I feel that banishment has failed Cole. This is due to the facts that the banishment was not overwatched to ensure success, and also the fact that Cole didn’t get the procedure of punishment to be dealt properly. Also the circle had put too much trust in Cole causing for his punishment to be poorly executed, and for his bad decisions to not be controlled. The banishment process was just done all wrong, it left too many possibilities of failure in its wake. This lead to the ultimate punishment of all, getting mauled by a bear.
Clearly you saw the reason for Cole’s actions, being beat by his father and being ignored by both his parents. I still think Cole is responsible for his own actions because he could chose to be good and get attention, but he chose bad to get attention. But his parents definitely had at least a small part in the way Cole acts now, if they were more loving to him and actually knew how to discipline him the right way, like you're grounded for three weeks with no television or something instead of being him, maybe that would teach him a lesson. I mean I get that people are busy and they have work and everything, but you should always make time for your kids and your family. “‘Yes, Mr. Matthews, this is about responsibility. By the way, when is your son’s birthday?’ Cole’s father gulped a quick breath, and his face grew flushed. ‘Uh, well… birthdays have never been a very big thing around our house,’ he stammered. “I think it’s the beginning of July sometime.’” (pg. 52, Touching Spirit Bear) This just proves how badly Cole is treated at home. Obviously his dad drinks so much that he can’t remember the small, but important things. I’m pretty sure that every parent should at least know their kids birthday, even if they don’t love them 100%, which I find absolutely heart shattering. I also feel like destiny or fate had
The definition of an intermediate sanction is the criminal punishment between the act of imprisonment and the application of probation. This scenario and circumstances that one of these sanctions would be administered depends on multiple variables. These can be based on aggravating and mitigating circumstances, jury, and unfortunately racial and gender circumstances. Three major intermediate sanctions to take closer look at are pretrial diversion programs, fines, and community service.
Continuum sanctions is a new innovated system that allows judges to use more discretion when dictating the punishment or treatment of a juvenile based on how serious the offense is that the juvenile has committed (Bartollas, 2014, p. 388). In continuum sanctions judges can also decrease or increase the severity of the punishment or treatment given depending on how well the behavior of the juvenile is improving during the treatment, judges can rely on intermediate sanctions that are less intrusive if the juvenile is making good progress or more intrusive intermediate sanctions if the current treatment is not helping the juvenile (Bartollas, 2014, p. 388).
Statement of the Problem What is prisoner reentry? It is a term we use in society, to refer to the issues of transporting ex-offenders from incarceration to a community, while specifically involving the offender in programs that will promote them back into the communities and out of the criminal justice system. Upon reentering society, former offenders are likely to struggle with substance abuse, lack of adequate education, job skills, limited housing options, and mental health issues. Profile of Inmates In the county of Orangeburg, we have inmates that are in our system that will soon be out and about in our communities, trying to make a living like the rest of society. Men, women and juveniles being held in the Orangeburg-Calhoun Reg.
Inmate Chouch, I spoke to Officer Houston about this incident and she stated that she ordered the housing unit to lockdown for meal distribution at about 1700 hours. She then began to pull a group of inmates for chapel which left the housing unit at 1713 hours. I watched video recordings for Durango 8 from 1713 hours to 1733 hours, I observed multiple inmates standing beside there bunks, walking from one bunk to another, inmates attempting to use the phones, inmates attempting to shower, and inmates waking up and down the rows without there MCSO issued orange shirt on. I also observed Officer Houston walking up and down the rows ordering inmates to get lockdown, which in a dorm style housing unit is sitting on your assigned bunk, NOT beside
The Kelly Criterion or sometimes called a Kelly bet is a formula used to decide the optimal sized stake of the bank to bet on a certain outcome. The way the Kelly Criterion works is that if one believes to have an edge over the bookmakers odds for a certain outcome one applies the kelly formula to calculate how much of their bank to stake and then do this for a series of bets resulting in a profit. Many argue the Kelly strategy is the strongest strategy among all betting strategies in the long term. The Kelly Criterion was designed in 1956 cite{kelly}, originally used to bet on an event where the probability of the winning and losing are the same and could be repeated again and again like a biased coin toss. Similar to the Kelly criterion,
The resources devoted to Cole’s paid promotion and advertising must achieve three critical goals. First, promotional material must make “Joshua Cole” a known name before the General Election. Second, promotional material should convey political ideology and platform. Third, promotional material must inform voters of the General Election and encourage voters to participate in the election.
Explain why you believe or don’t believe that exceptions to the Exclusionary Rule should be made.
In “Offender Reentry”, David Allender, dives into how recidivism effects both the criminals and the community. To begin with Allender expressing how the Philadelphia Society for Alleviating the Miseries of Public Prisons (PSAMPP) started an attempt to ameliorate the public prisons to better rehabilitate the prisoners where the goal was not to punish its' offenders, but to move them toward spiritual reflection and change. Inmates were on a 23 hour lockdown and had limited communication with any other inmates or staff. The facility restricted reading materials to the Bible since majority of the criminals confided in it and used it show them the right path and make better choices. Consequently, this backfired and led to the first changes in sentences which resulted in a high relapse ratio; as a result, this led to higher strain on the taxpayer and the communities where the crime was committed.
To incorporate the sentencing goals of retribution, incapacitations and deterrence all sort of tie in with each other. Giving the individual five years sentence with minimum 3 years served. Retribution would be dealt with by giving the criminal jail time well deserved. By serving time in jail, incapacitation would be incorporated. It would definitely remove the convicted person from the community. Jail time would prove to be short term deterrence for the person to commit further crime for three to five years while serving time. Depending on the person’s experience in prison, it might deter him or her from committing any future crimes.
Punishment has been a vital feature of every developed legal system; widespread disagreement exists over the moral principles that can support its imposition. One vital question is why and whether the social institution of punishment is justified. Punishment is a debatable issue because it raises more general issues about the proper standards for assessing social practices. Punishment is considered to be an exclusive province of the law. Parents punish their children and unlike most concepts, punishment has no severe boundaries.
Intermediate sanctions are used a lot in a lot of scenarios like house arrest, remote location monitoring and Intensive Supervision Probation or parole. It is used for more punitive and restrictive monitoring. It could be used in the middle of court proceedings like if the court does not want to lose a suspect, that suspect could be in house arrest. The use of electronic monitoring is appealing due to lower jail/prison overcrowding, expensive to do but better results, and easier to do. Offenders are given intermediate sanctions under some form of probation supervision (Bayens and Smykla). Every state except New Hampshire has some form of electronic monitoring for juvenile defendants (Weisburd). Electronic monitoring is a tool that probation
1. What is the exclusionary rule? Discuss its history through several landmark U.S. Supreme Court cases.
The growing Western threat caused the Soviets to modify their military strategy. In the 1960s, the primary feature of their military doctrine and strategy was the assumption that future war against capitalism would be inevitable, and it would be nuclear war. During that time, the Soviet’s military doctrine and strategy, particularly the intentions and objectives, were the most important and perplexing issues confronting the coalition of the United States and NATO. As a socialist state, the Soviet Union viewed American capitalism as a threat to its socialist society and other parts of the globe. William T. Lee and Richard F. Starr argued that the Soviet military doctrine primary objective was to claim victory over American capitalism, and shift the global power in favor of socialism.
Probation is an alternative to the traditional forms of punishment that a court can impose, and is influenced by the background of the offender (Klingele 2013,1022). The origin of probation can be traced back to the actions of Matthew Davenport Hill, Frederick Rainer, and John Augustus. Although their contributions are similar, each contribution was significant in creating the basis for probation.
