I am a native Virginian and a graduate of the prestigious Marshall-Wythe School of Law at the College of William and Mary. After being admitted to the Bar in 1980, I clerked for the Judges of the Circuit Court in Fairfax County. I then opened my own private practice in Arlington before relocating to my hometown of Stafford, VA. Additionally, I accepted appointments from the Circuit Courts of Stafford and Spotsylvania to assist the Circuit Court in resolving domestic matters.

Divorce connects with the family stress theory where as stress plays a major role in the separation between the spouses and the relationships between the children. Individuals who go through a divorce can be very stressed out because it is known that divorce is one of the most stressful situations a family can go through where they have to worry and stress over a lot of stuff (Smith, 2009). When going through divorce families lose their spouses, parents, and confidante within their selves, as they are often the primary caregivers of their children. When going through the process of a divorce the family goes through a time where they have severe and mixed emotions which are made more difficult by the stresses and worries of legal and financial problems and also custody battles (Smith, 2009). Divorce has a major negative effect on the parents as well as they have to support and counsel their children who may be involved in the process and are suffering too. Families who are going through a divorce or a parental divorce if it is the spouses or the children are going to experience series of emotional stages due to the post-breakdown (Smith, 2009). Stress from divorce can lead from anger and depression to fear and frustration. Also, families who are coping and managing all the tasks associated with divorce can also lead to anxiety, panic, and depression. Divorces are easy to obtain in the United States but the decision needs to be carefully examined. According to statistics, “divorce makes sense in the 10 percent to 15 percent of troubled marriages that involve high-level and persistent conflict with severe abuse and physical violence” (Dafoe 1). In the other 85 to 90 percent of marriages, the marriage can and should be reconciled. Divorce that dreaded word that no married couple wants to hear. Its an issue that no one personally wants to experience first-hand. It can be a difficult or a smooth process depending on the mindset of both parties. It can be time consuming, expensive, stressful and can certainly get ugly. When a married couple is going through a divorce and there are no children it can be a great thing because the only ones that face the effects are the couple. However, when children are a part of the divorce process it can take a big toll on them and for the worst. Some couples think about their children and unfortunately others do not. There are certainly two sides to the issue and everyone has their own view, both expertise wise and personal.
Mediation is a form of the Alternative Dispute Resolution (ADR). Mediation is a process which it assists disputed parties to arrive to a mutually agreed resolution without going to court. As the out of court problem solving approach, mediation is a more convenient way for parties which trying to avoid the hassle and loving some flexibility from the more rigid court procedure. Mediation can be said as an informal process of which parties during this process is encouraged to work together among the disputed parties in good faith in order to solve their problems and disputes at a lower financial cost and it consume lesser time as opposed to the court procedure. Mediation recently has become more common as one of dispute resolution process especially for disputes which have relations to divorce matter, child custody or even for child visitation especially for its privacy and confidentiality.
