Introduction
In view of all the historical failures in Corrections and the changes with what is criminalized, should Americans transition to more probations and Community Correction programs for guilty offenders or continue the status quo? With the goal of corrections to being to control the unwanted action of the public, is incarceration the best means to insure compliance with the rules of society or could there be better ways to approach the problem? With a suffering economy, new ways must be sought to correct unwanted behaviors and treat offenders. Since corrections covers such a broad area, we will consider only the State of Alabama in an effort to narrow the scope of this document. For our purpose, a working definition of corrections

Incarceration may be best for those who treatment has little hope. There are some who would be better treated by other means. Many crimes have underlying issues. Those issues include things like mental illness, substance abuse, and poverty. Issues like those mentioned will receive help from incarceration alone. Many people with substance abuse issues have underlying issues which would need to be treated if the offender is to break the cycle of addiction. If those issues are not addressed, the cycle will start again when the offender is released. In this case the offender would revolve in and out of the correction system until the underlying issue was addressed. For this reform to happen in a system where underlying issues are the focus of treatment, a new kind of staff will be required. When the system looks more toward treatment, new agents of the government would need to be better trained in many areas.
There would need to be staff trained to identify underlying problems, treat the problems, and supervise the offenders while they are in the recovery phase of the correction process. If the offender is allowed to work on the issues which cause the criminal actions while remaining in society they would benefit in not having to readjust once they left the prison environment. This would be accomplished through more community corrections and probation.
Staff within the corrections system will need to be more specialized in certain aspects of the process and be more of a specialist instead of a general practitioner. The new professional would be more educated and better trained. They would have a narrower field of focus making them better equipped to provide the service needed in the correction
Mandatory minimums for controlled substances were first implemented in the 1980s as a countermeasure for the hysteria that surrounded drugs in the era (“A Brief History,” 2014). The common belief was that stiff penalties discouraged people from using drugs and enhanced public safety (“A Brief History,” 2014). That theory, however, was proven false and rather than less illegal drug activity, there are simply more people incarcerated. Studies show that over half of federal prisoners currently incarcerated are there on drug charges, a 116 percent percentage rise since 1970 (Miles, 2014). Mandatory sentencing refers to the practice of parliament setting a fixed penalty for the commission of a criminal offence. Mandatory sentencing was mainly introduced in Australia to: prevent crime, to incapacitate the offenders, to deter offenders so they don’t offend again, to create a stronger retribution and to eliminate inconsistency. There is a firm belief that the imposition of Mandatory sentencing for an offence will have a deterrent effect on the individual and will send a forcible message to the offenders. Those in favour argue that it will bring consistency in sentencing and conciliate public concern about crime and punishment.
In recent years, there has been controversy over mass incarceration rates within the United States. In the past, the imprisonment of criminals was seen as the most efficient way to protect citizens. However, as time has gone on, crime rates have continued to increase exponentially. Because of this, many people have begun to propose alternatives that will effectively prevent criminals from merely repeating their illegal actions. Some contend that diversion programs, such as rehabilitation treatment for drug offenders, is a more practical solution than placing mentally unstable individuals into prison. Community-based corrections offer a viable alternative to imprisonment. As an alternative, a community-based correction save on cost, reduces prison populations, is an effective form of rehabilitation, is humane, and supported by public opinion. However, despite the potential for community-based correction for reducing prison population, this has not been the case. Judges are reluctant to hand community sanctions, and sentencing philosophy does not support it as an alternative mechanism for punishing offenders (Mackenzie, 2001).
Throughout the history of the United States and including the western world. Corrections have served the country by convicting and sentencing offenders depending on the seriousness of the crime. Along with that today, offenders are either placed in probation, incarcerated or taken to community-based corrections. Even though, corrections have always tried to find ways to deter crime by correcting criminals, the poor economy in our country has been the cause for struggles in the correctional system. Some of the causes of economic issues are the cut of budget, over crowing, lack of programs for people with mental illnesses, and lack of innovation.
The Criminal Justice system was established to achieve justice. Incarceration and rehabilitation are two operations our government practices to achieve justice over criminal behavior. Incarceration is the punishment for infraction of the law and in result being confined in prison. It is more popular than rehabilitation because it associates with a desire for retribution. However, retribution is different than punishment. Rehabilitation, on the other hand is the act of restoring the destruction caused by a crime rather than simply punishing offenders. This may be the least popular out of the two and seen as “soft on crime” however it is the only way to heal ruptured communities and obtain justice instead of punishing and dispatching criminals
Unfortunately, the criminal justice system is a vital piece of today’s society. Without it, the public would be free to do whatever they choose with no real consequence to negative actions. According to the Bureau of Labor Statistics, roughly 3 million workers were employed in the criminal justice field in 2015 (Occupational Employment, 2016). This is made up of countless different agencies, including law enforcement, corrections, homeland security, and many more. Corrections is a key element in the criminal justice system, which has its own unique functional philosophy, administrative structure and functions, theoretical assumptions that govern its existence, organizational mission, goals and objectives, and division of responsibilities.
More are sentencing options are great because just like every person is different, so is the crime. Prison may not always be the most effective response for people, so If courts have options other than incarceration, “they can better tailor a cost-effective sentence that fits the offender and the crime, protects the public, and provides rehabilitation” (FAMM, 2011). Findings have also proven that alternative saves taxpayers money. “It costs over $28,000 to keep one person in federal prison for one year1 (some states’ prison costs are much higher). Alternatives to incarceration are cheaper, help prevent prison and jail overcrowding, and save taxpayers millions” (FAMM, 2011, para. 3). Lastly, alternatives protect the public by reducing crime. There is a 40% chance that all people leaving prison will go back within three years of their release (FAMM, 2011). “Alternatives to prison such as drug and mental health courts are proven to confront the underlying causes of crime (i.e., drug addiction and mental illness) and help prevent offenders from committing new crimes” (FAMM, 2011, para.
The “Tough on Crime” and “War on Drugs” policies of the 1970s – 1980s have caused an over populated prison system where incarceration is policy and assistance for prevention was placed on the back burner. As of 2005, a little fewer than 2,000 prisoners are being released every day. These individuals have not gone through treatment or been properly assisted in reentering society. This has caused individuals to reenter the prison system after only a year of being release and this problem will not go away, but will get worst if current thinking does not change. This change must be bigger than putting in place some under funded programs that do not provide support. As the current cost of incarceration is around $30,000 a year per inmate, change to the system/procedure must prevent recidivism and the current problem of over-crowed prisons.
Every civilization in history has had rules, and citizens who break them. To this day governments struggle to figure out the best way to deal with their criminals in ways that help both society and those that commit the crimes. Imprisonment has historically been the popular solution. However, there are many instances in which people are sent to prison that would be better served for community service, rehab, or some other form of punishment. Prison affects more than just the prisoner; the families, friends, employers, and communities of the incarcerated also pay a price. Prison as a punishment has its pros and cons; although it may be necessary for some, it can be harmful for those who would be better suited for alternative means of punishment.
With the substantial increase in prison population and various changes that plague correctional institutions, government agencies are finding that what was once considered a difficult task to provide educational programs, inmate security and rehabilitation programs are now impossible to accomplish. From state to state, each correctional organization is coupled with financial problems that have depleted the resources to assist in providing the quality of care in which the judicial system demands from these state and federal prisons. Judges, victims, and prosecuting attorneys entrust that once an offender is turned over to the correctional system, that the offender will receive the punishment imposed by the court, be given services that aid in the rehabilitation of those offenders that one day will be released back into society, and to act as a deterrent to other criminals contemplating criminal acts that could result in their incarceration. Has our nation’s correctional system finally reached it’s critical collapse, and as a result placed American citizens in harm’s way to what could result in a plethora of early releases of inmates to reduce the large prison populations in which independent facilities are no longer able to manage? Could these problems ultimately result in a drastic increase in person and property crimes in which even our own law enforcement is ineffective in controlling these colossal increases in crime against society?
“The history of correctional thought and practice has been marked by enthusiasm for new approaches, disillusionment with these approaches, and then substitution of yet other tactics”(Clear 59). During the mid 1900s, many changes came about for the system of corrections in America. Once a new idea goes sour, a new one replaces it. Prisons shifted their focus from the punishment of offenders to the rehabilitation of offenders, then to the reentry into society, and back to incarceration. As times and the needs of the criminal justice system changed, new prison models were organized in hopes of lowering the crime rates in America. The three major models of prisons that were developed were the medical, model, the community model, and the crime control model.
This model of corrections main purpose was to reintroducing the offenders in to the community. This Program was invented to help offenders in the transition from jail to the community, aid in the processes of finding jobs and stay connected to their families and the community. The needs of these individuals are difficult: the frequency of substance abuse, mental illness, unemployment, and homelessness is elevated among the jail population.
All over America, crime is on the rise. Every day, every minute, and even every second someone will commit a crime. Now, I invite you to consider that a crime is taking place as you read this paper. "The fraction of the population in the State and Federal prison has increased in every single year for the last 34 years and the rate for imprisonment today is now five times higher than in 1972"(Russell, 2009). Considering that rate along crime is a serious act. These crimes range from robbery, rape, kidnapping, identity theft, abuse, trafficking, assault, and murder. Crime is a major social problem in the United States. While the correctional system was designed to protect society from offenders it also serves two specific functions. First it can serve as a tool for punishing the offender. This involves making the offender pay for his/her crime while serving time in a correctional facility. On the other hand it can serve as a place to rehabilitate the offender as preparation to be successful as they renter society. The U.S correctional system is a quite controversial subject that leads to questions such as how does our correctional system punish offenders? How does our correctional system rehabilitate offenders? Which method is more effective in reducing crime punishment or rehabilitation? Our correctional system has several ways to punish and rehabilitate offenders.
Law and law enforcement would become more effective and correctional measures could be implemented swiftly, therefore effectively preventing the wrong people from being convicted and placed in correctional facilities and reducing the massive strain on the economy and government resources.
