The Supreme Court’s decision in Tinker v. Des Moines held that students do not necessarily shed their constitutional rights when they enter onto school grounds. Tinker v. Des Moines Independent School District, 393 U.S. 503 (1969). However, the court recognizes the school’s special relationship with the students including abilities to limit freedoms on campus like speech that are not necessarily the same as adults outside school grounds. Id. The court established a two-prong test to determine the constitutionality of those limitations, of which either can be met. Id. The first prong is the forecast of a substantial disruption of the work of the school. Id. The second is the infringement of the rights of other students to be let alone. Id.
The third legal issue I chose was Mills vs The Board of Education of The District of Columbia. In 1972 this case was brought to the courts representing seven children, as well as nearly 18,000 other students in the District of Columbia area. These children were classified as having behavioral, intellectual, and emotional disabilities, as well as hyperactivity. All of these children were denied an educational services and public education by being excluded, suspended, expelled, reassigned, and transferred. They were denied based solely on their disability, and without due process. This case was the other of the two that laid the ground work for Section 504 of the Rehabilitation Act of 1973 to be passed.
Abington v. Schempp was an important case regarding the establishment of religion in American schools. Until the late twentieth century, most children were sent to schools which had some sort of religious instruction in their day. The schools taught the morals, values, and beliefs of Christianity in addition to their everyday curriculum. However, as some people began to drift away from Christianity, parents believed this was not fair to the kids and justifiable by the government. They thought public schools should not be affiliated with religion to ensure the freedom of all of the families who send students there. Such is the situation with the 1963 Supreme Court case Abington v. Schempp.
The case, Near v Minnesota, took place in Minneapolis in 1929. It was argued on January 30, 1931 and was decided on June 1, 1931. This case appeared in the supreme court after the constitutionality of Minnesota’s law was questioned by Jay Near, the defendant. Near was to be censored due to his "malicious, scandalous and defamatory" article about the Chicago chief of police and many other local officials with being affiliated with gangsters. This then led to a lawsuit that formed from an attempt by Floyd B. Olson, to shut down the local newspaper owned by Jay Near that used racial language in its criticism of local officials and political figures. Olson claimed the paper violated the state’s nuisance law, and both the county court and Minnesota Supreme Court upheld Olson’s right to shut down the paper under Minnesota’s nuisance law. This was questioned because it was unclear whether or not the law permitted by the state would be impeding upon the defendant 's freedom of speech and even freedom of press.
Therefore, the respondents took the case to court (Island Trees…). The holding, the court’s decision, by a 5-4 vote, was “The First Amendment limits the power of local or school boards to remove library books from junior high schools and high schools” (Island Trees…). The court also said that the Board of Education “should not intervene in ‘the daily operations of school systems’ unless ‘basic constitutional values’ were ‘sharply implicate[d]”(qtd. in Board of Education, Island). The dissent consisted of Burger, Powell, Rehnquist, and O’Connor; the concurrence consisted of Blackmun and White (Island Trees…).
Separate but equal, judicial review, and the Miranda Rights are decisions made by the Supreme Court that have impacted the United States in history altering ways. Another notable decision was made in the Tinker v. Des Moines Case. Ultimately the Supreme Court decided that the students in the case should have their rights protected and that the school acted unconstitutionally. Justice Fortas delivered a compelling majority opinion. In the case of Tinker v Des Moines, the Supreme Court’s majority opinion was strongly supported with great reasoning but had weaknesses that could present future problems.
Through using case laws, the First Amendment, and previous cases, Justice Abe Fortas explains the reasoning behind why the principal was not permissible. In the first two paragraphs, Fortas provides a brief summary stating how the policy banning armbands go against the First Amendment. In the following paragraph, Fortas says, “Only a few of the 18,00 students in the school system wore the black armbands.” When introducing his first argument, he supports this fact explaining how “the work of the schools or any class was [not] disrupted.” As for the fourth paragraph, Justice Fortas provides a counter argument with what the District Court said. The district court found the disruptive-conduct rule unconstitutionally vague and broad, and that withdrawal of the student's name from the graduation speaker's list violated the Due Process Clause of the Fourteenth Amendment because the rule did not mention such removal as a likely sanction. The court made the case that nothing in the Constitution forbids the states from insisting that certain forms of expression are unfitting and subject to sanctions. (Tinker v. Des Moines Independent Community School District, 1969) The court affirmed that students do not "shed their constitutional rights to freedom of speech or expression at the schoolhouse gate."(Tinker) If the student had given the same speech off the school premises, he would not have been penalized because government officials found his language inappropriate.

In the landmark case Tinker v. Des Moines Independent Community School District (1969), John Tinker and his siblings decided to openly protest the Vietnam War by wearing black armbands to school (Goldman 1). The school felt that their efforts to protest the war disrupted the school environment. “The Supreme Court said that ‘in our system, undifferentiated fear or apprehension of disturbance is not enough to overcome the right to freedom of expression.’ School officials cannot silence student speech simply because they dislike it or it is controversial or unpopular” (FAQs 2). What about theatrical performance? Should certain plays not be performed at school because of inflammatory content? Theatrical performance plays a significant role during various years of a child’s youth, but, alone, has one central aim that allows for tolerance and multifariousness within the “salad bowl” United States. High school theatre arts curriculum’s purpose is to develop appreciation of the doctrines, perspectives, principles, and consciousness of diversified individuals in distinctive epochs throughout history as conveyed through literary works and theatre. If theatre has this sort of impact, why does the school administration, teachers, parents, even the state government, infringe upon the student body’s First Amendment rights? Schools should make no policy that would chastise a student for speaking their mind or expressing oneself, unless the process by which they are expressing themselves meddles with the educational methods and the claims of others. If a student threatens another student under “the right” of being able to speak freely, one would hope a school would take immediate action before potential harm occurs. The First Amendment clearly states that “Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the government for a redress of grievances.” In reference to students and a school environment, the definition of freedom of speech and expression becomes very unclear as to what they can and cannot say.
This case study is about a man, Miller, who has worked at a factory for 27 years. He is a pocket setter and is able to run two machines in an efficient manner. He is happy with his job as well as happily married to his wife who works at the same factory. He has children but they are raised and moved out of the Miller’s home. He wants to work another ten years before retiring but is rethinking this decision due to the company hiring a consultant firm who has recommend a job enrichment program and his job will be the first to be effected by this program. Right now he just uses the machines and sews but under the new program he will also have to get his own materials, get his own needles, perform routine maintenance on his equipment, and deliver his work to the next station. He believes this will be having him to do three jobs instead of two and that he could go elsewhere and not to have to deal with something like this.
In Goss v. Lopez, a student sued because an Ohio law allowed a school principal to suspend a student for 10 days or more with only a simple 24-hour notice to parents. The court ruled that this was a violation of a student’s 14th amendment due process clause rights because students were not given a due process hearing. In Dixon v. Alabama, a federal appellate court affirmed same standard in higher education by maintaining that a public college or university cannot expel a student without a hearing.
