In Dr. King's Letter From Birmingham Jail he writes about something he states as just and unjust laws. Taking a closer look at the diction and syntax of the letter, Dr. King makes a distinction that is similar to the philosophy of the Romans during their golden age. Ius Gentium; or ‘law’ that is universally practiced and Ius Naturalis means ‘natural law’ or ‘moral law’. He further explains the difference between a just and unjust law stating “Any law that uplifts human personality is just. Any law that degrades human personality is unjust.” Proving morally similar to the Romans belief a law that was universally practiced and at the same time was morally right. Aquinas’s indication that “An unjust law is a human law that is not rooted in eternal and natural law.” as any law that is not in harmony with the moral law or the `Law of God`.Martin Luther King saw that segregation was not only rooted in unjust laws, but from groups who placed the laws on minorities expecting them to follow. However, these majority groups fail to follow the law themselves, therefore making it unjust. King felt that we should never obey an unjust law. He felt it necessary for us to obey unjust laws in non violent ways in order to gain civil rights, and that the supreme courts were not the way to solve segregation. He made this clear by coming to Birmingham in the first place. King thought it necessary to show direct action. He himself claimed, “Nonviolent direct action seeks to create such a crisis and foster such a tension that a community which has constantly refused to negotiate is forced to confront the issue.” In this quote King makes it clear that he is upset with the way Birmingham has handled the segregation issues, and that nonviolent direct action is the only resort. Although King, Jr. took many steps beyond Thoreau's advocacies of civil disobedience, his actions rang true to the central theme of standing powerfully, and non-violently, against an unjust system of government. Both advocated disconnecting oneself from social law as to better follow the divine laws set forth by God, and despite the great diversity in which each man carried out his beliefs, the underlying fact still remains: "we cannot, by total reliance on law, escape the duty to judge right and wrong" (Alexander Bickel), the distinction between just and unjust rests on the shoulders of mankind and it remains the duty of each individual to act accordingly.
Argumentation has followed humans from the dawn of time as a way for us to express our ideas and for our ideas to be heard. People naturally obtain the knowledge to persuade others, either backing their opinions by fact or touching others emotionally, from growing up and through their own experiences in life. We can be persuaded by a numerous amounts of different factors pertaining to the argument. Martin Luther King Jr. is known for his use of religion to justify actions, with this letter as a prime example. He believes that the morality of laws should be put into question to see if they are just, where the measurement of morality comes from an inner scale that is balanced by religion. He effectively argues this through a strong biblical allusion, saying, “… just as the Apostle Paul left his village of Tarsus and carried the gospel of Jesus Christ to the far corners of the Greco Roman world, so am I compelled to carry the gospel of freedom beyond my own home town. King, a leader of a civil-rights group that supported protest against traditional views, encouraged protesting against tradition and established laws that are unjust. In his letter from Birmingham Jail King states: "It was illegal to aid and comfort a Jew in Hitler's Germany. Even so, I am sure that, had I lived in Germany at that time, I would have aided and comforted my Jewish brothers. His great use of rhetoric affected largely the freeing of an entire race. During his work in the Civil Rights Movement, he visited a small town called Birmingham in Alabama, and wrote one of his most rhetorically compelling letters there. In this letter, he used historical evidence, scriptural references, descriptive vocabulary, and great organization of points to respond to grievances raised against his movement: that he should wait, that he was breaking laws, that his peace brought on violence, and that his activities were extreme.
Reverend Martin Luther King Jr. had faith in his beliefs of equality, and that all people, regardless of race should be free and governed under the same laws. In the later part of the 1960's, Birmingham, Alabama, the home of King, was considered to be the most racially divided city in the South. "Birmingham is so segregated, we're within a cab ride of being in Johannesburg, South Africa", 1 when King said this he was only speaking half jokingly. In Birmingham the unwritten rule towards blacks was that "if the Klan doesn't stop you, the police will."2 When King decided that the time had come to end the racial hatred, or at least end the violence, he chose to fight in a non-traditional way. Rather than giving the white people the pleasure of participating in violent confrontations, King believed if they fought without violence for their rights, they would have a faster success rate. King also saw Birmingham as the major problem in America.
While the government the founding fathers established had a purpose of protecting the divine rights granted to man, more issues arose due to the inability of the government to fully protect all human rights. Jefferson stated in The Declaration of Independence “that all men are created equal,” (Jefferson, 2014, p. 108). However, the government did not uphold this ideal. Martin Luther King Jr., one of the leaders of the civil rights movement, encouraged Americans to practice civil disobedience to attempt to make a change in the treatment the African-American people endured under the ideals of the government. Segregation laws were considered unjust under the divine law. They encouraged the unfair treatment of American citizens based solely on the color of their skin. A portion of the American identity established by the revolution, was an intolerance to unjust laws and actions. King explains in his Letter from Birmingham Jail that “injustice anywhere is a treat to justice everywhere,” (King, 2014b, p. 141). Therefore, the citizens had a duty to disobey injustice to achieve justice. However, disobedience only applies with unjust laws. According to King, “an unjust law is a code that is out of harmony with the moral law,” (King, 2014b, p. 144). Kings considers any law that does not align with the teachings of the Lord or the natural rights that all men possess as unjust. This echoes the ideas of the Founding Fathers that the British government defied the rights of the colonists. The American identity established during the founding of the nation, seems to accept the use of disobedience of unjust laws as a method of improving the American state.
