Time and time again technology has transformed faster than we can control it. Facial recognition is being used gradually by social media, advertisers, stores and security companies. With no federal laws in place regulating the usage of facial recognition these companies are able to identify people without their consent. Because of this it is extremely difficult if possible to remain anonymous in public. We need a federal law, like the BIPA in Illinois and the laws written by Brian McCall, which will limit the usage of facial recognition to those who specifically opt in and give their consent. I’m going to start off by stating that facial recognition has some benefits to offer for both businesses and consumers. Up until the last couple of years, this technology has been generally used by law enforcement to stop known criminals and for border control, but since then companies have shown more interest in using it for commercial uses. In Europe, citizen’s right to privacy regarding facial recognition is highly protected. A commercial company must pursue permission before using facial recognition. Specifically in the UK, there is an act that “stipulates that we have to be informed when we are under camera surveillance and by whom.” They also can request any footage they are in. Currently in the U.S, only Illinois and Texas have state laws which cover the privacy concerns of facial recognition. Although these state laws are in place, Companies such as Facebook and Shutterfly have decided not to distinguish any differences for the two states compared to the rest of the country. This has resulted in numerous lawsuits piling up over the past year which will test these laws. Even if the cases are won, it doesn’t protect everyone who doesn’t reside in Texas and
