Colossal Corporation’s White Arch Casino (WAC) has suffered a minor setback, a promise was made by WAC manager, Sam Pending to dealer, Enoch Thompson. Thompson, the dealer has been with the company for several years and is a highly skillful dealer was a valuable asset to the corporation. He was recently offered a new position with the Venetian Flamingo Casino by the manager herself, Shirley Eugest. It was discovered that Shirley Eugest offered Thompson a substantial increase in salary to leave WAC and begin employment with the Venetian Flamingo Casino. Word of this offer quickly spread amongst WAC staff, eventually reaching the desk of WAC manager, Sam Pending. Thompson proceeded to decline the offer made by Venetian Flamingo Casino manager, Shirley Eugest. Soon after, Thompson was fired from WAC under the claim of corporate downsizing. I have investigated all aspects of this case with the purpose of determining whether or not Sam Pending’s promise is legally enforceable and ethically enforceable; along with what actions could be taken by Enoch Thompson and the implications on the corporation if he decided to try and enforce the promise. Finally, what actions Colossal Corporation should take in order to resolve this current case and in order to prevent another incident such as this to occur again. This investigation determined if the promise made by Pending is considered a legal contract, what rules and regulations a Nevada business has to comply with both legally and ethically, and if Pending’s action were legally and ethically correct.
