Thomas Bender reminds us in his book A Nation Among Nations, to search for all of the information before we make a decision on the history we have written. American or U.S. history cannot be understood completely without putting it into a global context first. Two documents we can draw information from that would support Bender’s thesis are the Virginia Slave Codes enacted in 1705 and The Barbados Slave Code written in 1688. These two documents bring perspective to the strides that were made toward slavery and how they affected America. The slavery that ran throughout the world began as common practice then was later made law. The Barbados Slave Code was law passed in the Caribbean island of Barbados to provide something of a basis for slavery. The codes were written to benefit both slaves and their owners but it is apparent that the slaves were not benefitting from them in the slightest. The reality is that the only “benefit” the slaves received was a set of clothing for that year. The treatment of slaves was dependent on their master or owner. Both went through a series of revisions before they became law. Both give instructions to the multitude of things slaves were stripped of and the heinous reasoning behind them. Slaves were nothing but tools for their owners. Slaves were dispensable and lacked the skin color to be treated fairly. Slave owners could do with their slaves as they pleased and had little to no regulation on what they allowed them to have. Both documents state on various occasions that the owners had the final say in what happened to their slave. And if a white man came across another mans Negro slave away from his plantation, the white man had the right to reprimand the slave however he saw
“Slavery is an American embarrassment” (Breen/Innes 3). The history of slavery can be very complex. While most people believe that slaves did not have the chance to advance, Breen and Innes prove that theory wrong. At least slaves had the opportunity to purchase their freedom on the Eastern Shore of Virginia. Breen and Innes also point out that the relationships between blacks and whites are also not how we originally thought they were. They were not one sided relationships; they could be considered co-dependent relationships.
The Mississippi Black Codes document of 1865 was presented to us by Walter L. Fleming, who was a historian who dealt with the south and more specifically the reconstruction era. He was targeting future historians who were studying this era. He nearly states the pros and cons of what the Mississippi Black Codes asked of their citizens. There were several things in the document that interested me in what history was at this time period. On the other hand, there were parts of the amendments to the government which I found very unethical with my present-day mindset. I realize such times were different, but it still made me sick to my stomach that “Freedmen, Free Negroes, and Mulattoes” were treated very differently than the ways such as whites were treated. The author breaks down the documents into different sections of the reconstruction plan. At first, he starts out talking about vagrant laws, which stated that the newly emancipated citizens had special laws that pertained to them. In 1619 a well-known issue was brought to life that is now known as an American catastrophe. In the book Black Southerners, the author John B. Boles doesn’t just provide background of how slavery began or who started it, and doesn’t just rant about the past and how mistreated the African American race was; he goes on to explain how as slavery and racism boosted the families of these slaves began to grow closer to a community and the efficiency and profitability of slavery. He also shows the perspective of not just the slaves, but the bondsmen as well to show the different perspectives throughout this point in time. Between 1800 and 1860 slavery in the American South had become a ‘peculiar institution’ during these times. Although it may have seemed that the worst was over when it came to slavery, it had just begun. The time gap within 1800 and 1860 had slavery at an all time high from what it looks like. As soon as the cotton production had become a long staple trade source it gave more reason for slavery to exist. Varieties of slavery were instituted as well, especially once international slave trading was banned in America after 1808, they had to think of a way to keep it going – which they did. Nonetheless, slavery in the American South had never declined; it may have just come to a halt for a long while, but during this time between 1800 and 1860, it shows it could have been at an all time high.

Winthrop D. Jordan author of White Over Black: American Attitudes Toward the Negro 1550-1812, expresses two main arguments in explaining why Slavery became an institution. He also focuses attention on the initial discovery of Africans by English. How theories on why Africans had darker complexions and on the peculiarly savage behavior they exhibited. Through out the first two chapters Jordan supports his opinions, with both facts and assumptions. Jordan goes to great length in explaining how the English and early colonialist over centuries stripped the humanity from a people in order to enslave them and justify their actions in doing so. His focus is heavily on attitudes and how those positions worked to create the slave society established in this country.
The American Revolution was a “light at the end of the tunnel” for slaves, or at least some. African Americans played a huge part in the war for both sides. Lord Dunmore, a governor of Virginia, promised freedom to any slave that enlisted into the British army. Colonists’ previously denied enlistment to African American’s because of the response of the South, but hesitantly changed their minds in fear of slaves rebelling against them. After the Civil War, in 1865, the southern plantation owners were left with minimal labor. They were bitter over the outcome of the war and wanted to keep African Americans under their control. Black Codes were unique to the southern states, and each state had their own variation of them. In general, the codes compelled the freedmen to work. Any unemployed black could be arrested and charged with vagrancy. The ones that did work had hours, duties, and types of jobs dictated to them. Codes were also developed to restrict blacks from becoming successful. They discouraged owning and selling property, and raising and selling their own crops. Blacks were often prohibited from entering town without written permission from a white employer. A black found after 10 p.m. without a note could be arrested. After the civil war, newly freed slaves faced many challenges. Whites, especially in the south, regarded blacks as inferior more than ever before. The black codes were just one obstacle the freed slaves had to overcome. They were laws that were passed in the southern states that had the intent and the effect of restricting African Americans freedom. These laws made it possible for the south to regain control over the black population in much of the same ways they had before. States like South Carolina, Virginia, Delaware, Maryland, and North Carolina all enforced many codes to ensure that slaves had very limited freedoms. Virginia had a great deal of slave codes. They enforced codes that legally forbid slaves from carrying firearms and allowed their masters to lash them 20 times for the crime (Understandingrace.com). Many other states also enforced the slave code that denied slaves the right to carry firearms. This was a way to prevent rebellions on the plantations. These slave codes gave white owners great power over the slaves. The codes even allowed them to commit murder free of penalty if a slave attempted to run away. If controlling their work life, and where they lived wasn’t enough, plantation owners controlled how they lived their life. Slaves could not even learn to read and write and could be punished if they were caught. States like South Carolina even controlled what slaves wore by forbidding slaves to wear or buy clothes that were finer than “Negro cloth” (Boundless.com). The Signers did not have much to say on the issue of slavery during this time. In fact, I don’t believe it is mentioned in the words of the Constitutions, rather clauses are in place that seem to touch on the issue of slavery. It may appear the Signers avoided the word altogether. As we know there were clauses included that held some important, rights for slaves and mainly what I can tell slave owners, on the issue of slavery. Although it would seem, at the time in history this was written, and normal way of life, to have offered some protection to slaves.

The term slave is defined as a person held in servitude as the chattel of another, or one that is completely passive to a dominating influence. The most well known cases of slavery occurred during the settling of the United States of America. From 1619 until July 1st 1928 slavery was allowed within our country. Slavery abolitionists attempted to end slavery, which at some point; they were successful at doing so. This paper will take the reader a lot of different directions, it will look at slavery in a legal aspect along the lines of the constitution and the thirteenth amendment, and it will also discuss how abolitionists tried to end slavery. This paper will also discuss how slaves were being taken away from their families and how their lives were affected after.
Slavery has been a part of human practices for centuries and dates back to the world’s ancient civilizations. In order for us to recognize modern day slavery we must take a look and understand slavery in the American south before the 1860’s, also known as antebellum slavery.
