With the ever growing concern that the world’s water supply is dwindling, property law and the concept of legal personhood is being applied to the situation in order to create a solution to preserve the water quality and supply. Economists like Garrett Hardin and Elinor Ostrom have also shared their ideas in relation to issue of water conservation. All of this, combined with the legal cases that have already been argued in relation to water, create various viewpoints and solutions to the issue of water pollution and supply. Nova Scotia Forest Industries involved the allegation that if offending chemicals, produced by Nova Scotia Forest Industries, go on to the plaintiff’s land they would interfere with the health of the plaintiff and the enjoyment of his land. In this case the judge decided that it was unnecessary to consider the riparian rights in relation to the groundwater that would be potentially impacted because of the chemicals because there a health risk was not proven. This case shows that the law does not recognize the rights of commons such as water and the harm that may occur because of pollution and chemicals, but is only concerned with the effect it may have on humans. The case of Wanganui River was a major step towards the resolution of historical grievances of Whanganui Iwi and it national importance. A society in which rivers have legal rights causes a collaboration between, in this case, the iwi, the central and local government along with commercial and recreational users. Rivers holding legal rights created a different legal system because now new rules and regulations need to be put in place in order to protect the rivers

The Grassy Narrows people have a long, deeply rooted history in the environmental justices movement. Rodgers (2009) points to a number of environmental justice struggles such as the fight against the harmful effects of mercury poisoning and the Minamata disease associated with it (para. 1-3), the Ontario Hydro dams that destroyed part of the wild rice harvest and degraded the habitat of fish and fur animals, as well as the displacement of the community (due to relocation into prefabricated houses where electricity and running water were promised) and the culture shock it created (para. 4). He also discusses the successful blockade in 2002, which is the longest-lasting blockade in Canadian history (para. 28)—an example that shows how employing legal methods were critical in the struggle against environmental injustices for this community. There are a number of other issues that will be discussed in the following paragraphs; the above are just a few of the injustices the Grassy Narrows community face.

This article does two things successfully: it raises awareness of an important problem and communicates exactly how the problem will affect the world. Barlow’s argument uses pathos and logos to push her ideals to her audience. However, while her use of appeals stimulates, it fails to finish with a final solution to solve the previously posed problem.
An issue arose in Eastern Canada between 1865 and 1903 in which Peter Gillis focused on the views of certain environmentalists, lumbermen and the government as well as the public’s opinions on the matter throughout the years. Gillis stressed the damage caused by dumping sawdust into rivers and lakes regularly – mainly the Ottawa River. Water-powered sawmills, which were designed to allow waste to drop through the floorboards into the water, caused blocked navigation ways, posed as a health hazard, and threatened wildlife. (84) The controversial issue that Gillis presented was based around the lumbermen’s sole interest in business to maximize profits clashing with environmental concerns of the conservationists. The government had to implement a strategy that would appeal to both sides which would become an important victory for the early environmentalists.
We would like to begin by discussing the evolution of what will become known as the EBR. The first idea of having a statute that would provide people with environmental rights can be traced back to American law. The first of such laws was the Michigan Environmental Protection Act (MEPA) of 1970 which was seen as a “lean, mean, green, right to sue” (Lindgren, 2010). In the developed countries like the US, France and Europe water is controlled by the public and private companies or corporations. Water remains a function of municipal government in 90% of cities around the US and Suez Environment and Veolia Water are the top two water companies.2 The consensus throughout the US is that water should be the publics responsibility because water in privately owned water facilities is more expensive and in some cases below standards and less desirable.6 People in the US want to keep their water in their hands because they feel better knowing that people like them control and consume the same water as they do and not people who do not. “Water is the driving force of all nature.” Leonardo da Vince once said. Water is a huge part of life, and everything that lives requires water to make it through its days on earth. A lot of people think that the world has massive amounts of water available for use; therefore, most roll their eyes when conserving water is mentioned. After all, 71% of the earth’s surface is made up of water. However, the truth is that only 2.5% of that is clean, drinkable water, and two-thirds of that percentage is unavailable because it is stuck in ice caps and glaciers (water). The water ordeal in America is bigger than many realize, and the United States needs to begin looking at how we can solve this issue. The U.S. needs to acknowledge the impending dangers and help the states that are already suffering by putting water conservation methods in place and investing money into research for alternatives.
People don’t appreciated the many advantages that comes with having clean potable water to use, taking it for granted. A lot of clean useful water is wasted by humans all the time that people don’t care about saving water because they have easy access to it. Clean and safe drinkable water resources are getting scarce as the population grows. The world is facing many problems, but the most important needed to survive, is water. Water is getting low in many countries, therefore habitants are suffering the misfortune of not having the reliable source of clean water. Freshwater in the world makes up only a small portion of water on the planet. While the percentage of water in the world is nearly 70%, only 2.5% is consumable. Even further, only <1% is easily accessible to basic human needs. According to National Geographic, “by 2025, an estimated 1.8 billion people will live in areas plagued by water scarcity, with two-thirds of the world's population living in water-stressed regions as a result of use, growth, and climate change.” With this current trend, water will become more immersed in environmental, economic, political, and social changes. Drinking water is sourced from bodies of freshwater.
The problem of water scarcity has increasingly spread throughout the world as of yet, The UN reports that within the next half- century up to 7 billion people in 60 countries which is more than the whole present population will face water scarcity (Sawin “Water Scarcity could Overwhelm the Next Generation”). As well the demand for freshwater has tripled over the past 50 years, and is continuing to rise as a result of population growth and economic development. 70% of this demand derives from agriculture which shows the influence of water on food supply globally as well not just drinking water (Sawin “Water Scarcity could overwhelm the Next Generation”). But increasing water use is not just a matter of the greater number of people needing it to drink and eat; it also comes from pollution and misuse of water supplies, by either dumping or runoff of bacteria or chemicals into water. This also “causes other pollutions as well such as soil and air pollution, accelerating wetland damage and human caused global warming” (Smith and Thomassey 25). According to UN report, recent estimates suggest that climate change will account for about 20 percent of the increase in global water scarcity in coming decades.
