Introduction
The mechanism of human memory recall is neither a parallel nor a sequential retrieval of previously learned events. Instead, it is a complex system that has elements of both sequential and parallel modalities, engaging all of the sensory faculties of the individual. On an everyday level, issues about memory and recall affect everyone. It has a bearing on ramifications from the trivial to matters of life and death. Thus, a particular student might worry about his or her ability to remember 'memorized' material, a person might worry about losing his or her mind, and, there are the more troubling issue of diseases affecting memory such as Alzheimer's disease. According to Tulving, episodic memory represents only a small part of the much larger domain of memory (Tulving, 1992, p.1). Specifically, episodic memory is the process involved in remembering past events. This paper is a review of research findings on episodic memory with specific attention to episodic memory in adults and infants.
Episodic Memory in Adults
In society, it is quite common for people in their golden years or even well before that, to worry about losing their memory. There is scientific evidence to support this notion of degradation of memory with age. It is now well known in neurology that brain cells die off as one ages. Verhaeghen and Marcoen (1993, pp. 172-178) found that the decline associated with age in relation to the ability to perform episodic memory tasks involving deliberate recall appears to be largely a quantitative rather than a qualitative phenomenon. The ability of older adults to recall individual items in lists, or ideas in texts could be predicted based on the performance by younger adults on the same tasks. From their data in a sample of 48 younger and 45 older adults, they postulated a relationship between recall and age with a median correlation of r = .88. The same item characteristics could be used to predict probability of recall by younger or older adults.
Kliegl and Lindenberger (1993, pp. 617-637) tested a model for correct recall and intrusions in cued recall of word lists. Intrusions are defined as false responses that were correct in an earlier list. The model assumes three exclusive states for memory traces after encoding; 1) with a list tag-with information about list origin, 2) without list tags, and 3) missing. Across lists, a trace can lose its list tag or it's content.

In the United States, jury trials are an important part of our court system. We rely heavily on the jury to decide the fate of the accused. We don’t give a second thought to having a jury trial now, but they were not always the ‘norm’.
Human memory is flexible and prone to suggestion. “Human memory, while remarkable in many ways, does not operate like a video camera” (Walker, 2013). In fact, human memory is quite the opposite of a video camera; it can be greatly influenced and even often distorted by interactions with its surroundings (Walker, 2013). Memory is separated into three different phases. The first phase is acquisition, which is when information is first entered into memory or the perception of an event (Samaha, 2011). The next phase is retention. Retention is the process of storing information during the period of time between the event and the recollection of a piece of information from that event (Samaha, 2011). The last stage is retrieval. Retrieval is recalling stored information about an event with the purpose of making an identification of a person in that event (Samaha, 2011).
A jury is a panel of citizens, selected randomly from the electoral role, whose job it is to determine guilt or innocence based on the evidence presented. The Jury Act 1977 (NSW) stipulates the purpose of juries and some of the legal aspects, such as verdicts and the right of the defence and prosecution to challenge jurors. The jury system is able to reflect the moral and ethical standards of society as members of the community ultimately decide whether the person is guilty or innocent. The creation of the Jury Amendment Act 2006 (NSW) enabled the criminal trial process to better represent the standards of society as it allowed majority verdicts of 11-1 or 10-2, which also allowed the courts to be more resource efficient. Majority verdicts still ensure that a just outcome is reached as they are only used if there is a hung jury and there has been considerable deliberation. However, the role of the media is often criticized in relation to ensuring that the jurors remain unbiased as highlighted in the media article “Independent Juries” (SMH, 2001), and the wide reporting of R v Gittany 2013 supports the arguments raised in the media article. Hence, the jury system is moderately effective in reflecting the moral and ethical standards of society, as it resource efficient and achieves just outcomes, but the influence of the media reduces the effectiveness.
There is no way to measure how everyday people of the jury compartmentalize the information given to them. By disregarding information, does it work in favor of justice or does it highlight a forbidden topic. Using a jury trial and the disregarding of evidence played a key role in the OJ Simpson case that began in 1994 (Jasanoff: 714). Just after a year of his acquittal of the first case, he became the defendant of a civil suit placed by the relatives of the victims. When asking juries to disregard statements and evidence can change their decision-making abilities, especially if the evidence directly links the alleged criminal to the crime as it did arguably in OJ Simpson’s case. During this trial, the defense tried to highlight and find errors in the Los Angeles Police Department’s procedures for collective and transporting evidence (Jasanoff: 715). The evidence, which was once connected to the trial, was now inspected to establish both its validity and reliability. The outside influence of the evidence played a role in the decision, which included the credentials of the lab and their procedures. Trial by Jury was first introduced during the reign of King Henry II as a mechanism to uncover the King’s rights, but it wasn’t until King Henry III that the jury was molded into a body of witnesses to call on their knowledge. Presently, our jury system is a body of witnesses that determine the guilt or innocence grounded upon a presentation of facts and evidence. The current structure of trial by jury is not sufficiently democratic. Jury panels are not selected democratically, but instead are chosen through a process call “voir dire” where attorneys and the judge ask a series of questions to establish the “impartiality” of the potential juror. This aspect of jury selection rejects the democratic notion that everyone is equally qualified to rule. The unanimity of the verdict is another key component of trial by juries that is not appropriately democratic because it forces people to fall under the coercion of others. This feature discards the fundamentals of democratic rule, which is a majority rule. These aspects of trial by jury do not ensure the effectiveness of a trial and actually hinder the possibility for a fair verdict. With the increasing number of trials all over the United States, reform of these components are necessary to guarantee the just and democratic ruling of trials.

However, despite colonial influence, judicial systems across the world have taken their own way. In this essay I will be discussing the role of the jury system and how some believe the jury is one of the most important institutions in ensuring that Australia has an effective legal system, while others disagree. Our current trial by jury system was originally adopted from Anglo-Saxon English common law. Prior to juries, the United States had much more rudimentary methods that were in affect, such as bench trials. A bench trial consists of solely the judge determining the final verdict, versus a jury possessing that responsibility. Proceeding with a trial by jury assures that there will be a margin of error, simply due to the fact that the jurors are human, and are susceptible to human fallibility. Whether the jury is cognizant of it or not, emotions such as pre-determined bias and favoritism can impede or bring the case to a halt all together. According to Andy Leipold, a professor emeritus at the University of Illinois College of Law, the number of jury trial conviction rates have increased from 75 percent in 1946 to 84 percent from 1989 to 2002 (Krause). This sudden anomaly can be attributed to the influx of uneducated jurors, the increased cost of proceeding to trial, and improper juror selection.
Long-drawn out trials that go on for years cause psychological stress, tension in the family of those involved in the case, and these trials make a huge dent in the money supply of the court system in the government. Each day members of the jury have to be accounted for and must receive money for their services. Using a judge is both cost-effective and smart. Memory is the tool we use to learn and think. We all use memory in our everyday lives. Memory is the mental faculty of retaining and recalling past experiences. We all reassure ourselves that our memories are accurate and precise. Many people believe that they would be able to remember anything from the event and the different features of the situation. Yet, people don’t realize the fact that the more you think about a situation the more likely the story will change. Our memories are not a camcorder or a camera. Our memory tends to be very selective and reconstructive.
This study tested whether or not the common deficit of the elderly’s ability to use episodic memory to recall past events extends to their ability to use episodic memory to predict future events. Both instances of recalling and predicting use a common neural pathway. The experimenters tested sixteen younger adults with a mean age of 25 and sixteen older adults with a mean age of 72. Each individual was given a noun and told to recall a memory or imagine an event relating to that noun. They were also told to tell the story from a particular perspective—vantage point or field perspective. After 3 minutes, the individuals had to stop and were rated on the detail, emotion, and personal significance of their account. Each individual went through 8 trials.
