If they are capable enough to load a gun or grab a weapon to kill someone they know the crime they are going to commit as well as the consequences for their actions. Unfortunately, these two cases are not uncommon in the justice world. As a matter of fact, “by 2010, Florida had sentenced more than a hundred children to life imprisonment without parole for non-homicide offenses,” (Stevenson 153). One of the primary reasons for this originated in the idea that harsher punishments will act as a deterrent for kids who want to break the law. However, recent studies have suggested that because the prefrontal lobe of the brain is still in development until the age of twenty, children don’t have the mental capacity to make the best decisions, especially under stress. Additionally, children normally wouldn’t have access to weapons or drugs, which allows the argument that adults should be held responsible for making such objects available to them in the first place (Reaves).
Heinous crimes are considered brutal and common among adults who commit these crimes, but among children with a young age, it is something that is now being counted for an adult trial and punishable with life sentencing. Although some people agree with this decision being made by judges, It is my foremost belief that juveniles don’t deserve to be given life sentencing without being given a chance at rehabilitation. If this goes on there’s no point in even having a juvenile system if children are not being rehabilitated and just being sent off to prison for the rest of their lives and having no chance getting an education or future. Gail Garinger’s article “ juveniles Don’t deserve Life sentence”, written March 14, 2012 and published by New york Times, mentions that “ Nationwide, 79 adolescents have been sentenced to die in prison-a sentence not imposed on children anywhere else in the world. These children were told that they could never change and that no one cared what became of them. They were denied access to education and rehabilitation programs and left without help or hope”. I myself know what it’s like to be in a situation like that, and i also know that people are capable of changing even children when they are young and still growing.
For example, a 12 year old kid, Lionel Tate, beat and killed a 6 year old girl to death because he was imitating professional wrestlers he saw on TV. Life in prison without parole or even going to an adult prison is extreme for a 12 year old. Many kids who make it out of the adult system end up worse than when they went in because they come out as hardened criminals. In another case, Nathaniel Brazill, who shot and killed his teacher at the age of 13. The crime was heinous, but the issue with convicting teenagers as adults is that during the teenage years, gray matter in the brain which supports all our thinking and emotions is purged at a rate of 1 to 2 percent a year. This occurs in the frontal lobe of our brain, which controls impulses, risk-taking, and self-control. Teenagers brains work differently and are not yet fully functioning compared to adult brains, evidence enough juveniles should not be tried as adults. However many prosecutors and the families of victims claim that teenagers know it is wrong to kill and the courts need to crack down on these cases in order to send a message to teenegaers across the US to not commit murder, or they could face life without parole. That may be true however, giving kids the message that they are not curable or worthy of a second chance sends out the wrong message and makes other countries in the world look down on the US. Also, they claim that many teenagers commit “thrill kills”, and nothing is wrong with them mentally. They also state that if brain development was the reason, that kids should kill at the same rate as adults. Their main argument is that the murders leave families in ruins and forever scar them when they lose a loved one. Once again many of these arguments are true, but kids are less mature and more vulnerable to peer pressure because their characters are still forming. Children
Although some would argue that juveniles undergo a series of brain development in which they lose brain cells that control their impulses, risk taking, and self-control (Thompson 46). However this lost during development does not excuse juvenile from their accountability, instead they should acquire special attention, proper nurturing and guidance during development in order to help them make better decisions. Thus teenagers accused of violent crimes should be tried and sentenced justly, regardless of age, to ensure the law's equality and educate juveniles regarding the potential severity of their actions' consequences. That is how we'll be able prevent future acts of violence and crimes from occurring in society.
Juveniles are more than just kids. They are capable of doing anything an adult is capable of doing. One has probably heard the saying, “If you want to be treated like an adult, then act like an adult.” If they’re going to do crimes that “only” adults are capable of doing, then they should treated like an adult and be tried and sentenced like one. Imagine being close to a murder victim, wouldn’t you want them to feel hell? “How would you feel if you never got to see your child alive again while their killer served only a short sentence before being released from jail?” (hchs1259). This quote hits hard. One can only imagine being in the position of a parent whose child was murdered.
There are millions of adults in federal prison, but The United States is the only country in the world that condemns children to die in prison (Pequeneza, 2014). It’s sad to think about children being sentenced to life in prison, and frankly it is a disturbing and a scary fact to face. However, in recent years the U.S Supreme Court has made it illegal to charge juveniles with life sentencing for anything less than murder (Pequeneza, 2014). This new law gives children a second chance at life when they are finally released from prison. Many children are forced to be in a household that is not suitable for a developing child. Guilty! As the gavel hits the sound block, everyone is amazed at the verdict. This teenage boy is sentenced to a life in prison without parole. As you read this in newspapers, magazines, and even online, what goes through your head? You may be thinking, “Why is this teen being tried as adult, he is just a kid?” While he is “just a kid”, and this is a widely held opinion, but it is not mine. Should minors who commit violent crimes be tried as adults? Absolutely. Just because minors are young they do have the ability to know what is right from wrong. Since these minors have committed the crime, they need to be held accountable. If a minor has acted as an adult, they need to be treated like adults. Lastly, minors need to know that their actions have consequences, no matter what age.
Although children are constantly being exposed to violence through movies, television, and video games which could influence the harm done, kids today are more sophisticated at a younger age; they understand the implications of violence and how to use violent weapons. In the article “Kids are Kids- Until They Commit Crimes”, Marjie Lundstrom explores the stories of two young boys, Lionel Tate and Thomas A. Preciado, who both commit violent crimes and try to play it off. Tate unsuccessfully tried to put pro wrestling on trial for “savagely beating a six-year-old girl..” and Preciado claimed he was mimicking a TV show of robbing a bank and was tried as an adult for stabbing the mini mart clerk to death. The real question is how do we know if these indications are true, if these children really were imitating or if those are all just excuses. It is absurd to argue that a modern child, who sees the effect of violence around him in the news every day, does not understand what it means to kill. The fact that child killers know how to load and shoot a gun is an indicator that they understand exactly what they are doing and should not be able to make excuses as such. The first article; “Adult Crime; Adult Time.” by Linda J. Collier is about how the juvenile delinquents of the world should be thrown right in with the hardened criminals. She talks about the Jonesboro, Arkansas incident in which 11-year-old Andrew Golden and 13-year-old Mitchell Johnson, slaughtered their classmates as they ran from the school building. They pulled the fire alarm and began their assault with a barrage of bullets. In this particular situation, “they are still regarded by the law as children first and criminals second.”(Pg. 620). This has not been the first time that young children have committed such crimes, but the average of violence committed by children has risen by 60% since 1984. She claims that because of these statistics, we need to update the juvenile justice system. “In recent years many states have enacted changes in their juvenile crime laws and some have lowered the age at which a juvenile can be tried as an adult for certain violent crimes.” (Pg. 620) According to this author, she feels that it is a start in the right direction. She claims that she has represented children as a court appointed guardian and is humbled trying to help children out of their difficulties which often due to circumstances beyond their control. Still, for violent crimes, she feels that “children who knowingly engage in adult conduct and crimes should automatically be subject to adult rules and adult prison time.”
Sentencing juveniles to capital punishment is unethical and cruel. It is too severe for juveniles without the full reasoning ability and limited brain development to be sentence to the death penalty. Horn (2009) writes, “Youths lack the sense of responsibility that society requires of adults. Their personalities are not yet fixed… Young people have to little experience to fully grasp the consequences of their actions.” (Horn, 2009). This shows that juveniles do not have the experience that adults have to be like adults. Also, Stevenson (2014) writes, “Contemporary neurological, psychological…evidence has established that children are impaired by immature judgement, an underdeveloped capacity for self-regulation and responsibility, vulnerability to negative influences and outside pressures, and a lack of control over their own impulses and their environment.” (Stevenson, 2014, pg. 267-268). Stevenson (2014) is basically saying that children are not matured as adults and the court needs to look at these facts before giving such punishments. Not only that, Stevenson (2014) says, “Young adolescents lack life experience and background knowledge to inform their choices; they struggle to generate options and to imagine consequences; and, perhaps for good reason, they lack the necessary self-confidence to make reasoned judgements and stick by them” (Stevenson, 2014, pg. 268-269). Felonies are crucial, therefore if one has the capacity to commit such serious crimes then they definitely do not have the mindset of a child. Juveniles who commit intensive crimes as such should receive life without parole because they are responsible, dangerous, and unforgivable. Guilty teenagers should pay the price, even if that price is life without parole because they are responsible for their actions.
Kids are old enough to know the consequences of a crime. Gun responsibility is a contributing reason to why kids should be held accountable for their actions. I truly believe that minors should be responsible for their crimes and know the consequences of the crimes committed. I hope you will too. Many adults are treated unfairly compared to minors in sentencing for crime.
