The Senate Confirmation of Presidential Appointees is a complex process that has numerous opportunities for dissention amongst the major players. When the president identifies individuals to fill specific federal appointments, those individuals are required to go through a vetting process called the Senate Confirmation process. Senators vote to approve or disapprove those nominations based on a variety of motivating factors such as political party affiliation, merits of the individuals and national interests. This grueling process is a gauntlet of interviews, background checks and extreme scrutiny in order to determine if the individual can “perform the job” and make sure that there are no “surprises” that may come out later. (Davidson, 325)
On October 3rd, 2002, Minnesota Senator Paul Wellstone walked unto the Senate floor to give what would be one of the most momentous speeches of his career. A day prior, the Senate leadership had introduced a resolution, backed by the George W. Bush Administration, to authorize the President to attack Iraq. Wellstone, a progressive Democrat, had long been noted for his strong anti-war views. However, he was at the time struggling to win reelection, and a vote against the popular resolution could sway the election in his opponent’s favor. Yet instead of joining the bipartisan chorus for war with Iraq and abandoning his anti-war convictions, Wellstone chose to stand as a “monument of individual courage” and raise his concerns about the direction of American foreign policy (Kennedy 223).

Whilst the assumption that all members of Congress are ‘‘single-minded re-election seekers’’ does go some distance in analysing the motives behind members of Congress, the reading fails to take into account the other key goals of members of Congress. Other goals include good policy and future career positions. It is important to remember that the achievement of both re-election and other goals are not exclusive, members of Congress often are motivated by more than one goal.

Otto von Bismarck once said, “Laws are like sausages, it is better not to see them being made.” The arduous process that a bill undergoes in order to become a law may seem grueling and pointless; however, the processes high caliber of difficulty allows for the extreme prestige and exclusivity of bills that are passed. Because the process is so exhausting, and filibusters, subsequently requiring a super-majority vote to pass a bill, have always been such a threat in Congress, historically, bills that attempt to reform sensitive issues have not fared well in the legislative branch. However, when Congress does pass controversial laws, it then also faces the task of effectively enforcing them. But, when the process is carried out to completion, laws that are enforced have significant impacts on the everyday lives of the American people—such as laws concerning abortion rights. In the United States, the government and Congress have significantly affected the rights of women with regard to abortions through laws that either restrict or guarantee their legality and availability, while the government’s capacity to do so is affected by the principle of federalism along with that of the separation of powers.
In William Hudson’s book, American Democracy in Peril, he writes about different “challenges” that play a vital role in shaping the future of the United States. One is the problem of the “imperial judiciary”. Hudson defines its as that the justice system in the United States has become so powerful that it is answering and deciding upon important policy questions, questions that probably should be answered by our democratic legislatures. The rise of the use of recess appointments has led the Senate to come up with unjust practices to keep the president from having an opening to recess appoint. Pro-forma sessions were created by Senate democrats to stop President George W. Bush from making recess appointments. Pro-forma sessions were an open Senate floor to start business for the Senate. However, only one senator was needed to bang the gavel into a meeting. These sessions could be as short at thirty seconds. This would deny the President from being able to make any recess appointments, because the Senate would not be in recess, although most members were not in for the session and no votes could be held. Understanding and evaluating presidents’ performance often poses challenges for political experts. The nation votes one president at the time and each presidency faces different tests. The environments surrounding a presidency have a tremendous impact on the success and failure of that presidency. U.S. Presidential Elections offer ample opportunity to observe common heuristics and biases in supporters, candidates, and the media.
