Tinker v. Des Moines School District The Tinker v Des Moines School District issue was in 1969 and was about the Vietnam war , students in this school were not granted permission to protest the war. They could not show their feelings about the war. During this time many people did not approve of the war, many people were bitter over the whole subject, especially over the draft. This case involves a sophomore at a high school named Christine Franklin, who alleged that she was sexually harassed and abused by a teacher and sports coach by the name of Andrew Hill. These allegations were occurring from 1986-1988, a total of two years. These allegations included Hill having explicit conversations with Franklin, forcing her to kiss him, and forceful intercourse on school grounds. We, all, have the opportunity to voice our opinion on subjects that matter to us. The First Amendment grants us freedom of speech and expression. However, this was not provided to all students in 1968. During this time, there were three students in Des Moines, Iowa, who wore black armbands to school. These armbands were a symbol of protest against the United States involvement in the Vietnam War. After the Des Moines School District heard about this plan, they instituted a policy banning the wearing of armbands, leading to the suspension of students. A lawsuit has been filed against the Des Moines School District, stating how this principal goes against the students’ First Amendment rights. Thus, in the Tinker v. Des Moines Independent Community School District case, Justice Abe Fortes determined the policy to ban armbands is against the students’ First Amendment rights. Yet, Justice Hugo Black dissented with this decision, determining the principal is permissible under the First Amendment.
In December 1965, a group of students from Des Moines, Iowa met at Christopher Eckhardt’s home in order to plan a protest. During the meeting, the students planned to wear black armbands throughout the holiday season to show public support for a truce in the Vietnam War. However, the principal of the school got word of the planned protest and quickly established a policy that stated any student wearing an armband would be asked to remove it. If they refused to do so, it would result in suspension. On December 16, 1965, the protest began and students Mary Beth Tinker and Christopher Eckhardt wore their armbands to school and were sent home. In the late 1940’s and early 1950’s there were many issues that involved racial segregation with many different communities. A lot of people did not took a stand for these issues until they were addressed by other racial groups. Mendez vs Westminster and Brown vs The Board of Education, were related cases that had to take a stand to make a change. These two cases helped many people with different races to come together and be able to go to school even if a person was different than the rest.
The district court found the disruptive-conduct rule unconstitutionally vague and broad, and that withdrawal of the student's name from the graduation speaker's list violated the Due Process Clause of the Fourteenth Amendment because the rule did not mention such removal as a likely sanction. The court made the case that nothing in the Constitution forbids the states from insisting that certain forms of expression are unfitting and subject to sanctions. (Tinker v. Des Moines Independent Community School District, 1969) The court affirmed that students do not "shed their constitutional rights to freedom of speech or expression at the schoolhouse gate."(Tinker) If the student had given the same speech off the school premises, he would not have been penalized because government officials found his language inappropriate.
Among the riots caused by Nixon’s decision were revolts at many universities, such as Kent State. Young students were upset because they were the ones being drafted and the sooner the war ended the less chance they had of seeing war. On Friday, May 1, 1970 anti-war rallies began to take place at Kent State University. Students gathered and burned a copy of the constitution. Also, many riots broke out in downtown Kent.

The black armbands were a sign of protest against the Vietnam War. The school suspended the students and told them that they could not return to school until they agreed to take off the armbands. The students did not return to school until after the school’s Christmas break, and they wore black the rest of the year, as a sign of protest. The Tinker family, along with other supporters, did not think that the suspension was constitutional and sued the Des Moines Independent Community School District. The Supreme Court’s majority decision was a 7-2 vote that the suspension was unconstitutional (Tinker V. Des Moines).
Although the 1970s are greatly remembered as a decade filled with social influence, personal freedom, and a nation-wide cultural rebirth, they also presented a tense time period of American history. Civil unrest heightened at the United States entry into the Vietnam War, and as expected, protests in various shapes and sizes broke out across the country. However, one particular form of protest proved so important that the protester found himself before the United States Supreme Court in summer of 1971. The protester is also known as Paul Robert Cohen, and the case is also known as Cohen v. California. The decision that resulted from the case positively impacted America as it upheld the right of the People to voice their ire on governmental decisions without fearing law infringement, so long as violence is not the primary goal.

The particular issue was whether a black girl, Linda Brown could attend a local, all-white school. Linda had to walk over twenty blocks to get to her school in Topeka even though there was a local school just down the road. Linda's class at her school in Topekawas big, the classrooms were shabby and their were not enough books for each child. The all-white school down her road was much better off, better education with a lot better teaching materials. The poor quality education and environment at Linda's school was because the Topeka Board of Education spent much more money on the white school than on Linda's school for blacks.
Detroit is a story of a once flourishing city that has been on a long downslide for decades. There are miles of unoccupied homes and buildings, and crimes and unemployment are at an all-time high. Many aspects of the city are breaking down, including the school system. The Detroit Public School System has lost over eighty thousand students due to high enrollment in charter schools, the large economic decline, and the departure of residents. For many years no one has taken responsibility for the public school system. However, for Detroit to rise again, it is necessary for someone to take responsibility, make a plan, and make sure that children are safe, well cared for, and are receiving a high quality education when going to school each day. In 2016, schools are low-performing with poor test scores, are falling apart, and teachers and parents have decided to take a stand.

The armbands they wore represented their part in a group which was against American involvement in the Vietnam War. In result to wearing the armbands Mary and John Beth were suspended until they were to return to school without the armbands. As the process continued the Tinkers took the case to court where “they were disappointed when a tie vote in that court allowed the District Court’s ruling stand.”(Streelaw.org). Tinker V.
