. What my medical background wouldn’t show are certain things like when was my last flare-up, how long did it last and what
A background check is generally a further investigation on one 's criminal and financial records. Background check requirements vary depending on their purpose. Specifically, the National Instant Criminal Background Check System is a United States system
In the area of Background Investigations the FBI manages checks on anyone who applies for positions with the Department of Energy, Nuclear Regulatory Commission, the Department of Justice, and the FBI its self. Doing so ...
The medical physicals were being conducted as a direct result of the employees complaining of possible carpel tunnel syndrome (CTS) from the repeated work they were doing in conjunction with their jobs or occupations. There ailments weren’t from prior medical problems like the company was secretly trying to uncover. These complaints hailed from the worker’s after many years of working. The repeated pressure and motion endured in their wrists, while working their specific occupation, has caused many of them pain and undue suffering over the years.
Some of the disabilities included are vision, hearing, motion, or mental impairments. "Title I of the Americans With Disabilities Act prohibits employers from discriminating against qualified individuals with disabilities in job application procedures, hi...
I am an awful human being. I am a disgrace to my family. My friends are embarrassed of me. I am gross. I am judged, and will be until I am deemed ‘safe’ by my supervisors. People are afraid of me. I am not welcome anywhere. I am disgusting. I don’t deserve to be treated as a normal person, but as a leper. I should be ashamed of myself, or at least that is what I’m told. I am a registered sex offender.
In the case of “Leonel v. American Airlines, Inc. (AA), 400 F.3d 702 (9th Cir.2005)” (Melvin, 2013), on page 351 of The Legal Environment of Business: a Managerial Approach: Theory to Practice, “Leonel and two other applicants were given conditional offers of employment by American Airlines.” (Melvin, 2013); these offers were dependent on whether a background check and medical exam were passed. However, before the background checks could be conducted American Airlines directed Leonel and the other applicants to go to their facility and take medical exams and a health questionnaire. “Leonel and the other applicants were HIV-positive” (Melvin, 2013) and failed to divulge this on their questionnaires. The applicants’ tests came back HIV positive and resulted in AA retracting their offer. This leads “Leonel and
I believe that the background/character investigation is a very necessary procedure to be included in the hiring process. I would not want anyone with a shady or checkered past to be “protecting and serving” me and my neighbors. This process is very well laid out and if it is followed to its said specifications, it would seem to be a great tool of aid in both the background investigation and hiring process.
At the time of interview give a brief introduction of yourself as well as company, give time for answering questions and after interview summarize the things.

It may be true that if the applicants have a red flag in their credit report, there is a possibility that applicants would accept bribes or sell confidential information about the workplace and their financial issues could lead to peculation. Wendy Powell, author of “Management Experience Acquired” says that employers are constantly reviewing credit histories, for example, like jobs from the bank, brokerage houses, and other financial institutions. It is applied to accounting or anything related to managing money since there is possible frauding or embezzlement (Farrell 2010). The proponents also say that the credit report information is excellent when comparing two employees for one position. If an applicant has a significantly high debt or bad credit, it could distract them from fulfilling their job properly, and it would be information that should be taken into consideration (Farrell 2010). It may not be true because not everyone has bad debt also be tempted to compromise their honor and career. Since they are trying to find a good job and make money to cover their costs and debt. They are educated and realize that having a good job is really meaningful for those who have experienced unemployment
In society, most people will work for many different reasons. Some will work based on the needs of money to survive, some require money to feed their love ones, and some just need money for their own leisure. In life, most people work just to stay busy, and even work until it’s time for them to retire. When applying for a job, the employer will ask for a résumé or a job application. When the information is given, it contains a work history which is a detailed report of all the jobs that a person has held, including company name, job title, and dates of employment. Companies typically required that applicants must provide their work history when applying for a job. A person’s work history is used by prospective employers to verify the information that a person has provided and to be contacted by pervious employers for background checks.
In criminal justice, certain requirements must be met so that the defendant can be held accountable for the crime committed. Mental illness can be a very major reason for committing a crime, and when someone who is mentally unhealthy becomes a criminal the case is much more complex than with an average person. There are many cases where a defendant is deemed mentally unstable and thus are not considered entirely responsible for their actions. In cases where sanity is at question the court must determine a few things for the accused to be held wholly accountable, the defendant must have committed the crime in a clear state of mind, that they were mentally healthy at the time of the crime, that they had intent to carry the crime out, and they
