According to Porter, “A ‘discourse community’ is a group of individuals bound by a common interest who communicate through approved channels and whose discourse is regulated. A discourse community shares assumptions about what objects are appropriate for examination and discussion, what constitutes ‘evidence’ and ‘validity’ and what formal conventions are followed (38-39).” These five texts collectively constitute a community of discourse through their application of common language norms, characteristics, patterns and rhetorical strategies. “The Discourse itself defines what counts as acceptable criticism” (Gee 162). All of the articles use similar rhetorical strategies by describing a problem in shared thinking; the common conception that the women’s equality dilemma has been resolved since formal regulations were instituted and women’s number have increased in the profession. Within both Brenner and Rhodes articles, both writers use a common language norm by referring to this conception as the ‘no problem’ problem. Furthermore, both authors push against this conventional way of thinking and claim this ‘no problem’ problem is oppositely one of the predominant factors leading to gender inequality in the legal profession and demand it not be overlooked within today’s society. In Brenner’s article, she asserts an alternate way of approaching content by disputing the topic of legal ethics. This discourse consists of authors (whos) writing about their opinions, ideas, beliefs and revisions to the issue of gender inequality (whats). The borders are not necessarily defined nor fluid, instead they are somewhat steady in the middle; there is a range for authors to have similar or competing concepts centered on the issue. In the article “The Concept of Discourse Community” John Swales touches a few very important main ideas about what discourse community really is. I found it to be refreshing that he is able to express his feelings how he does in this article. Swales talks about discourse community and how our world today really isn 't that good at being apart of them. He discusses the six qualities or characteristics of being apart of a discourse community. You have to be active in communicating and wanting to be apart of that community and if you 're not that type of person than maybe it 's not your thing.

Despite legislation for equal opportunities, sexism is still evident in the workplace. Women have made great advancements in the workforce and have become an integral part of the labor market. They have greater access to higher education and as a result, greater access to traditionally male dominated professions such as law. While statistics show that women are equal to men in terms of their numbers in the law profession, it is clear however, that they have not yet achieved equality in all other areas of their employment. Discrimination in the form of gender, sex and sexual harassment continues to be a problem in today’s society.
Discourse communities are groups of people with a unique point of view. There are many discourse communities around your everyday life. These communities are part of the entire human environment. Many discourse communities are distinctly large due to all the societies wanting the same things. My discourse communities are mostly Facebook.
Deborah Tannen’s, “Fighting For Our Lives,” explores the ideas and concepts behind human sociology. She delves into the sociolinguistic relationship between women and men in conversation. Tannen amplifies the importance between language and gender and how they affect interpersonal relationships. Tannen showcases her analytical thinking processes by using rhetorical strategies to support her claim on conflicted communication within the argument culture. Specifically, focusing on politics, the law, education, spousal relationships, the media and within work environments. She gives many examples to support her claim by using figurative language and literary devices such as metaphors and logic and reasoning to accurately convey her message.
Gender Matters is a collection of various essays on feminist linguistic texts analysis, by Sara Mills. Mills develops methods of analyzing literary and non-literary texts, in addition to conversational analysis based on a feminist approach. The author draws on data from her collection of essays gathered over the last two decades on feminism during the 1990s. The essays focus on gender issues, the representation of gender in reading, writing, and in public speaking. Furthermore, it highlights the importance of feminists’ analysis of sexism in literature and the relation between gender and politeness. The article is informative for my research paper, as my topic is going to cover language analysis of the text and who women reading and writing differs according to the discourse analysis within linguistic, psychology, case studies audiences and surveys. The book would be helpful, particularly the last three essays that discusses gender, public speaking, the question of politeness and impoliteness in public speaking. Mills’ analysis is not complete without including the idea of global notions of both women and men, to see whether women and men write and read in the same way globally. Therefore, an update would enrich the book’s discussion section. Although, Mills addresses the class and race theme in language and public speaking, I will only look into the role of language that plays a part in doing or reducing gender in literary, non-literary texts and in conversation.
Imagine Kirsty and Marc, a young couple who resort to robbing a house in a desperate attempt to make money. They are caught, charged with the same crime and given the same sentence, except for one thing: the male dominant world we live in does not stop at the courtroom door. Marc is sent to a medium security prison one hour from his family with every opportunity to earn his way into a minimum-security facility. He spends his days learning to cook in the kitchenette and has access to basic necessities like aftershave or hairspray. Meanwhile, Kirsty walks into her frigid six-by-ten foot cell with bars for a door, a toilet in plain view and not a trace of sunlight. She is twelve hours from home with no hope of changing location since there is nowhere else to go. The stories of rapes, beatings and riots told by her new neighbours are endless. Kirsty realizes that the only way for her to survive this place is to oppose nature and forget what it is to feel. This is discrimination against women as they are penalized more severely than men for committing less crime. How can women strive for equality when they cannot attain justice in the justice system itself? The controversy over the gender bias goes beyond the "too-few-to-count" syndrome as Sally Armstrong calls it, it is a question of women's constitutional right to be treated equally.

The Australian Human Rights Commission (2011:p1) states that “Gender equality is a principal that lies at the heart of a fair and productive society”. If gender equality is the heart of a fair and productive society than the laws and regulations in place must be the key in maintaining a fair and productive society. If regulations and laws are not frequently discussed, debated and reviewed than issues such as sex discrimination in particular can be sufficiently dealt with or ignored. The Carter v Linuki Pty t/as Aussie & Anor [2005] NSWADTAP 40 (22 August 2005) will be used to demonstrate the regulations surrounding sexual discrimination. In this paper a thoroughly investigation into the recent changes in laws and regulations encompassing sexual discrimination will be conducted in relation to the case provided. By using the elements of the case the Sex Discrimination Act 1984 (Cth) (SDA) will be applied to the facts presented in order to explain the regulation surrounding this issue. Since the case involves a work related situation where the employee was discriminated on the basis of gender the SDA will be used. A Brief description on the impact of exclusion will be provided to demonstrate the causal link between exclusion and gender discrimination. Firstly, the case’s elements will now be analysed.

In his article “The Concept of Discourse Community,” John Swales describes a discourse community as a group of people that “have a broadly agreed set of common goals, contain certain mechanisms of intercommunication among its members, have acquired a specific lexis, and have a threshold level of members with a suitable degree of relevant content discoursal expertise” (Swales #). An example of such a discourse community is the legal profession. The legal profession has the common goal of understanding and applying general principles to particular factual situations. In doing so, lawyers use language, concepts, and methods that are unique to their community. In order to become a recognized member of the legal community, a person must graduate from law school and pass the bar exam thereby demonstrating an in depth knowledge concerning all areas of the law and the specialized rules, methods, and jargon used by lawyers to communicate about legal principles.
A discourse community is a group of people with relatively the same goals and interest to achieve a specific goal. Discourse communities gain there members by qualification, shared objectives, training, or persuading others to join their discourse community. In order for a group to be a discourse community, they must have their own languages, text, rules, and ethics that will make the discourse community run more efficiently. They will also have a form of intercommunication among the group to keep everyone involved or informed with upcoming events or just important news. The debates began over the meaning between a man and woman’s morality and a woman’s rights and obligations in society. After the 19th Amendment was sanctioned around 1920, the ball started rolling on women’s suffrage. Modern times have brought about the union of these causes, but due to the differences between the genetic makeup and socio demographics, the battle over women’s equality issue still continues to exist. While men have always held the covenant role of the dominant sex, it was only since the end of the 19th century that the movement for women’s equality and the entitlement of women have become more prevalent. “The general consensus at the time was that men were more capable of dealing with the competitive work world they now found themselves thrust into. A discourse community refers to a group of people who have language, life patterns, culture, and communication in common with each other. The idea of a discourse community has also been used to bring people of different orientations together, like family members, students, or committees. All of these types of people might have different standards of living, like their level of income, education, and work abilities. Discourse community can also refer to a speech community, because the main feature of a discourse community is communication. In her article “Small Things Rendered: Susan Glaspell’s “A Jury of Her Peers” Elaine Hedges make several arguments regarding the roles of women in a masculine society, particularly in Susan Glaspell’s “A Jury of Her Peers”. The article takes the feministic approach and brings to light the superior frame of mind versus the inferior frame of mind. The author’s argument is validated and strongly supported by how a superior mind frame of a man can adversely affect an even change the motives and actions of an inferior mind frame of women when oppression, isolation, insensitivity, and living without the presence of say and a range of possibilities are introduced.
