Most of the time it is the duty of the members of constituted authorities to inflict the punishment. Thus it can be said that almost all of the punishments are an act of self-defense and an act of defending the community against different types of offences. According to Professor Hart “the ultimate justification of any punishment is not that it is deterrent but that it is the emphatic denunciation by the community of a crime” (Hart P.65). Whenever the punishments are inflicted having rationale and humane factor in mind and not motivated by our punitive passions and pleasures then it can be justified otherwise it is nothing but a brutal act of terrorism. The United States has a larger percent of its population incarcerated than any other country. America is responsible for a quarter of the world’s inmates, and its incarceration rate is growing exponentially. The expense generated by these overcrowded prisons cost the country a substantial amount of money every year. While people are incarcerated for a number of reasons, the country’s prisons are focused on punishment rather than reform, and the result is a misguided system that fails to rehabilitate criminals or discourage crime. The ineffectiveness of the United States’ criminal justice system is caused by mass incarceration of non-violent offenders, racial profiling, and a high rate of recidivism.
Today, half of state prisoners are serving time for nonviolent crimes. Over half of federal prisoners are serving time for drug crimes. Mass incarceration seems to be extremely expensive and a waste of money. It is believed to be a massive failure. Increased punishments and jailing have been declining in effectiveness for more than thirty years. Violent crime rates fell by more than fifty percent between 1991 and 2013, while property crime declined by forty-six percent, according to FBI statistics. Yet between 1990 and 2009, the prison population in the U.S. more than doubled, jumping from 771,243 to over 1.6 million (Nadia Prupis, 2015). While jailing may have at first had a positive result on the crime rate, it has reached a point of being less and less worth all the effort. Income growth and an aging population each had a greater effect on the decline in national crime rates than jailing. There are better ways to punish criminals and protect society than mass incarceration. The state and local governments should be tough on crime, but “in ways that emphasize personal responsibility, promote rehabilitation and treatment, and allow for the provision of victim restitution where applicable” (Alec, 2014). The government also succeeds in overseeing punishment but fails to “…take into account the needs of offenders, victims, and their communities.” (Morris, 2002: Pg. 1 and 2). Alternatives to incarceration, such as sentencing circles, victim offender mediation, and family conferences, can successfully hold criminals responsible while allowing them a chance to get “back on their feet”. Introduction: Recidivism or, habitual relapses into crime, has time and time again proven to be an issue among delinquents, which thereby increases the overall juvenile prison population. This issue has become more prevalent than what we realize. Unless a unit for measuring a juvenile’s risk of recidivism is enacted and used to determine a system to promote effective prevention, than the juvenile prison population will continue to increase. Our court system should not only focus on punishing the said juvenile but also enforce a program or policy that will allow for prevention of recidivism. So the question remains, how can recidivism in the juvenile prison population be prevented so that it is no longer the central cause for increased juvenile delinquency? Simply put, we must create a means of measuring juvenile’s level of risk and in turn, form an effective rehabilitation program that will decrease their risk level for future recidivism.
We can all agree that an important goal of the American criminal justice system is rehabilitation. It expects that most, if not all, offenders to learn from his or her wrongdoing and become productive members of society (Ballenstedt, 2008). It is this thinking at the heart of a community-based initiative that is designed to bring law enforcement officials together to form a single concerted effort to identify and address patterns of crime, mitigate the underlying conditions that fuel crime, and engage the community as an active partner (Wolf, Prinicples of Problem-Solving Justice, 2007).
The “Tough on Crime” and “War on Drugs” policies of the 1970s – 1980s have caused an over populated prison system where incarceration is policy and assistance for prevention was placed on the back burner. As of 2005, a little fewer than 2,000 prisoners are being released every day. These individuals have not gone through treatment or been properly assisted in reentering society. This has caused individuals to reenter the prison system after only a year of being release and this problem will not go away, but will get worst if current thinking does not change. This change must be bigger than putting in place some under funded programs that do not provide support. As the current cost of incarceration is around $30,000 a year per inmate, change to the system/procedure must prevent recidivism and the current problem of over-crowed prisons.
Although it may not seem like a major problem to most people in the United States, prisons are becoming overcrowded, expensive to maintain and have little to no effect on the moral discipline of inmates. The current prison system is extremely inefficient and the purpose of prisons has been completely forgotten. Recidivism refers to the tendency of reversion to criminal activities of the released inmates. It is measured by the frequency with which released offenders return to incarceration for new crimes. The rates reflect on the effectiveness of instituted programs that focus on integrating the released offenders into the society (Schmalleger, 2007). When the rates are healthy, it means that the programs in place are doing well in helping the offender restrain from criminal activities. The importance of correctional programs cannot be downplayed for any reason. The programs whether in the prison or out are effective in saving the nation a huge amount in providing public safety and taxes (Pollock, 2004).
Reintegrating offenders into society is an important part of incarceration. Within the United States justice system, we are often more concerned with the punishment of the offender and neglect to assist them in reentering society. By developing programs that are different from the formal control agencies which offender’s encounter upon release, we can hopefully begin to see a decrease in offender recidivism across the United States. Since President Richard Nixon first announced the War on Drugs forty years ago, the United States has implemented tough on crime criminal justice policies that have given it the United States the distinction of having the highest incarceration rate in the world. Consequently, over the past forty years, criminal justice policymaking has been characterized by overcriminalization, increasingly harsh sentencing and parole regimes, mass incarceration of impoverished communities of color, and rapid prison building. These policies have also come at a great expense to taxpayers. But budget limitations are finally prompting states across the country to realize that less punitive approaches to criminal justice make more sense and also better protect our communities.
