Racial Profiling has tremendously affected the mass incarceration rate in America. It has increased every year since 1920-2014. America’s prison system has become the world’s largest prison incarceration. To in prison an individual has become much easier than trying to actually rehabilitate them and put them back out in society. There are about 2.2 Million people in America's Prisons and Jails. Increased tensions during the 1960s in the context of the Civil Rights Movement started to cause an increase in crime, sparking a newfound belief in incarcerating the masses to prevent more crime from occurring. During the 1970s, the likelihood of being incarcerated increased for nearly every citizen, especially low-level offenders. Clear and Frost thoroughly explain that the Punishment Imperative in the 1980s was caused by changes in government “policies and practices associated with the increasingly ubiquitous War on Drugs” (31). Changes in sentencing guidelines, mandatory minimum sentences, and three strikes legislation were though to be initially helpful in decreasing the rate of incarceration, but they proved to do the exact opposite. Policies also regarding reentry into society, access to education, public housing, and child custody for ex-convicts continued to play a major role in the increase in incarceration because newly released convicts had an extremely difficult time reintegrating into society. For a majority of the 20th century, sentencing policies had a minimal effect on social inequality (Western and Pettit 2002). In the early 1970s, this began to change when stricter sentencing policies were enacted (Western and Pettit 2002). Sentencing laws such as determinate sentencing, truth-in-sentencing, mandatory minimum sentencing, and three-strikes laws were enacted with the purpose of achieving greater consistency, certainty, and severity in sentencing (National Research Council 2014). Numerous inequalities involving race, ethnicity, gender, and socioeconomic status have generated an unprecedented rate of incarceration in America, especially among minority populations (Western and Pettit 2010). Racial profiling is the tactic of stopping someone because of the color of his or her skin and a fleeting suspicion that the person is engaging in criminal behavior (Meeks, p. 4-5). This practice can be conducted with routine traffic stops, or can be completely random based on the car that is driven, the number of people in the car and the race of the driver and passengers. The practice of racial profiling may seem more prevalent in today’s society, but in reality has been a part of American culture since the days of slavery. According to Tracey Maclin, a professor at the Boston University School of Law, racial profiling is an old concept. The historical roots “can be traced to a time in early American society when court officials permitted constables and ordinary citizens the right to ‘take up’ all black persons seen ‘gadding abroad’ without their master’s permission” (Meeks, p. 5). Although slavery is long since gone, the frequency in which racial profiling takes place remains the same. However, because of our advanced electronic media, this issue has been brought to the American public’s attention.
The United States has a larger percent of its population incarcerated than any other country. America is responsible for a quarter of the world’s inmates, and its incarceration rate is growing exponentially. The expense generated by these overcrowded prisons cost the country a substantial amount of money every year. While people are incarcerated for a number of reasons, the country’s prisons are focused on punishment rather than reform, and the result is a misguided system that fails to rehabilitate criminals or discourage crime. The ineffectiveness of the United States’ criminal justice system is caused by mass incarceration of non-violent offenders, racial profiling, and a high rate of recidivism.
Nationwide, blacks are incarcerated at 8.2 times the rate of whites (Human Rights Watch, 2000).” This difference in proportionality does not necessarily involve direct discrimination; it can be explained by a number of combined factors. Correctional agencies do not control the number of minorities who enter their facilities. Therefore, the disparity must come from decisions made earlier in the criminal justice process. Law enforcement, court pre-sentencing policies and procedures, and sentencing all have a direct effect on the overrepresentation of minorities in the correctional population.
For the past few years there has been an ongoing debate surrounding the issue of racial profiling. The act of racial profiling may rest on the assumption that African Americans and Hispanics are more likely to commit crimes than any individual of other races or ethnicities. Both David Cole in the article "The Color of Justice" and William in the article "Road Rage" take stance on this issue and argue against it in order to make humanity aware of how erroneous it is to judge people without evidence. Although Cole and William were very successful in matters of showing situations and qualitative information about racial profiling in their articles, both of them fail at some points.
Disproportionate Incarceration of African Americans The disproportionate numbers of African Americans in the prison system is a very serious issue, which is not usually discussed in its entirety. However, it is quite important to address the matter because it ultimately will have an effect on African Americans as a whole. Of the many tribulations that plague Americans today, the increase in the number of African American men and women in prisons is unbelievable. It would be nave to say that the increase is due to the fact that more African Americans are committing crimes now than before.
In todays society the United States has the highest incarceration rate in the world. This high incarceration rate is due to the growing phenomena known as mass incarceration. This phenomenon has led to massive increase of people being placed in prison and the amount of money being used for these prisons. The book, Race to Incarcerate by Marc Mauer, focuses on mass incarceration as our default social policy because of the weak welfare state in the U.S. In the book Mauer discusses the causes and the problems with this policy.
According to statistics since the early 1970’s there has been a 500% increase in the number of people being incarcerated with an average total of 2.2 million people behind bars. The increase in rate of people being incarcerated has also brought about an increasingly disproportionate racial composition. The jails and prisons have a high rate of African Americans incarcerated with an average of 900,000 out of the 2.2 million incarcerateed being African American. According to the Bureau of Justice Statistics 1 in 6 African American males has been incarcerated at some point in time as of the year 2001.
These statistics demonstrate that racialized mass incarceration exists in the U.S. There are a few reasons why African Americans are discriminated against by the legal system. The primary cause is inequitable protection by the law and unequal enforcement of it. Unequal protection is when the legal system offers less protection to African Americans that are victimized by whites. It is unequal enforcement because discriminatory treatment of African Americans that are labeled as criminal suspects is more accepted.
There has always been racial profiling in our history. The problem here is that at some point the ones who are oppressed and discriminated sooner o later will claim why they are treated unequally. There are many examples around the world, but one only has to take a look at how the American society has been designed to realize the great difference between individuals. It was even normal and acceptable to see these differences during the creation of this nation because the ones who supposedly had the power and knowledge of conquering made sure to create a huge division between leaders and subordinates.
The most problematic conclusion about Mass Incarceration, whatever the causes or practices, is that currently America has had the highest national prison rates in the world; furthermore, the rates of minorities (particularly African Americans) are extraordinarily disproportionate to the rates of incarcerated Caucasians. Despite the overall rise in incarceration rates since the 1980s, the crime rates have not been reduced as would be expected. Researchers, activists, and politicians alike are now taking a closer look at Mass Incarceration and how it affects society on a larger scale. In the news every day there are stories about the ways the police abuse their power, whether through physical abuse, or simply just profiling a person because of their race. Racial profiling by the police is a common practice that police use to try and prevent a crime before it happens. Although racial profiling has been shown to disproportionally affect minorities, and has been unsuccessful more often than it has been successful, racial profiling is allowed in law enforcement and there needs to be more to discourage these practices.
