Physical Property Risks
Physical damage caused to property by fire, flooding and the normal deterioration of property due to weather changes is a risk that GSU property owners face. Due to climate change and unprecedented global warming, flooding and weather changes are an expected phenomena. Flooding and weather changes pose both direct and indirect risk exposure to the University. A direct risk associated with flooding is water sipping into the premises and damaging the property inside causing financial implications to the institution due to replacement of the property. In this particular Article, Pike states that indirect infringement is a risk faced by the University as demonstrated by the copyright infringement lawsuit against Georgia State University. In this particular lawsuit, the University was charged with directly infringing copyright through those web and e reserve services with both vicarious and contributory infringement. The vicarious claim was based on the employer-employee relationship between The University and staff members who were copying materials. The contributory claim was that GSU encouraged and induced faculty and staff to do illegal copying. GSU claimed that any copying done was a fair use however, it also denied that it was directly, vicariously, liable for the acts of staff and faculty. A court agreed that GSU's administration was not directly liable; the copying had been done by faculty and staff members. The court also found that GSU was not vicariously liable, even though it employed faculty and staff who did the copying that may have been illegal; GSU did not profit from the copying. On the issue of contributory liability, the court felt that while GSU was not specifically encouraging or inducing faculty and staff to violate copyright-GSU had policies that said only fair use copying should be done-the court wasn't certain about these policies in practice. Several risks are associated with these particular activities. Financial abuse is a risk attached to compensation and benefits obligation of the institution. Employees are bond to abuse this particular benefit if a risk analysis is not taken into consideration.
Discriminatory practices, hiring unsuitable or unsafe candidates, and wrongful hiring are risks associated with the hiring of employees who work for the institution. This particular risk is important to the institution as its reputation is also at stake. The Human resource policies of the institution should be able to address this particular area effectively to ensure human rights laws are observed. Environmental and Personal injury or death relate to occupational health and safety. Safe working conditions should be provided to the employees Safety checks and clothing should also be available to the employees suitable to the kind of work they undertake in the
